4. Statutory Authority Permitting Other Than Full and Open

Competition

10 U.S.C. 2304(c)(1) as implemented by paragraph 6.302-1 of the Federal

Acquisition Regulation (FAR): Only One Brand of Items and No Other Supplies or Services Will Satisfy Agency Requirements

5. Rational Justifying Use Of Cited Statutory Authority

Pursuant to 10 U.S.C 2304(c)(1), as implemented in FAR 6.302-1, The hardware requested matches the LCS baselines used in the Fleet today.

The In-Service Engineering Agent (ISEA) for the baselines is NSWC Port

Hueneme Division (PHD). The ISEA's design specifies the requested brand for compatibility with the Fleet. The hardware being procured is required to match the installed shipboard configuration to properly support engineering investigations, documentation development/validation efforts, and direct fleet support efforts. All current software and documentation is built around the specific hardware. The cost to re-engineer to accept an alternate, as well as, the cost to re-write associated support documentation

(ex. technical manuals, drawings) would be cost prohibitive. Additionally, the program cannot use these items as battle ready spares if they do not match the installed fleet configuration. This procurement is initiated to assemble the various baselines in the LCS Warfare Engineering Capability

(LWEC) lab at NSWC PHD. In-Service Engineering Agent's (ISEA) design specifies the requested brand for compatibility with the Fleet. The hardware being procured is required to match the installed shipboard configuration to properly support engineering investigations, documentation development/validation efforts, and direct fleet support efforts. Cisco is the manufacturer for these highly specialized parts which are critical for LCS Warfare Engineering Capability (LWEC) lab at PHD NSWC.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

Market research by Contract Specialist has shown material available by many sources. A Solicitation/Synopsis N6339419T0066 will be posted on the Government Point of Entry. The hardware requested is currently used on Littoral Combat Ship (LCS) platforms. The requested hardware for purchase for use in the LCS Warfare Engineering Capability (LWEC)

Lab must be the exact same equipment as defined in Allowance Parts

Lists (APLs) as they may be required for use as “battle ready spares” whereupon they will be removed and re-installed in U.S. Navy LCS platforms to resolve Casualty Reports (CASREPs) and Automated Work

Numbers (AWNs). Only equipment identified on APLs may be allowed for installation on U.S. Navy LCS ships. Non-branded equipment might not meet form, fit and function requirements and may have unknown compatibility issues.

The following parts are unacceptable: refurbished products, re-certified products, used products, compatible products, products from non-authorized Resellers, gray-market, and any products that will void the warranty of the new hardware.

7. Determination Of Fair And Reasonable Cost

The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by the J&A will be fair and reasonable.

8. Actions To Remove Barriers To Future Competition

NSWC PHD Contracts Department has no plans at this time to compete future contracts for the type of supply covered by this document.

This is expected to be the second to the last buy for this supply.
