From: B. Buffkin, NSWC PCD Code E31 To: L. Gely, NSWC PCD Code 024

Subj: SOLE SOURCE JUSTIFICATION FOR PURCHASE OF LANDING CRAFT AIR

CUSHION (LCAC) CONTROL AND MONITORING SYSTEM (CAMS) BREAKOUT

BOXES FROM SILVER ENGINEERING INC.

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”

This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Department Code 02).

2. Nature and/or description of the action being approved.

This action will award a firm fixed price commercial item purchase order to Silver Engineering Inc. (SEI), 255 East Drive, Suite A, Melbourne FL. 32904 (DUNS: 627995509 CAGE Code:

0RJ73) for six (6) each CAMS Craft Control Card Breakout Boxes and associated cables.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

The purchase is to acquire the following commercial items:

PART NUM DESCRIPTION QTY

NS-02007-1 CAMS Craft Control Card Breakout Box 6 NS-02007-2 Cable Assemblies NS-03009, NS-03010, NS-03011, NS-03012 6 NS-02007-3 Cable Assembly NS-03013 6 NS-02007-4 Cable Assembly NS-03014 6 NS-02007-5 Storage Cases 6 SE-01030-1 D-SS 78 Breakout Box W/Tip Jacks and Toggle Switches 6

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. The estimated value of this effort is not to exceed $159,636. All deliverables will be delivered within 8 weeks after award of the order. The purchase action will be funded with Fiscal Year 2016 Operation & Maintenance Navy (O&MN) funds.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C.

2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1. NSWC PCD in conjunction with the LCAC Program Office

(PMS377J) and the LCAC community are in need of additional Break out Boxes (BoB) kits for troubleshooting the Control Alarm Monitoring Systems (CAMS), Sensor Interface Units (SIU), Full Authority Digital Engine Controls (FADEC), ETF40B Gas Turbine Engines, and Auxiliary Power Units (APU). The BOB kits are made up of Commercial off the Shelf (COTS) equipment previously procured from SEI under Purchase Order N61331-11-P-9013. Pursuant to 10 U.S.C.

2304(c), SEI is the only responsible source capable of providing this material. Other commercial products would not be feasible because of the requirement to test and evaluate the items. This purchase is not suitable for full and open competition and it is in the best interest of the Government to acquire this item using a non-competitive purchase for the following reasons:

a. NSWC PCD has evaluated and developed troubleshooting guides specific to the SEI product and has determined that it is necessary to purchase the same equipment for consistency.

Evaluation and troubleshooting guides development involved extensive testing and documentation development over three months to ensure 100 percent compatibility with the equipment, signals, and sensors of the LCAC systems. The cost of conducting this qualification program on new BoB equipment is estimated at $131,070 and this cost is not expected to be recovered through competition. This cost is based on actual cost for the development of the current BoBs developed by the LCAC C4N project in Fiscal Year 2012.

b. To avoid having to train fleet maintainers on multiple configurations of BoB equipment.

c. The lead time associated with the procurement, test, and evaluation of new equipment would delay delivery of needed material to fleet by an additional 6 months which will impact fleet operations.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

This requirement will be synopsized on FEDBIZOPPS per FAR 5.2. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 4 above to substitute any other product.

7. Any other facts supporting the justification.

None

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, SEI as the Original Equipment Manufacturer (OEM), is the only source that meet the requirement. Due to significant engineering costs and long lead time for development described under paragraph 4 above, there are no actions taken by the LCAC program to remove the barrier to competition.
