4. Statutory Authority Permitting Other Than Full and Open Competition 10 U.S.C. 2304(c)(1). Only one responsible source and no other supplies or services will satisfy agency requirements in accordance with FAR 6.302-1(c) and FAR 6.302-1(a)(2)(ii)
5. Rationale Justifying Use of Cited Statutory Authority
The Data Analysis Control Group (DACG) is a collection of hardware and software used by USMC FMF Calibration Labs. The DACG supports the calibration labs by providing TMDE/Metrology technicians the ability to capture instrument data, environment data, utilize calibration procedures, utilize automated maintenance functions, record and archive calibration traceability data and provide inventory control accountability within the calibration lab.
The replacement to the existing obsolete calibration management software package was chosen by the program office at Marine Corps Systems Command PM115.4. The Army was the integrator responsible for procuring the equipment and building new calibration facilities (ANTSM/214A) for the Marine Corps. A test license of the software was purchased by the Army integrator for function testing of the software during the testing phase of the calibration facilities. The software listed in the specifications is required to field to remaining USMC FMF Calibration Labs.
The FLUKE MET/TEAM software is listed in the DON Application Database Management System (DADMS) which is the authoritative data source for approved DON Software having met CDA and BCA requirements based on validations of specific functional and technical requirements.
The Global Command Support System – Marine Corps (GCSS-MC) is the legacy logistics system for the Marine Corps. The MET/TEAM software is capable of recording and archiving data fields required by the USMC UM/4000-125 – GCSS Field User’s Manual.
MET/TEAM software supports the traceability and record keeping requirements of quality and accreditation standards, including ISO/IEC 17025, ISO 9000, ANSI Z540, and FDA 21 CFR Part 11. MET/TEAM supports electronic signatures and audit trail as required by 21CFR Part 11. It records all changes and maintains them in history to form an audit trail. Tt documents the quality process for the criteria used when deciding whether to return an instrument or keep it for repair and/or recalibration. These features support compliance with many quality and regulatory standards. MET/TEAM supports the requirements of USMC FMF Calibration Labs, specifically ANSI-Z540/ISO IEC 17025 requirements for reverse traceability.
MET/TEAM has been tested to work within the strict security requirements of the DACG standalone environment and functions with the hardware and software listed within the DACG’s DIACAP’s accredited package. Procurement of any other Calibration Management System would result in the required recertification of the DACG. This would require hundreds of labor hours to reconfigure and test the new software within the existing DACG software configuration and could require new software programs and licenses to support the CMS (i.e. – Using Oracle vs SQL). Changes to the configuration will require the DACG to submit for Independent Validation and Verification audits (IV&V). Any security vulnerabilities exposed by the IV&V audit would trigger follow up audits; past IV&V audits have exceeded $8,000 per audit. The software would then be required to undergo Field User Testing (FUT) to verify the validity of data recorded and ability to meet USMC TI-4733-35 and TI-4733-OD/1 requirements for Calibration Laboratories and Measuring Test Equipment. A FUT can take up to 60 days to complete, and would require the Marine Calibrators to perform double data entry into the existing Calibration Management System and new Calibration Management System. The data generated by both systems would be collected and compared at the end of the FUT.
This procurement will support the program office to field licenses to remaining USMC FMF Calibration Labs.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable A Sources Sought Notice was posted on FEDBIZOPPS (FBO), indicating the Government’s intent to sole source this requirement to Fluke. The posting was created on 15 September 2015 and closed on 1 October 2015. Fluke responded to the sources sought notice on 1 October 2015. They stated that the items in the solicitation are available for purchase directly from Fluke, and those items are not available through distributors or other resellers. There were no other vendors that submitted any information that indicated any interest. The market research did not supply any other vendor or alternative to this requirement. Award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. The market research was completed on 1 October 2015.
7. Determination of Fair and Reasonable Costs The Contracting Officer will use price analysis, including historical cost estimating relationships from previous procurements to determine that the final price to the Government is fair reasonable. Assistance from the Defense Contract Audit Agency (DCAA), the Defense Contract Management Agency (DCMA), and the Contracting Officer Representative (COR) or Engineering Requirements Officer (ERO) will be utilized to analyze, evaluate and negotiate based upon detailed pricing data. The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition For reasons set forth in Paragraph 5, NSWC Corona Division has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, NSWC Corona Division will assess whether competition for future requirements is feasible. The Contracting Officer is not aware of any specific actions that would further remove barriers to competition.
