MEMORANDUM
Subj: SOLE SOURCE MEMORANDUM TO ACQUIRE M.A. TECH SERVICES, INC. CUSTOM MASS SPECTROMETER
(Purchase Request TBD)
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Sole Source Justification.”
This is a sole source justification. Contracting activity is NSWC PCD, Code 024, 110 Vernon Avenue, Panama City, FL 32407.
2. Nature and/or description of the action being approved.
This action will award a firm fixed price purchase order to M.A. Tech Services, Inc. to acquire a customized Perkin Elmer Mass Spectrometer MGA 1100 from Mass Spectrometer for test subject and atmospheric analysis at NEDU
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
This acquisition will be conducted using simplified acquisition procedures with a total estimated value of $80,000.00 with two options estimated at the same value. The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This purchase will be funded with re-imbursable project and FY-19 command funds.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR 6.302- 1(a)(2)(iii)(B).
Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1. The equipment listed above is modernized by M.A. Tech Services, Inc., and they are the only source for that meet this requirement for the following reasons: NEDU currently owns three Perkin Elmer MGA 1100s that have been one of the key scientific data acquisition elements at NEDU since 1985; however, the electronics and user interface have become antiquated and far more costly to maintain.
The custom modified M.A. Tech MGA 1100 keeps the desired response time, accuracy, and capabilities, but digitizes the control elements to simplify the user needed knowledge to use and to calibrate unit.. Market research has yielded no better designed or accurate magnetic sector mass spectrometer than the MGA 1100; however, the system is almost impossible to maintain due to parts availability and service centers. M.A. Tech’s utilization of LabVIEW software interface removes these obsolete parts and service constraits, and falls in line with NEDU’s already existing backbone of National Instrument Products. This is a propriety mass spectrometer; other sources do not have the rights, equipment to manufacturer, or provide these listed systems. Other manufacturer’s mass spectrometers are not compatible with the established backbone components in use at NEDU. Use of another mass spectrometer would not support current OSF Medical Deck and Test Pool DAS Room equipment, therefore requiring a change from the original configuration which would invalidate certification of equipment.
As such, the Government does not expect significant savings through competition and does expects significant and unacceptable delays that will negatively impact this requirement. Therefore, it is in the Governments’ best interest to award on a sole source basis to M.A. Tech Services Inc.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, the M.A. Tech Services, Inc. is the only source that can meet the Government’s needs. This requirement will be synopsized in the government point of entry fbo.gov.
7. Any other facts supporting the justification.
None
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, M.A. Tech Services, Inc. is the only source that can meet this requirement.
