JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

LIMITED SOURCES

1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC), Norfolk, VA.

2. Nature of Action: Award of a purchase order on a limited source basis for the purchase of 04 Main Diesel Engine Vulkan Flexible Couplings from American Vulkan with a required delivery date of 1 FEB 2019.

3. Description of Supplies/Services: MSC has a requirement to procure 04 sets of RATO-S 531W Balanced Flexible Couplings for the Main Diesel Engine. Based on historical data, the cost of the required parts is approximately each. Accordingly, the actions executed under this J&A have an estimated value of approximately .

4. Statutory Authority Permitting Other than Full and Open: The statutory authority for this procurement is 10 U.S.C 2304 (c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(a).

5. Rationale Justifying Use of Cited Statutory Authority: American Vulkan is the Original Equipment Manufacturer (OEM) and only known provider of the EG531W0003-ABS RATO-S 531W Element MDG Flexible couplings for the T-AKE Class ships. American Vulkan is the only authorized source to ensure fit, form, function, and quality of the Main Diesel Engine Couplings. The engineering, construction, proprietary drawings, and technical characteristics are proprietary to American Vulkan. SMS procedure number 10.6-002-ALL identifies all four Main Diesel Engines as critical equipment. This critical equipment must receive parts that are a one for one direct replacement to ensure high quality performance. Only OEM repair parts can be guaranteed to fit and perform as designed for the ship’s main engine coupling. Using Non-OEM parts could result in catastrophic damage to equipment, loss of warranty, and injury to the crew. Main Diesel Engine Couplings rotate at a very high RPM. Catastrophic failure of these Couplings would result in loss of propulsion and mission readiness, severe damage to the ship, and possible loss of life.

6. Description of Efforts made To Solicit Offers from as Many Offerors as Practicable: The Contracting Officer will continue to synopsize and solicit each requirement in FEDBIZOPPS, unless there is an urgent and compelling need for the service and/or parts. In that case, a procurement-specific J&A for unusual and compelling urgency will be executed and included in the file.

7. Contracting Officer’s Determination of Fair and Reasonable Price: The Contracting Officer will determine that the price is fair and reasonable pursuant to Federal Acquisition Regulations (FAR) Part 13.106-3.

8. Actions To Remove Barriers to Future Competition: No specific action is planned to overcome barriers to competition in subsequent procurements, other than synopsizing the requirements. If another potential source emerges, MSC Norfolk will assess whether competition for future requirements is feasible.
