CONTRACTOR SUPPORT

Notice: Navy Use of Support Contractor For Contract Closeout Functions

Naval Medical Logistics Command (NMLC) uses two private contractors in support of the contract closeout process. Those companies are Contracting Resources Group (CRG) of Federal Hill, MD, doing business under the authority of the Small Business Administration’s 8(a) program and the Ability One Program, doing business under the authority of the Javits-Wagner O’Day Act (41 U.S.C. § 47).

The contract closeout process includes activities such as processing deobligation modifications, obtaining contractor and requiring activity concurrence, preparing the DD-Form 1594 (Contract Completion Statement), and preparing closed files for archiving. Support contractors may perform additional administrative duties, including filing and processing simple administrative modifications. Performing these functions require the contractor employees to have access to the contract file. Therefore, information you provide to the Government or information already in the possession of the Government may be viewed by these support contractors in the course of performing contract close-out functions. The information that may be made available to the contractor may include pricing and technical proposals and performance information.

NMLC has signed Non-Disclosure Agreements with each support contractor employee and has required both contractors to provide a Conflict of interest Mitigation Plan to ensure these employees are firewalled from all business development activity.

By submission of a proposal in response to this soliciation, the offeror and its subcontractors consent to access of their business sensitive/confidential or proprietary data by the Government’s support contractor personnel in order to perform close out services.

EVALUATION FACTORS FOR AWARD

The Government intends to award a contract to the contractor whose response conforms to the solicitation and will be most advantageous to the Government, price and other factors considered.

Only offerors whose proposal conforms to the SOR will be further evaluated. Those offerors whose proposal conforms to the SOR will be futher evaluated as part of a best value procurement. The Government may elect to award to other than the lowest price, based on the evaluation of the non-price factors and the best value to the Government. The Government anticipates award of a firm fixed price (FFP) contract.

The Government intends to evaluate proposals and award a contract without discussions, but reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government reserves the right to make no award as a result of this solicitation.

Proposals must include sufficiently detailed information to enable evaluation based on the following factors listed below in order of decreasing priority:

1. Past Performance

2. Small Business Participation Commitment Document/Small Business Subcontracting Plan

3. Price

Conformance to SOR – Evaluation shall include ability to meet the SOR of this requirement. Vendors not meeting all requirements will not be further considered for award unless there are no other technically acceptable offerors.

This will be rated either Pass or Fail.

Past Performance – The Government will evaluate the offeror's recent and relevant past performance record based on (1) the delivery of the proposed or Radiopharmaceuticals that the offeror has delivered to previous customers and

(2) the quality and timeliness of the technical assistance or other support that the vendor has supplied to its customers, following the delivery of the Radiopharmaceuticals. Recent is defined as occurring within the past 3 years. Relevant is defined as providing radiopharmaceuticals, in terms of scope and complexity for a recent effort accomplished by the offeror.

Offerors shall provide past performance data for all radiopharmaceutical contracts for the last 3 years, up to 3 data points, or 3 data points for delivery starting with the most recent contracts for which delivery occurred at least 3 months prior to the closing of this solicitation. The data shall include the following:

• Organization/Location

• Person of Contact (POC) (Including Number, Email Address)

• Contract Reference Number and Contract Date

• Value of the Contract (Note: Rounding to the nearest $5,000.00 is acceptable)

• POC has agreed to be contacted as a reference

The Government reserves the right to consider other past performance information at its disposal, in addition to any information obtained from the references provided above. The Government is likely to randomly select references provided for contact and does not commit to contact every reference. It is the responsibility of the offeror to ensure names and phone numbers of points of contact (POCs) are verified and accurate. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will not be evaluated favorably or unfavorably on past performance. The offeror will receive a neutral rating.

Ratings regarding the relevancy of past performance records are assigned as follows:

Rating Description

Relevant Present/past performance effort involved in providing radiopharmaceuticals, in terms of scope and complexity for a recent effort accomplished by the offeror.

Not Relevant Present/past performance effort involved little or none of the scope and complexity in providing radiopharmaceuticals for a recent effort accomplished by the offeror.

Relevant records will be used to determine past performance confidence assessment ratings according to the following scale:

Rating Description

Substantial Confidence

Based on the offeror’s recent/relevant performance record and the quality of their past performance, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence

Based on the offeror’s recent/relevant performance record and the quality of their past performance, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Limited Confidence

Based on the offeror’s recent/relevant performance record and the quality of their past performance, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s recent/relevant performance record and the quality of their past performance, the Government has no expectation that the offeror can successfully perform the required effort.

Unknown Confidence

(Neutral)

No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

Small Business Participation Commitment Document/Small Business Subcontracting Plan All Offerors (both large (other than small business) and small businesses) will be evaluated on the level of small business commitment that they are demonstrating for the proposed acquisition, and their level of commitment to utilizing small businesses in performance of prior contracts. In addition, for those other than small businesses, the offeror(s) shall provide a small business subcontracting plan with their proposal. If an offeror fails to negotiate a subcontracting plan acceptable to the Contracting Officer within the time limit* prescribed by the Contracting Officer, the offeror will be ineligible for award. If the offeror believes there are no subcontracting possibilities, the offeror shall submit documentation with their proposal sufficient to justify its position.

*Time specified by the Contracting Officer equals prior to award or established time specified by the Contracting Officer if negotiation is required.

The small business participation commitment document and the small business subcontracting plan (if applicable), will be evaluated on an “Acceptable (Pass)” or “Unacceptable (Fail)” basis.

The following shall be evaluated from the Small Business Participation Commitment Document and/or the Small Business Subcontracting Plan:

a. The extent to which such firms, as defined in FAR Part 19, are specifically identified in proposals;

b. The extent of commitment to use such firms (enforceable commitments will be weighted more heavily than non-enforceable ones);

c. The complexity and variety of the work small firms are to perform;

d. The realism of the proposal;

e. Past performance of the Offeror in complying with requirements of the clauses at FAR 52.219-8, Utilization of Small Business Concerns, and, for all large business Offerors, FAR 52.219-9 DEV, Small Business Subcontracting Plan;

f. The extent of participation of such firms in terms of the value of the total acquisition;

g. The extent to which the Offeror provides detailed explanations/documentation supporting the proposed participation percentages, or lack thereof.

The Department of Defense (DoD) has established small business goals as an assistance to assure small business receives a fair proportion of DoD awards. The small business subcontracting goal for this requirement is: 5% of the total contract value**.

**The Government recognizes that this goal is stated as a percentage of the total contract value for the small business participation commitment; whereas, the goals included in the subcontracting plan (FAR Clause 52.219-9) are stated in terms of a percentage of total subcontract dollars.

The Government will assign a rating to the Offeror’s Small Business Participation Commitment Document and, if applicable, the Offeror’s Small Business Subcontracting Plan.

Price – Reasonableness: The degree to which the offeror’s total proposed price represents a fair and reasonable price.

Completeness: Offeror’s have included pricing for all line items, are registered in SAM at time of award, and have provided acknowledgement of all amendments.
