This acquisition is being conducted under FAR 13.5 Simplified Procedures for Certain Commercial Items

MSC Strategic Sealift Program Support Office, Code N103A, requests proposals for vessel(s) capable of meeting the transportation requirements described below. The paragraph numbers below apply to the box layout of references (a) and (b), which are incorporated herein by reference (available on the MSC web site at https://www.msc.navy.mil, under “Contracts,” then “Proforma,” or upon request), and shall be the charter form of any contract resulting from this solicitation. By submission of a proposal, the offeror confirms agreement with all terms and conditions of this solicitation and the charter form, unless otherwise identified therein.

INSTRUCTIONS (AUG 2012)

27a. Solicitation incorporates by reference FAR 52.212-1 and 52.212-4; 52.212-3 Alt I, and 52.212-5 are attached.

PART I - TANKTIME BOXES:

1. VESSEL(S) REQUIRED:

One, clean, approved, U.S. or foreign-flagged, double-hull tanker with Segregated Ballast Tanks (SBTs), capable of carrying a minimum of 40,000 bbls of clean petroleum products (intentions JP5, F76, and/or JA1) within the vessel’s natural segregation in designated cargo tanks with double-valve isolation. Specific vessel requirements are:

a) There is a classified requirement in conjunction with this RFP that may eliminate offerors. Offerors who are affected will be given the opportunity during discussions to read/address this requirement if affected offerors have appropriate security clearances in place. Offerors not affected will not have a need to know about the requirement regardless of appropriate security clearances being in place.

b) Owners must warrant that the vessel meets statutory requirements to perform tanker cargo operations in Guam.

c) Vessel must be a party to the SIRE System and provide a current Q-88 with offer. The Q-88 must detail current acceptances and dates of inspection. There shall be at least one SIRE inspection not more than six months prior to the commencement of laydays under this charter. Offerors shall confirm that such inspections were satisfactory.

d) Owners must provide list of approvals that include the inspection dates and expiration dates.

e) Vessel’s age shall be less than 20 years for the duration of the charter.

f) Vessel shall not exceed a maximum LOA of 108 meters.

g) Vessel shall have SBTs.

h) Vessel shall have a current class society-issued Safety Management Certificate.

i) Vessel shall have a current International Ship Security Certificate.

j) Owner must provide vessel itinerary from offer to arrival laydays at load port ready for tank inspection.

k) Vessel stowage plan shall demonstrate the vessel’s ability to load a minimum of 40,000 bbls of JP5, F76, and/or JA1 while not exceeding a laden draft of 8.2 meters.

l) Vessel stowage plan shall demonstrate the vessel’s ability to load a minimum of 33,000 bbls of JP5, F76, and/or JA1 while not exceeding a laden draft of 6.7 meters.

m) Vessel shall arrive at load port in a clean, gas-free condition, and be ready for internal tank inspection by Quality Assurance Representative (QAR). Any adjacent tanks shall also be clean and gas-free.

Contractor shall provide (for Owner's account) a certified marine chemist to certify the tanks are safe for entry for internal tank inspection by Government representative. Certified marine chemist shall enter all cargo tanks in advance of the QAR and perform a full four-corner entry inspection. The certified marine chemist’s inspection shall include all tank pockets identified by the QAR to the satisfaction of the QAR. If either of the prior two cargos contained a percentage of benzene, the owner’s certified marine chemist shall arrive equipped with to measure toxicity for benzene content.

All safe for entry, toxicity, and flammability assessments shall be performed in the presence of the inspecting QAR.

n) Vessel must have the ability to hot wash all cargo spaces with water not to exceed 58 degrees centigrade prior to presenting for initial acceptance and inspection. All cargo tanks must be free of loose rust, previous cargo residues and films (including dyes), significant salt deposits and other impediments that could affect the quality of the cargo to be loaded.

o) If vessel cargo tanks have heating coils, owner must provide the type of metal the coils are constructed of and the date the heating coils were last pressure tested and the results of the test (passed or failed).

Date of last pressure test cannot exceed 12 months for duration of this charter. Metals that are incompatible with the fuel to be carried will be rejected.

p) If vessel cargo tanks are internally coated, owner must provide the coating type (epoxy, inorganic zinc, etc.). If tanks are not coated, then state “none”. Coatings that are incompatible with the fuel to be carried will be rejected.

q) Owner must provide copies of Certificates of Quality for last three cargoes. These Certificates shall contain all test data required by specification for the products that were previously loaded (last three).

Vessel Certificates of Quality from vessel post-load samples are preferred, but if unavailable shore tank Certificates of Quality representing quality of product loaded are acceptable. The Certificates of Quality shall contain the test data required by the specification for the product which were loaded.

They shall be submitted for each shore tank as well as the vessel tanks after loading (composite sample). Results of “typical” are not acceptable. Additionally, the following are required for the specific products mentioned:

1. Naphtha / Condensates: Mercaptan Sulphur, reported in “parts per million” (ppm) or “mass percent”, or Doctor Test (ASTMD 4952). Otherwise, Certificates of Quality should contain the test data required by the specification for the products which were loaded.

2. Gasoline (Motor or Aviation): It must be stated whether the previous product was “leaded” or “unleaded”.

r) Vessel shall either (1) not have carried Fatty Acid Methyl Esters (FAME) within its last three cargoes or (2) have had its cargo tanks cleaned and conditioned in accordance with the guidance in Energy Institute HM50 if its tanks contained FAME within its last three cargo carries. Offeror shall either state, with the submission of its offer, that (1) the last three cargoes were FAME-free or that (2) the aforementioned cleaning has or will occur prior to loading the government’s cargo.

s) Vessel shall be able to take all-level (e.g., upper, middle, lower, and bottom) samples of the cargo (to include OBQ & ROB) without contaminating them from the sampling location. If unable to do so or if the sampling location is contaminated or suspected to be contaminated, Charterer will require open sampling on a tank-by-tank basis, consistent with safety and local terminal regulations.

t) Owner agrees where cargo is carried after contract award and prior to delivery to provide cargo type/description prior to loading, and applicable Certificates of Quality (to include all test data required in the initial RFP) for review within 48 hours after loading said cargo. Test shall be on a sample taken from the ship versus a representative sample from a shore facility. Any rejection of the Certificates of Quality by the Government shall result in the Government cancelling this contract at no cost to the Government.

u) The vessel shall possess a 5-ton boom for lifting cargo hoses with cruciform bits at the manifold capable of reaching both port and starboard.

v) Vessel shall be fitted with a minimum of four (4) mooring lines on power drums at each end of vessel for a minimum total of eight (8).

w) The vessel’s rail, at the manifold (port and starboard), shall be of the same height as the bottom of the manifold and of sufficient strength to support the weight of a six-inch cargo hose during cargo operation at an offshore mooring.

x) Minimum of 3 segregations with double-valve isolation between each segregation

y) Vessel must be able to machine wash cargo tanks, as applicable, while underway.

z) Vessel must be able to clean, mop, dry and inert cargo tanks within three (3) days between cargoes during performance of this charter when required.

aa) Vessel must be able to carry one complete, undecanted tank washing in dedicated slop tanks.

bb) Vessel must be able and equipped to perform cargo operations pier side.

cc) Owner must confirm Vessel’s minimum SOA of 12 knots in moderate weather (Force 5).

dd) Vessel(s) must report fully loaded with bunkers when they submit their notice of readiness at port of delivery.

ee) Vessel shall meet all MSC reporting requirements. Vessel shall provide position/status reports in-port and at-sea every six hours daily at 0000, 0600, 1200, and 1800 hours local Washington, D.C. time (GMT-5 EST/GMT-4 EDT) and 72/48/24/12 hours pre-arrival notifications for all ports to Area Command and COMSC PM35. Reports shall be sent to the following email addresses:

ff) Vessel shall be required to submit a MONTHLY VOYAGE ABSTRACT form on a monthly basis and emailed to COMSC.TANKERS@NAVY.MIL no later than the 1st day of the month following the month of performance. For time charters that complete prior to the end of the month, the report shall be received no later than two calendar days after completion of charter (off-hire). Entries shall start with the date the ship presents NOR and is accepted on hire. All columns shall be completed as noted.

Pull down menus for columns C, X and Y are the only comments to be used. Built in macros/formulas shall not to be altered.

gg) Confirm that owners agree to all other terms and conditions as per TANKTIME 10/13. Counters to TANKTIME 10/13 terms are not acceptable until written confirmation is provided by the charterer.

ADD: Request offerors identify those ports in which they have any active arrest warrants or similar actions pending that would either delay the vessel from performing, or otherwise prevent the vessel from free entry/departure.

ADD: Owner agrees as a condition of this contract that the vessel will not proceed to Gibraltar for any purpose for its next port call after departing a Spanish port, even if the vessel is off-hire or if the charter has concluded and the ship was redelivered to the owner in Spain. Owner also agrees as a condition of this contract that the vessel will not proceed to Spain for any purpose for its next port call after departing Gibraltar, even if the vessel is off-hire or if the charter has concluded and the ship was redelivered to the owner in Gibraltar.
