JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Pearl Harbor Naval Shipyard and Intermediate Maintenance Facility (PHNSY) Contracts Division Code 400.
2. Description of the Action Being Approved
This is a Justification and Approval (J&A) for Other Than Full and Open Competition to contract on a Sole Source basis for modification of Power Conversion Technologies, Inc.
(PCTI) Rectifier Unit, Model Number 12DC-3000-365-480-TF.
This justification and the approval sought cover this model unit in its entirety. The Independent Government Estimate totals $290,133.
3. Description of Supplies/Services
PCTI as the Original Equipment Manufacturer (OEM), shall provide all management, labor, tools, materials, supplies, equipment, and transportation, to trouble shoot, repair, modify, and test the PCTI Rectifier Unit Model Number, 12DC- 3000-365-480-TF, to a fully operational condition, in accordance with current OEM guidelines, at the contractor’s facility.
The PCTI Rectifier Unit is critical in supporting sustained mission objectives of the PHNSY operations, for direct and indirect support to SSN 688 and 774 class submarines, surface vessels, and shore based electrical test systems.
Delivery of the modified PCTI Rectifier Unit is estimated at twelve months, to include round trip shipment, after
J&A Number: 20-121 contract award. The certifying technical and requirements personnel have verified the Government’s minimum need.
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirement
5. Rationale Justifying Use of Cited Statutory Authority
Modification of the existing rectifier unit includes a Full Uninterrupted Satisfactory Load Test in accordance with DC Rectifier PHNSY Load Table specifications, a Functionality Test of all modifications, and the performance of a comprehensive visual inspection of major internal and external components, to establish a base line condition.
As attested to in a letter dated 3/15/2020, from Catherine Chis, President of PCTI, to Pearl Harbor Naval Shipyard; the design of the equipment is proprietary to PCTI. As such, PCTI is not required or willing to provide the schematics and other design data that are required to accomplish the modification to other vendors. Without the proprietary data, other vendors would not have the capability to modify the equipment in order to achieve the objectives of the Navy.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
On 7/21/2020, The Government posted a Sources Sought notice on beta.sam.gov, the Government Point of Entry (GPE) for Government contract opportunities. The Sources Sought posting summarized the need for a contractor to provide the non-personal services necessary to perform the modification of the rectifier unit as defined in the PWS. The Sources Sought notice closed on 7/27/2020. No capability responses were received.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the services covered by this J&A will be fair and reasonable. The Contracting Officer will rely on the technical expertise of the project team to determine technical acceptability. The Contracting Officer will supplement the fair and reasonable price determination with comparison to the GSA Field Service Technician hourly rate calculator, multiplied by the estimated direct labor hours based on specific, technical upgrade instructions from the requirement generator, and competitive commercial shipping cost estimates.
8. Actions to Remove Barriers to Competition
The Government posted a Sources Sought notice for the modification of the rectifier unit and no capability responses were received in response to the notice. It is expected that future requirements for similar services will be sole source due to the OEM’s proprietary rights. However, the Government will conduct market research and consider competition to the maximum extent possible on future requirements for comparable services.
