About this file

This document is a justification and approval for using other than full and open competition to award a sole source contract. The Naval Sea Systems Command Pearl Harbor Naval Shipyard & Intermediate Maintenance Facility plans to award a firm-fixed price contract to Northrop Grumman Marine Systems for long lead time material to support inspection, maintenance, and repair of two ship service turbine generators aboard a Navy Virginia class submarine. The period of performance is from October 2020 to January 2022 with funding provided by Pearl Harbor Naval Shipyard & Intermediate Maintenance Facility based on historical contracted work. A market research report and sources sought found no other qualified vendors capable of providing the required materials. As the original equipment manufacturer, Northrop Grumman is determined to be the only responsible source. The anticipated cost is determined to be fair and reasonable based on a previously awarded contract. The justification was approved by the competition advocate. Subsequently, contract N32253-21-C-0003 was awarded to Northrop Grumman Systems Corporation on January 27, 2021 for $2,398,265.39.

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Pearl Harbor Naval Shipyard & Intermediate Maintenance Facility (PHNSY & IMF) Contracts Division, Code 400

2. Description of the Action Being Approved

Award a firm-fixed price contract on a sole source basis for procurement of long lead time material (LLTM) for the inspection, maintenance, and repair of #1 and #2 Ship Service Turbine Generator (SSTG) aboard a U.S. Navy Virginia Class submarine with maintenance scheduled to begin in January 2022.

3. Description of Supplies/Services

The total estimated dollar value:

a. Period of performance: 01 OCTOBER 2020 to 01 JANUARY 2022.

b. PHNSY & IMF will provide in funding which is appropriate for this procurement based on historical contracted work on SSN Virginia Class submarines.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

5. Rationale Justifying Use of Cited Statutory Authority

The Project Manager has stated that Northrop Grumman Marine Systems is the Original Equipment Manufacturer (OEM) and the only vendor authorized to provide material for the SSTGs identified in Paragraph 2 above.

Original Equipment Manufacturer (OEM) Northrop Grumman Marine Systems 1167 Main St, Suite 201 PO Box 420 Wyoming, RI 02898 Phone:(401) 491-9550 / (401) 954-4301 Fax: (401) 491-9551

Currently the only known vendor that has provided material for the SSTGs and is able to meet our material requirement is the OEM.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

A market research report dated 14 July 2020 for repair and maintenance of Ship Service Turbine Generators (SSTGs) found no other qualified vendors with the capability to provide material for the SSTGs.

A sources sought for market research purposes was posted to beta.SAM.gov on 08 June 2020 for 18 days. The sources sought received no interest from potential contractors.

Additional market research was not conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Northrop Grumman to provide the required materials.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. The Contacting Officer will use contract N32253-18-C-0015 awarded on 24 September 2018 as historical reference for the price reasonableness determination.

8. Actions to Remove Barriers to Competition

Actions to remove barriers to future competition should be reviewed at the time ships are built, i.e. whether component(s) being installed shipboard will remain proprietary to the OEM. For this reason and the reasons set forth in Paragraph 5, PHNSY&IMF has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, PHNSY&IMF will assess whether competition for future requirements is feasible.
