This procurement is a FAR Part 12 acquisition being conducted under FAR 15 Contracting by Negotiation. Per FAR 52.216-1, the Government contemplates award of up to two, firm-fixed-price contracts resulting from this solicitation.
MSC Strategic Sealift Program Support Office, N103A, requests proposals for vessel(s) capable of meeting the transportation requirements described below. The paragraph numbers below apply to the box layout of references (a) and (b), which are incorporated herein by reference (available on the MSC web site at https://www.msc.usff.navy.mil, under “Business “Opportunities”, select “Contracts”, then “Proforma”, or upon request), and shall be the charter form of any contract resulting from this solicitation. By submission of a proposal, the owner/offeror confirms agreement with all terms and conditions of this solicitation and the charter form, unless otherwise identified therein.

PART I-DRYTIME BOXES:
1. Vessels Required:
U.S. or foreign flag, self-sustaining Lift-On/Lift-Off (LO/LO), breakbulk vessel(s) (multiple awards up to two vessels or until the needs of the government have been met) each capable of carrying a minimum of 750 TEU’s and an additional 25,000 square feet of cargo space, to support resupply operations.
Each vessel shall have:
A. Minimum capacity of 750 TEU’s with average container weight of 30,000 lbs and a minimum of 50 Reefer Plugs (230V/60HZ/3 PHASE). In addition to the container capacity, minimum of 25,000 square feet of cargo space.
B. One 20-foot ISO container spreader bar and one 40-foot ISO container spreader bar, both weight tested.
C. A minimum of two cranes with 100 MT (per crane) lifting capacity.
D. A maximum overall length of less than or equal to 180 meters (590 feet) and a laden draft of less than or equal to 9.7 meters (32 feet)
E. The capability to maintain a minimum of 15 knots when laden.
F. A minimum range of 10,000 nautical miles unrefueled.
G. Ability to meet IMO Polar Code Classification C regulations with a minimum Ice Class GL- E2, ABS-B0, F-S-1B, or equivalent.
H. Ability to meet all MARPOL regulations.
I. Vessel must arrive fully bunkered for mission and must be capable of utilizing MGO for all operations conducted south of 60 degrees latitude.
J. Vessel must arrive with all required certifications current for duration of charter period to include cranes and spreader bars.
K. Holds with a minimum tween deck height of 9 feet and a minimum tank top deck height of 12 feet.
L. Berthing for Supercargo, New Zealand National Refrigeration Technician, Embarking and
Disembarking at Port Hueneme, CA. Crane Technician and Ice Pilot.
M. As part of the fixed price, inspection of all cargo by a national cargo representative at Port Hueneme, CA must be completed prior to loading cargo onto each vessel.
N. The following specialized cargo will be loaded within each ship’s cargo capacity, as stated above:
(1) Two modular warping tug units, 194,000 lbs each.
(2) Two completed causeway sections, 142,500 lbs each.
O. Vessel shall comply with New Zealand biofouling requirements, and provide evidence of such to the Charterer, prior to delivery.

Owners/Offerors to indicate estimated time of arrival (ETA). In accordance with Part X (b) (xxvi), provide vessel’s itinerary confirming the vessel can meet the layday(s).
6. Terms/Conditions/Attachments added, deleted or modified:
Special requirements:
A. Health and Safety Requirements: Owner/Offeror agrees that crew and other embarked personnel may be ordered by the charterer to stay aboard the vessel during port visits under this charter as deemed necessary by the charterer or local government authorities. Further, the Owner/Offeror agrees that the charterer may limit access to the vessel by any shore-side personnel upon the vessel’s port calls during this charter.
B. Documentation: Upon award, Owner/Offeror will provide open and/or overdue conditions of class, statutory conditions, any short-term certificates vice full certificates with reasoning, current deficiencies per category and corrections are planned, any USCG 835’s that are outstanding, and any ABS open ISM findings and/or observations. This is to assist Military Sealift Command in determining the scope of On-hire inspection.
C. Supercargo: Pursuant to PART IV (k), a minimum of three supercargo is required for each vessel, which includes one sponsor (National Science Foundation) provided refrigeration technician, two U.S. Army Warping Tug Technicians.
D. CALL OUT PART V (i): Lashing Gear.
E. CALL OUT PART V (j): Spreader Bar.
F. CALL OUT PART V (k): Self-Sustaining.
G. CALL OUT PART V (l): 1-4, 7: Certificates.
H. CALL OUT PART V (m): Stow Plan.
I. CALL OUT PART V (n): Fully Bunkered.
J. Owners/Offerors shall acknowledge Classified Requirement:
1. There is a classified requirement in this solicitation. Owner/Offeror or their representative, with appropriate security clearances in place, must submit to the contracting officer a request to review the classified requirement within one business day of the issuance of this solicitation and then must then make the necessary arrangements at their expense to view the classified requirement at appointed place and time provided, which must be prior to the solicitation response date and time. The opportunity to review the classified requirement will be lost if the contracting officer does not receive a request on time or if the Owner/Offeror misses the appointment. There is no requirement to review the classified requirement prior to submitting an offer. Not reviewing the requirement prior to submitting an offer will not in and of itself render an offer ineligible for award.
2. Offers will be considered against this requirement before any other evaluation. An offer found not acceptable with this requirement will not be further evaluated. Owner/Offeror will be notified if their offers were excluded because of this requirement.
K. Ice Pilot: As part of the fixed price, Ice Pilots are required to be onboard, at a minimum, embarking and disembarking in Port Lyttleton, New Zealand.
L. Crane technician: As part of the fixed price, at least one Crane Technician is required to be onboard, at a minimum during the McMurdo Station Port Call.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

ADD PART X (a)(1)(o) FAR 15 Acquisition. This procurement is a FAR Part 12 acquisition being conducted under FAR 15 Contracting by Negotiation. PART XI. FAR 52.212-2 EVALUATION -- COMMERCIAL PRODUCTS AND

Amend PART XI(a) first and second paragraph to read as follows:
The Government will award up to two contracts resulting from this solicitation to the responsible offeror(s) (See Note (1) below) whose technically acceptable proposal(s) represents the lowest price to the Government. Award(s) will be made to the offeror(s) with the two lowest evaluated price proposals, and according to the preference scale set forth in sec. III.A.3. of VISA (available at 79
Federal Register 64462-64470). If this RFP does not include DFARS 252.247-7026, award will be made, if at all, for the technically acceptable offer in the highest VISA priority which has the lowest price among the offers in that VISA priority. If this RFP includes DFARS 252.247-7026, then this evaluation scheme is subject to the next paragraph.
If 50% or more of the cost of overhaul, repair, and maintenance work of an offeror’s “covered vessel[s]” (see definition at DFARS 252.247-7026(a)) has been conducted within a U.S. shipyard during the period covering the current calendar year through the date of proposal submission, plus the preceding four calendar years, then the offeror is in “Category 1.” All other offerors are in “Category 2.” Award(s) will be made, if at all, for the technically acceptable “Category 1” offer(s) with the highest VISA priority which has the lowest price among the offers with that VISA priority. If no such offers exist, then award(s) will be made, if at all, to the lowest price, technically acceptable, “Category 2” offer(s) with the highest VISA priority. This evaluation scheme will continue, with “Category 1” offers within a particular VISA priority level having preference over “Category 2” offers within the same preference level.
Amend XI(b) to read as follows:
“(b) In selecting the lowest-priced, technically acceptable offer, the following factors will be considered:
Technical Price
In compliance with Cargo Preference, the Contracting Officer may elect to only evaluate U.S. flag vessels, to include current U.S. flag vessels and vessels to be U.S. flag upon delivery.

PART XI(e) PRICE; amend to read as follows:
XI(e)(a) The offeror’s price proposal will be evaluated based on the value of the charter hire rate(s) offered for the entire charter period of (a) 85 days, price for fuel, and any other pricing elements set forth in the offer. For evaluation purposes, the period of performance will consist of (b) 85 days.
Fuel calculations will be based upon (c) 55 days underway laden at the speed specified in the individual solicitation, using fuel consumptions provided in DRYTIME Boxes 68 and 70; (d) 00 days underway ballast at the speed specified in the individual solicitation, using fuel consumptions provided in DRYTIME Boxes 69 and 70; and (e) 30 days in port idle, using the fuel consumption provided in DRYTIME Box 71. This will represent the overall price to the Government. The proposed price(s) must be determined to be fair and reasonable. Award will be made, if at all, for up to the two lowest technically acceptable vessels, or until the Government’s needs have been met.
