Pearl Harbor Naval Shipyard And Intermediate Maintenance Facility
Amada America Laser Cutter
Preventive Maintenance Inspection and Remedial Services
1. BACKGROUND:
1.1. Pearl Harbor Naval Shipyard & Intermediate Maintenance Facility (PHNSY & IMF) is a US Navy regional industrial center that maintains, overhauls, and repairs various vessels of the US Navy. Its industrial operations provide the US Naval forces with a wide range of services and resources located on the island of Oahu, Hawaii, with direct and indirect support to SSN 688 and 774 class submarines, surface vessels, and shore based activities in the Pacific.
2. OBJECTIVE & SCOPE:
2.1. The Contractor shall supply a Manufacturer Trained Certified Technician to repair the Amada America Laser Cutter 2005 Model Number: LC2415A3NT, Serial Number:
35580915, to a fully operational condition. The Contractor shall provide annual preventive maintenance, repair, calibration, and remedial service, to include an inspection report of work performed.
2.2. Optional Service. The Contractor may be asked to re-locate the machine at a future date, and provide installation, system function test, as required. Only a Contracting Officer is authorized to order this service within the period of performance. COR will work with Contractor to schedule completion within 12 weeks of request.
3. PERFORMANCE REQUIREMENTS:
3.1. Preventive Maintenance: The Contractor shall provide all management, labor, tools, materials, supplies, equipment and transportation to repair and conduct on-site, preventive maintenance service of the Amada America Laser Cutter, in accordance with current Original Equipment Manufacturer (OEM) guidelines. The Contractor shall only authorize a U.S. citizen, OEM trained technician, not a sub-contract technician. The Contractor shall notify the government if any equipment covered under this contract cannot be restored to operational status within the contract period. The Contractor shall create complete system backups, prior to and after any configuration changes to hardware and software to ensure no loss of data. All software upgrades, if required, shall be provided to include applicable software licensing agreements.
3.1.1. The Contractor shall provide two, routine, on-site preventive maintenance services, within the period of performance, which shall be scheduled at least four-weeks in advance with the Government.
3.1.2. Provide unlimited direct phone service support with field service engineer, during Contractor’s business hours, in a timely manner, to address the aging machines frailties, nuances, error readings, and the need for continuous, uninterrupted, preventive maintenance service.
3.1.3. Clean and calibrate system to Amada’s specifications and perform function test of CO2’s, according to processes developed by Amada, to verify equipment is operating within specified requirements.
3.1.4. Preventive Maintenance Parts: Parts that are replaced during preventive maintenance service, shall be included at no additional cost to the government.
Materials used shall be new and not refurbished or reconditioned materials.
3.1.5. Any remedial repairs identified during the preventive maintenance shall be accomplished, if the completion of the repair is possible during the on-site PM visit.
3.2. Warranty:
3.2.1. Provide unlimited on-site service, if Contractors direct phone service does not accomplish restoration of the unit.
3.2.2. Provide Fanuc parts (excluding 200 and 3000 series) as needed, including Servo motors, power supply and PC boards.
3.2.3. Provide oil change on turbo and vacuum pump as needed.
3.3. Reports: The Contractor shall provide an inspection report no later than 1 month after completion of the service. The report shall detail the nature of the work performed, problems identified during preventive maintenance, remedial repair actions, parts or materials replaced, to include part number and prices, any upgrades or modifications, and an assessment of the overall condition of the equipment. The report shall include the name of the technician, date the service was performed, identification and location of the equipment. If a repair cannot be completed during the on-site visit, the Contractor shall provide a report to include the equipment identification, description of the repair needed, the time and costs to accomplish the work.
3.4. Remedial Repair Parts: Parts that are replaced as part of the remedial repair is to be issued on a separate purchase order, and approved by the government before purchase at government expense. Materials supplied shall be new and not refurbished or reconditioned materials.
3.4.1. Contractor shall transfer replacement parts and materials, to PHNSY & IMF for proper disposal.
3.4.2. Hazardous Waste and scrap metals shall be transferred to PHNSY & IMF. For specific guidelines, and procedures governing the use and disposal of hazardous material or waste, direct all questions to the government.
3.5. Labor, airfare, lodging, rental car, per diem, shall be included. Travel shall be in accordance with current Department of Defense (DoD), Joint Travel Regulations and
Federal Acquisition Regulations (FAR) 31.204-46. Travel receipts shall be provided upon request.
3.6. Service Delivery Summary:

4. QUALITY ASSURANCE:
4.1. The Contractor shall be responsible for maintaining and implementing a Quality Control
Plan (QCP), to ensure that the work performed meets or exceeds the requirement of this PWS, and results in the prevention of potential and correction of actual problems. The QCP shall address what will be reviewed and shall outline any remedial actions warranted by the review. The QCP shall be implemented upon contract performance.
4.2. The Contractor shall maintain records of reviews and actions taken per the QCP, and shall make such records available to the government upon request.
5. GOVERNMENT FURNISHED PROPERTY:
5.1. The Government will provide all the required amount of electricity needed to perform the preventive maintenance service, tooling and testing of the equipment.
5.2. Removal and disposal of hazardous waste and scrap metals, to include used lubricants, coolants, and cleaning solutions generated from the service of the equipment.
5.3. No other property, utilities, or services will be provided.
6. CONTRACTOR QUALIFICATIONS:
6.1. The Contractor shall be an authorized, Original Equipment Manufacturer (OEM) trained, certified technician, not a sub-contract technician, to troubleshoot, repair, and perform preventive maintenance service on the Amada America Laser Cutter machine:
Model Number: LC2415A3NT, Serial Number 35580915.
6.2. The Contractor shall have a valid driver’s license and a vehicle pass for base access.
6.3. In accordance with current Department of Defense and Homeland Security requirements, performance of all work under this contract is restricted to U.S. citizens and U.S.
nationals only. The Contractor shall provide proof of this requirement upon request by the government.
6.4. Contractor personnel shall clearly identify themselves as a Contractor (e.g. company shirt, pin, visible company identification, in a visible location on the front exterior clothing and above the waist except when safety or health reasons prevent such placement) as to who the person is. Identification badges shall be worn at all times when travelling to work site and while performing work.
6.5. Work will be performed on-site at PHNSY & IMF. No work on official government holidays.
6.6. Portable Electronic Devices (PEDs), including pagers, mobile/cellular, telephones (with/without cameras), personal digital assistants/job performance aids, laptops, notebook/handheld computers, digital imagery (still video) devices, analog/digital sound records(e.g. iPods), video game devices, USB devices and devices of similar capability, functionality or design. The Contractor shall strictly comply with PHNSY & IMF procedures and policies concerning the use and possession of PEDs while working in the Controlled Industrial Area (CIA).
6.7. Photography and photographic equipment are prohibited at PHNSY & IMF. This includes personal cell phones with camera features. The Contractor is advised that written requests concerning justification and details shall be submitted to the Security Office (Code 1125) via the POC for approval.
7. SECURITY REQUIREMENTS:
7.1. In accordance with current DoD and Homeland Security Requirements, performance of all work under this contract is restricted to U.S. citizens and U.S. nationals only. U.S.
citizens of a foreign owned, controlled, and/or influenced (FOCI) company are considered foreign nationals and special authorization would be required for escorted access to PHNSY & IMF spaces. After contract award, the Contractor shall provide to the government, on company letterhead a request for access of all personnel working on this contract and include the following information: full name, Social Security number, date of birth, and citizenship. The Contractor shall state that the information has been verified, filed, and available for examination by the Government upon request.
7.2. The provisions of these security requirements are applicable to all Shipyard & IMF areas outside of the Controlled Industrial Areas (CIAs), excluding Dry Dock 4.
(Appendix III, Security Requirements Applicable for Pearl Harbor Naval Shipyard & IMF’s Contracted Work Outside of the Controlled Industrial Area (CIA), (Revision March 2015).
7.2.1. For escorted access to non-CIA spaces: White (ER) badges authorize access to PHNSY & IMF non-industrial, non-sensitive areas only. It does not authorize access into the CIA, classified areas, and NWA’s.
7.3. Security requirement are applicable to the prime contractor as well as to all subcontractors and suppliers there under.
7.4. For frequent access to Shipyard & IMF spaces, Security Access Control Badges are required. Three weeks prior to entry into the Shipyard & IMF spaces outside of the CIA, officials from the contractor, subcontractors, and suppliers shall complete all applicable items on Part 1 of the Contractor Visit Request, to Pearl Harbor Naval Shipyard & IMF (VR) (PH-SYD IMF 55512/28) form and submit it to the Government Contracting Agency (GCA) or designated Contracting Officer’s Representative (COR) for completion of Part 2. The GCA/COR will then forward the VR to the Shipyard & IMF Sponsor for completion of Part 3 no later than two weeks prior to the visit. The Shipyard & IMF Sponsor will submit the VR to the Shipyard & IMF Pass and Identification Office (Pass and ID) no later than one week prior to entry into the Shipyard. The VR must include country of citizenship. Entry into Shipyard & IMF spaces for US citizen personnel from companies without FOCI, may be authorized by the Security Officer (Code 1120).
7.5. Ensure that all employees wear and display the Shipyard & IMF badge in the chest area at all times while entering, remaining in, and exiting Shipyard & IMF spaces.
7.6. Ensure that each badge is used only by the specific individual named on the badge.
7.7. Maintain strict accountability over identification badges and passes issued by the Pass and ID office. Report immediately, to the Pass & ID Office, any badges/passes that are missing or lost and the circumstances. Return badges/passes to the GCA immediately upon termination of any employee, upon expiration, upon completion of contract, or when no longer required. The GCA will ensure that all badges/passes are returned and forwarded to the Shipyard & IMF Pass and ID Office (Code 1125.2).
7.8. The Pass and ID Office is located in Building 207 at Safeguard Street and Russell Avenue.
8. CONTRACTOR PERSONNEL:
8.1 The Contractor shall furnish sufficient personnel to perform all work within this performance work statement. Contractor is required to comply with Public Law 105-270, Section 5(2) (A) of this Public Law defines the term “inherently governmental function” as “a function that is so intimately related to the public interest as to require performance by Federal Government employees.” Per Section 5(2) (B), inherently governmental functions include management of Governmental programs requiring value judgements, conduct of foreign relations, selection of program priorities, and the direction of intelligence and counter-intelligence operations. Per Section 5(2) (C), inherent governmental functions DO NOT include. (i) Gathering information for providing advice, opinions, recommendations, or ideas to Federal Government officials; or (ii) any function that is primarily ministerial and internal in nature.
8.2 Contractor personnel shall not establish an employee-employer relationship with
Government personnel under this contract.
8.3 Contractor shall not provide personal services.
8.4 Contractor personnel will make clear to all individuals they engage with that they are
Contractor employees and not Government employees. When participating and introducing themselves during official events wherein Government, non-Government, or foreign personnel are present, Contractor personnel will identify themselves as employers of the Contractor. Contractor personnel must be clearly identified (i.e., company shirt, pin, visible company ID, etc.) in a visible location as to who their employer is.
8.5 Contractor personnel shall not manage, supervise, or task Government employees or military personnel. Contractor personnel may not make any commitment to non- Government personnel, including a foreign official, which commits the expenditure of U.S. Government resources.
8.6 Normal business hours of operation are 6:30 a.m. through 3:00 p.m. with a 30-minute lunch break, Monday through Friday, excluding Federal Holidays. Any work beyond normal business hours, the Contractor must request authorization from the POC before performing work.
8.7 If a holiday falls on a Saturday, the holiday is observed on the preceding Friday. If a holiday falls on a Sunday, the holiday is observed on the following Monday.
8.8 Federal Holidays:

9. PERIOD OF PERFORMANCE:
9.1. All work to be completed twelve months after award of the contract, on an annual basis for the base and four option years.
10. PLACE OF PERFORMANCE:
10.1. Building 72, Shop 17, Pearl Harbor Naval Shipyard, is located outside of the Controlled
Industrial Area (CIA), Pearl Harbor Hawaii. New location of movement to be determined.
11. POINT OF CONTACT: Contracting Officer.
12. ENTERPRISE –WIDE CONTRACTOR MANPOWER REPORTING APPLICATION:
12.1. The Contractor shall report contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the PHNSY & IMF via a secure data collection site. Contracted services excluded from reporting are based on Product Service Codes (PSCs). The excluded PSCs are:
12.1.1. W, Lease/Rental of Equipment;
12.1.2. X, Lease/Rental of Facilities;
12.1.3. Y, Construction of Structures and Facilities;
12.1.4. S, Utilities ONLY;

12.3. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs from October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. 52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (MAR 2020)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
(a) Definitions. As used in this provision --
“Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
"Forced or indentured child labor" means all work or service-
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
“Inverted domestic corporation” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except--
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
“Sensitive technology”--
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
“Service-disabled veteran-owned small business concern”--
(1) Means a small business concern--
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
“Small disadvantaged business concern”, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
“Subsidiary” means an entity in which more than 50 percent of the entity is owned--
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
“Successor” means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name.
The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.
“Veteran-owned small business concern” means a small business concern--
(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
"Women-owned business concern" means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and whose management and daily business operations are controlled by one or more women.
“Women-owned small business concern” means a small business concern--
(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; or
(2) Whose management and daily business operations are controlled by one or more women.
“Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127)”, means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
(b) (1) Annual Representations and Certifications. Any changes provided by the Offeror in paragraph (b)(2) of this provision do not automatically change the representations and certifications in SAM.
(2) The offeror has completed the annual representations and certifications electronically in SAM accessed through http://www.sam.gov. After reviewing SAM information, the Offeror verifies by submission of this offer that the representations and certifications currently posted electronically at FAR 52.212-3, Offeror Representations and Certifications--Commercial Items, have been entered or updated in the last 12 months, are current, accurate, complete, and applicable to this solicitation (including the business size standard(s) applicable to the NAICS code(s) referenced for this solicitation), at the time this offer is submitted and are incorporated in this offer by reference (see FAR 4.1201), except for paragraphs __.
