1. Contracting Activitv:

Naval Surface \Varfare Center, Corona Division (NSWCCO). Contracts Department, Code 0222

2. Description of the Action Being Approved

J&r\No.:

Code: 0222

The NSWCCO Contracts Depart1nent intends to a .. vard a Finn-Fixed-Price (FFP) supply contract on a sole source basis for the purchase of the Scorpion Trailer 1·0\ver Units in support of the Weapons Impact Scoring Set (WISS) projects under the cognizance ofthe NSWCCO Range Systems {RS) Depart1nent to Aluina To\ver Company, Inc. (Aluma). This Justification Approval {J&A) shall be effective fro1n the date of approval to the end to the contract tern1. The solicitation number for this procurement is N64267- l6-T-0247.

3. Description of Supplies/Services.

The NS\VC Coro11a Division, Range Syste1ns Engineering DepartJnent, (RS32), has been tasked to procure six (6) trailer to\ver units for the WISS system. The required units v,:il! be installed on four (4) ranges in . The WISS provides pilot training for delive1y of air-to-ground ordnance and ship's cre\v operational proficiency in the delivery of ship-to-shore gunfire. By computer processing impact video taken ofthe target area, the WISS detern1ines the position of ordnance iinpacts relative to a knov;n target location.

"fhe \VJSS is a govern1nent O\.Vned and developed system using proprietary govern1nent developed sofh-vare. As part of the agrce1nent provided by this FMS Case funding, RS32 is to procure. integrate/test, and deliver to,vable trailer tO\.Vers and related instruinentations to four different ranges across . Due to the terrain and limited resources at the operational sites, each tower has to be self-pov.·ered and tnovable to different targets v.·ithin the range that are spread out across many 1niles. Each to\ver ultimately provides high-definition video and the Global Positioning Systen1 {GPS) location of the video source to tl1e Range Operations Center (ROC) V.'irc!essly as part of the integrated WISS syste1n. The video can1eras must have a clear line of sight to the targets for scoring accuracy and arc mottnted on the top of the tov.'ers. These lo•vvable trailer to\vers are critical components of the WJSS.

The Government"s 1ninin1u1n needs have been verified by the certifying technical and require1nents personnel.

4, Statutory Authoritv and Regulatorv Authority Permitting Limited Sources:

l 0 U .S.C. § 2304( c)( I), Only one responsible source and no other supplies or services v.·ilJ satisfy agency requiren1ents as implen1entcd by FAR 13.501(a){1 )(ii).

5. Rationale ,Justifying Use of the Cited Authority.

In Novetnber 2014, the acquisition of the first two (2) towable trailer to\vers was a\varded to Alun1a: under contract nu1nber is N64267- I 5-P-0008. This contract was competitively solicited, and subsequently awarded to Aluma. These t\vo (2) trailer to\vers \vere delivered to NSWCCO and are being integrated v.·ith Govcrnment-o\vned \V!SS hard\vare to satisi}' custoiner's require1nents. The Gove1nment has spent significant effort and engineering to design the installation criteria and integration plans for the Governn1ent owned WISS hard\\·are onto the Alun1a Tiv153- 70EB4/T2-60UGL trailer towers. The fo!lo\ving is a unique characteristic that dictates the use of Alutna part nuinber TM53-70EB4ff2-60UGL for this requirement:

! . The feature critical to the WISS is the Patented Radial Pressure Slide Bar technofogv used on the all-alun1inun1 telescoping to\ver. This unique design gives the Alu1na self-supporting tov;er the ability to e\iininate the use of guy \Vires and thus saving critical tilne and manpo\\·er V.'hen establishing con1munications. This is a proven design and gives the end user the ability to complete the entire trailer to\ver setup in 15-20 rninutes. During operation, one cannot afTord the ti1ne lost when having to install guy wires, which can take up\vards oft\vo (2) hours to setup. The slide bar syste1n uses a custorn safety interlock '"'ith a mechanical safety stop which provides an extra level of operational safety and is not available through other systems.

Using a product other than the specified source would cost the government a total of in hardware and labor cost due to required re-deve!op1nent of other portable to\\·ers. Table l shows the labor hours spent up to J\.1ay 2016.

Redeveloping a different trailer solution v.·ill adversely i1npact the project funding and schedule, thereby severely impacting the Navy's ability to complete the project on time and on budget.

The above costs are not expected to be recovered through co111petition based on the projected dollar value oflhe requireinent.

6. Description of Efforts Made to Solicit Offers from as Many Offcrors as Practicable.

In accordance with OF ARS PG! 206.302~1 (d) a request JOr information (RF!) \Vas posted on Federal Business Opportunities (FBO) on 23 June 2016. The purpose ofthe RF! was to request and collect infonnation froin industry in regards to current n1arket conditions for po1table trailer tov.'ers. In response to the RF! there v.·ere four ( 4) interested vendors. v.·hich were all s1na!I businesses, who provided their capabilities.

The RS Depart111ent Technical Teain assessed all capability statements received in response to the RF!, the RS Departinent 1'echnical Teain determined that Aluina Tov.'e!' was the only co1npany capable of providing a Con1mercial offthe Shelf product that 1net all of the Government's salient characteristics specifically the Patented Radial Pressure Slide Bar technology.

Although devetop1nental products were offered, the government cannot risk extending the schedule, funding 1nore labor, and any other resources to re-evaluate and retest a new product at this ti1ne. The cost associated in this effort is detailed in Tables I and 2 above.

7. Determination of Fair and Reasonable Costs.

The Contracting Officer \.Viii use price analysis, including but not limited to historical cost estitnating relationships from previous procuren1ents to detennine that the final price Lo the Government is fair reasonable. Assistance from the Requiring Technical Activity inay also be utilized to analyze, evaluate and negotiate based upon detailed Data Other Than Certified Cost or Pricing Data. The Contracting Officer has detennined that the anticipated price to the Govem1nent for the supplies covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition.

For the reasons set forth in Paragraph 5 and 6, NSWCCO Corona has no imn1ediate plans at this ti1ne to compete future contracts for the type of supplies covered by this document. The govern1nent projects to re-evaluate the design and performance ofthe entire WISS syste1n in fiscal year 2022.
