About this file
This document is a Justification and Approval for Other Than Full and Open Competition for the upgrade of four SmartEye Pro dx multi-camera eye tracking systems, including installation and training. The Naval Medical Research Command (NMRC) is seeking to upgrade the existing eye tracking systems that support critical research capabilities for the Disorientation Research Device (DRD) and Spatial Disorientation laboratory. The justification cites 10 U.S.C. 2304(c)(1) and FAR 6.302-1 as the statutory exceptions permitting a sole source acquisition, as the proprietary design and unique support offered by SmartEye are required. The contracting officer will conduct a price analysis to determine the anticipated cost to the government will be fair and reasonable. The estimated value of the upgrade is $344,858, but the government anticipates a discounted price from SmartEye's commercial price list. The agency has no plans to compete future contracts for these services at this time, but will assess the feasibility if another potential source emerges.

JUSTIFICATION AND APPROVAL
OTHER THAN FULL AND OPEN COMPETITION
1. Identification of the agency and the contracting activity.
This justification is executed by the Naval Medical Research Command (NMRC), Silver Spring, MD, on behalf of NAMRU-Dayton aerospace medical research requirements.
2. Nature and/or description of the action.
Upgrade to the SmartEye eye tracking systems critical research capabilities for the Disorientation Research Device (DRD) and Spatial Disorientation laboratory. The system must be 100% available and functioning perfectly to collect data for research studies both planned and underway. The four systems are functional, but the technology is lagging behind industry standards and computer based components are overdue for replacement.
The design of the eye tracking system and the unique support offered is proprietary to SmartEye. This offer only applies to trade in value for the existing system. Sole source.
3. Description of Supplies or Services:
Four SmartEye Pro dx multi-camera eye tracking systems, installation and training cost included.
4. Identification of the statutory exceptions permitting other than full and open competition.
The statutory exception permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(1) and FAR 6.302-1 sole source (including brand name) acquisitions or FAR 13.106-1(b)(1) soliciting from a single source.
FAR Part 13
10 U.S.C. 2304(c)(1), Only one responsible source.
FAR 6.302-1, Only One Source (>$150K)
5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
Offer is for an upgrade of an existing system, sole source.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
• Science teams have worked for years with this system and have decided to stay with the system OEM as it has proven to be adaptive to our needs and matches other orgs using similar systems to track performance. There is no desire to seek out a new vendor where our old equipment would not have trade in value.
• Reviewing catalogs and other generally available product literature published by manufacturers, distributors, and dealers or available on-line helped to reinforce this decision.
7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer shall determine the anticipated cost to the Government of the supplies/services covered by this Justification and Approval will be fair and reasonable by conducting a price analysis before an award is made. In addition, the Government anticipates that the negotiated contract price will reflect a discount from the [enter vendor name]’s commercial price list and will be determined fair and reasonable.
8. Description of the market survey conducted and the results, or a statement of the reasons a market survey was not conducted.
Sole source acquisition.
9. Other facts supporting the use of other than full and open competition.
Previous procurement (various) and existing contracts with SmartEye to support Gov purchased systems:
N3239817P0323, SMART EYE PRO, $65,750.00
N3239818P0211, SmartEye Support, $9,720.00 N6311618P0601, 3 Camera 0.3 MP 120 Hz Smart Eye Pro 7.0, $66,550.00 N6311618P0610, 3 Camera 0.3 MP 120 Hz Smart Eye Pro 7.0, $66,505.00 N6311619P0609, Smart Recorder with Scene Cam and Mapps Pro, $18,185.00 N6311619P0624, Smart Support, $14,580.00 Total: $241,290.00
The estimate was derived directly from NAMRU-D contracts and does not reflect inflation.
The vendor quotation lists a price of $344,858.00 without equipment turn in.
10. Listing of Sources, if any, which expressed, in writing, an interest in the acquisition.
To date, no other sources have written to express an interest.
11. Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
Future requirements will be synopsized in accordance with FAR 5.203.
For the reasons set forth in Paragraph 5, (contracting activity) has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, (NMRC) will assess whether competition for future requirements are feasible.
