About this file
This document is a justification and approval for use of other than full and open competition. The Naval Sea Systems Command, Naval Surface Warfare Center, Corona Division requires ten King Nutronics Pneumatic Control Unit Assembly with Hoses model 3461-2-1 for a total estimated value of $345,858. The units will be used to verify the accuracy and precision of test instruments at Naval Calibration Laboratories. The justification cites 10 U.S.C. 2304(c)(1) and states that only King Nutronics can meet the agency's requirement as the units are a component of the King Nutronics Pneumatic Pressure Calibrator, which is the only portable unit that can generate pressures up to 10,000 pounds per square inch as required. Developing new calibration procedures for an alternative product was estimated to cost over $3 million in engineering hours. A sources sought notice received no responses.

J&A Number:50,316 Ser Code 02/0244
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity
The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center, Corona Division (Corona Division), Contracts Department, Code 0221.
2. Description of the Action Being Approved
Award of a Firm-Fixed-Price(FFP), supply contract on a sole source basis for the procurement of King Nutronics Pneumatic Control Unit Assembly with Hoses (PCUs) model 3461-2-1 to King Nutronics. This J&A shall be effective from the date of approval to the end of the contract term.
3. Description of Supplies
Measurement Science and Engineering Department, Metrology and Calibration (METCAL) Program has a requirement to procure King Nutronics PCUs. These PCUs will be used to verify the accuracy and precision of test instruments such as variable area flowmeters, engine airflow test standards, and cylinder pressure indicators at all level Naval Calibration Laboratories. The table below specifies the manufacturer part number and description for this sole source requirement:
Quantity Manufacturer Model Number
Part Description
10 King Nutronics 3461-2-1 Pneumatic Control Unit Assembly with Hoses
The total estimated value of this acquisition is $345,858.00 and will be funded with Fiscal Year 2023 (FY23) Other Procurement Navy (OPN) funds.
J&A Number: 50,316
Appropriation FY23 Totals
OPN $345,858 $345,858
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. § 2304(c)(1) [10 U.S.C. § 3204(a)(1)], only one responsible source and no other supplies will satisfy agency requirement. The statutory authority permitting this sole source action is 41 U.S.C. § 1901, simplified acquisition procedures - a sole source acquisition using simplified acquisition procedures for the acquisition of commercial items, as implemented by FAR 13.501(a).
5. Rationale Justifying Use of Cited Statutory Authority
King Nutronics Pneumatic Control Unit Assembly with Hoses (PCU) model 3461-2-1 is one of three components that make up the King Nutronics Pneumatic Pressure Calibrator (Calibrator). The Calibrator is the only unit available that is portable, ruggedized, and can generate 10,000 pounds per square inch (PSI) pneumatically with a specific design to meet the Government’s minimum requirements.
Specifically, the PCU is the primary component of the Calibrators which also include the Gage Accessory Kit and the Nitrogen Supply. Both the Gage Accessory Kit and the Nitrogen Supply were designed to safely and quickly connect and disconnect from the PCU for onsite mobile use. In addition, the Nitrogen Supply was designed to provide enough Nitrogen to allow the PCU to provide up to 10,000 PSI within its own system without the need for additional Nitrogen recompression chambers.
The entirety of the King Nutronics Pneumatic Pressure Calibrator is required for full capability to support Navy requirements pneumatically up to 10,000 PSI. This is essential to the Government’s requirement and other products lacking these features cannot meet the Agency’s need. Furthermore, the PCU is the only part available that is compatible with the Calibrator, and cannot be substituted for other variant models.
The Calibrator is specifically utilized in 23 Navy Instrument Calibration Procedures (ICPs). The cost of revising a single ICP is 120 engineering hours; since there are 23 ICPs, it would take 2,760 engineering hours. Adding to this cost, if a different model is procured, the Government would need to develop a new ICP to calibrate the new model. The cost to develop a new ICP is 350 hours for a combined total of 3,110 engineering hours. Based on the current FY23 stabilized rate of per hour, the total duplication of cost to the government if a different model is procured would be X 3,110 for a total of
Additionally, the real-time delay is estimated around 20-24 months to complete ICP modifications at each step for the requisite research, review, and approval throughout the technical, financial, and leadership chain of command.
Procurement of any other control unit or model from another manufacturer would severely affect the readiness on ships and submarines, causing ships to remain docked at ports pending mission readiness status.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
A sources sought notice was posted on System for Award Management’s (SAM) website on February 2, 2023 with a closing date of February 17, 2023 to express the government’s intent to purchase Pneumatic Control Units and to request interested parties submit a capabilities statement. Zero interested parties responded to the notice. The Contracts Specialist contacted King Nutronics to request additional information on the availability of authorized resellers. In response, King Nutronics responded stating that they do not have any authorized resellers. No additional market research was conducted because it is not practicable for any company other than King Nutronics to provide the required PCU’s model 3461-2-1 for the reasons discussed above.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, Corona Division, Contracts Department, Code 0221 has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, Corona Division will assess whether competition for future requirements is feasible.
