JUSTIF1CATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command.
2. Description of Action Being Approved: Award of a purchase order on an unusual and compelling urgency basis for the USNS CHOCTAW COUNTY (EPF-2). The government anticipates a firm fixed award in the estimated amount of
3. Description of the Supplies/Services: The following items are being procured for flight deck tie downs (as the end product) in accordance with Alcoa Drawing 05003554. Aero-Glen: 300 cups (P/N 05003552); 1,200 button head 5/8-11 screws (P/N 05003577); 300 button head ¾-10 bolts (P/N 05003578);
300 crossbars (P/N 05003553); 1,745 threaded inserts (P/N 03103Y); 435 threaded inserts (P/N 03123Y); 435 center top gaskets (P/N 05003573); 1,745 outer top gaskets (P/N 05003572); 435 center bottom gaskets (P/N 05003571) and 1,745 outer bottom gaskets (P/N 05003570).
4. Statutory Authority Permitting Other Full and Open Competition: The Statutory Authority permitting other than full and open competition is 10 U.S.C. 2304(c)(2), as implemented by FAR 6.302-2(a)(2), whereas the agency’s need for the property is of such an unusual and compelling urgency that the United States would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals.
5. Rationale Justifying Use of Cited Statutory Authority: The majority of lightweight aluminum flight deck tie down assembly fittings onboard USNS Choctaw County (EPF-2) have failed/cracked in service. This C3 CASREP number 19015 (271153ZAPR19) has resulted in the revocation of NAVAIR flight deck certification. The lack of an aviation certified deck degrades mission capability and prevents any flight deck operations onboard. The area of operations and mission requirements assigned for this vessel require urgent action to repair and restore mission capability. The failed fittings require removal and replacement with ALCOA design welded in replacement flight deck tie down fittings which are long lead time parts available from a single source provider. This ALCOA welded-in tie down assembly solution was specifically developed under NAVSEA technical authority for use on LCS and JHSV(EPF) class vessels, and its use has been approved by the American Bureau of Shipping (ABS). No substitute assembly parts are currently technically authorized or regulatory approved for use on board EPF class ships. The NSWC Alcoa Welded-In Flight Deck Tie Down technical report, dated Jan 2011, details the unique nature of these fittings.
6. Description of Efforts made to Solicit Offers from as Many Offers as Practicable: The Government intends to synopsize when required on FedBizopps for each separate procurement with the intent of awarding a firm-fixed priced contract.
7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine that the price is fair and reasonable pursuant to Federal Acquisition Regulations (FAR) Part 13.106 or 15.404-1, as appropriate.
8. Actions to Remove Barriers to Future Competition: MSC will synopsize future contacts for the type of supply covered by this document as applicable. If another potential system emerges, MSC Norfolk will assess whether competition for future requirements is feasible.
