J&A Control Number: N104-TAO VULKAN
CLASS JUSTIFICATION AND APPROVAL (J&A)
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC)
2. Description of Action Being Approved: Award of contracts on a sole source basis for technical representative services and materials from American Vulkan Corporation in support of T-AO class of MSC vessels. The authority to act under this class justification expires on August 1, 2019.
3. Description of Supplies/Services: MSC has a requirement to procure American Vulkan
Corporation brand parts and technical representative services on board the T-AO class of vessels, specifically the Power Take Off (PTO) Clutch and Coupling parts. MSC normally acquires these as long lead time repair components and provides them as
Government Furnished Material (GFM) for installation during regularly scheduled ship repair availabilities. Accordingly, the actions executed under this class J&A have an estimated value of approximately $1,000,000.00 using fiscal year (FY) 2018 and FY
2019 United States Navy Working Capital Funds (NWCF).
4. Statutory Authority Permitting Other Than Full and Open Competition: The statutory authority for commercial procurements greater than $150,000.00 is 41 U.S.C.
1901 as implemented by FAR Part 13.501(a), Simplified Procedures for Certain
Commercial Items, Sole Source-including Brand name acquisitions. The statutory authority for simplified acquisition less than $150,000 is FAR 13.106-1(b).
5. Rationale Justifying Use of Cited Authority: The US Navy’s Combat Logistics Force
(CLF) T-AO Class Replenishment Oilers provide direct support to US and Allied Forces at sea and support combat conflicts, War on Terrorism, and disaster relief around the globe. Their primary mission is to shuttle fuel oil to support ship and aviation operations, and to provide sustainment such as fresh fruit and vegetables, vital repair spares, and personnel to Carrier Strike Groups and Allied Forces. The critical logistics support provided by the T-AO replenishment oilers enables these afloat operations groups to remain on station without disrupting wartime and/or other military defense operations.
Fifteen (15) T-AO class replenishment oilers are dispersed across the five (5) Operational
Commander’s Area of Responsibility (AOR). With limited resupply ports around the world, along with limited port access for US Navy vessels, T-AO class replenishment oilers are vital to Department of Defense military operations.
There are currently seven (7) active Kaiser Class T-AOs (USNS BIG HORN (T-AO
198), USNS TIPPECANOE (T-AO 199), USNS GUADALUPE (T-AO 200), USNS
PATUXENT (T-AO 201), USNS YUKON (T-AO 202), USNS LARAMIE (T-AO 203),
and USNS RAPPAHANNOCK (T-AO 204)) each with two (2) Vulkan Model # MESLU
57 – RATO 2961 per hull for a total of fourteen (14) class wide.
N104-TAO VULKAN
MSC Safety Management System Number 10.6-002-ALL list both PTO Clutch and
Coupling parts as critical equipment. Failure of either of the hull’s two (2) PTO Clutches and Couplings will reduce the vessel’s power producing capability by 25%, which puts a vessel in a C-3 status. Failure of both of the PTO Clutches and Couplings will reduce the vessel’s power producing capability by 50%, which puts a vessel in a C-4 status, rendering it unable to perform its primary mission of providing underway replenishment services to the fleet. The reduction in power producing capability poses a hazard to the crew due to limiting the operation of critical and auxiliary equipment. Proper refurbishment and maintenance of the PTO Clutch and Couplings are critical to the safe operations of Kaiser Class vessels.
The Original Equipment Manufacturer (OEM) of the PTO Clutch and Coupling parts is
American Vulkan Corporation for the Kaiser Class ships. Proper refurbishment and maintenance of the PTO is critical to the safe operation of the Kaiser Class vessels. The
OEM part and technical data/drawings from the OEM are required by USCG and ABS regulations. This maintains all OEM warranties and ensures power producing reliability and crew safety, therefore precluding consideration of the product manufactured by another company. The engineering, construction drawings, and technical characteristics for the manufactured parts are proprietary to American Vulkan Corporation and the US
Government did not acquire rights to this data.
MSC does not have the manufacturing and technical information required to evaluate and determine whether non-OEM components and replacement parts offered are equivalent to the OEM components and replacement parts. Kaiser Class PTO Clutch and Coupling parts require special tools, specialized repair parts, and technical expertise unique to the
Vulkan PTO Clutch and Coupling parts; only approved OEM parts are authorized to be installed for this highly sophisticated equipment. The OEM Representative has access to provide parts and technical data/drawings from the original manufacturer, which is necessary to properly repair and maintain the equipment. All OEM parts are in compliance with USCG and ABS IMO regulatory requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable:
In accordance with FAR 5.201(b)(1)(i), the Government intends to issue a synopsis and solicitation on FEDBIZOPPS for each separate procurement, with the intent of awarding a firm fixed price contract.
7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine that the price for requirements are fair and reasonable pursuant to FAR 13.106-3 or
15.404-1, as appropriate on a per solicitation/contract basis.
8. Market Research: A sources sought (SS) notice was posted on the FBO website on July
24, 2018. The SS respondents were required to demonstrate the ability to provide the requested items or alternative solutions that are compatible with existing PTOs installed aboard T-AO class vessels. No responses were received.
9. A Listing of the Sources, if any, that Expressed, in writing, and Interest in the
Acquisition: To date, no qualified sources have expressed an interest in writing.
However, each requirement will be synopsized via the Government Point of Entry, the
FedBizOpps (FBO) website.
10. Actions to Removed Barriers to Future Competition: For the reasons set forth in
Paragraph 5, MSC has no plans at this time to compete future contracts for the types of supplies covered in this document. If another potential source emerges, MSC will assess whether competition for future requirements is feasible.
