JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

(LIMITED SOURCE)

1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC), Norfolk, VA.

2. Nature of Action: This is a justification and approval (J&A) for the use of other than full and open competition.

3. Description of Supplies/Services: Military Sealift Command (MSC) has a requirement for the services of an ABS recognized original equipment manufacturer (OEM) Marine EMD specialist and factory authorized distributor Familiar with the T-ATF CLASS SHIP to conduct overhaul of the starboard main propulsion diesel engine, and to replace the main turbocharger.

4. Statutory Authority Permitting Other than Full and Open: The statutory authority for this procurement is Section 4202 of the Clinger-Cohen Act of 1996 as implemented by FAR 13.501. 10 U.S.C 2304 (c)(1), a Limited Source will satisfy agency requirements, as implemented by FAR 6.302-1(c).

5. Rationale Justifying Use of Cited Statutory Authority: Military Sealift Command has a requirement to provide the services of an ABS recognized OEM Marine EMD specialist and factory authorized distributor familiar with the T-ATF CLASS SHIP to provide OEM parts, and to conduct overhaul of the starboard main propulsion diesel engine, and to replace the main turbocharger. Material needed to be received by due date to support the September voyage repair.

This item affects the propulsion capability of the ship, and thus limits the operational capability (not able to conduct primary mission). The requirement is to supply OEM parts and services for the overhaul of the starboard main propulsion diesel engine onboard the USNS Sioux. Only EMD OEM and authorized EMD service /parts provider have the expertise and knowledge, including access to proprietary drawings and technical manuals, to provide and identify OEM parts and component. The engine overhaul parts are long lead items, and must be procure and installed by OEM technicians to prevent inadvertent and premature failures. Installation of OEM parts will allow the Sioux to maintain and abide by the emission requirements.

The supplies or services required under this requisition are available from a limited number of responsible sources, and no other type of supplies or services will satisfy the Government's need. There is a reasonable basis to conclude that the Government's minimum needs can only be satisfied by unique supplies or services available only from one or a limited number of suppliers with unique capabilities. Two known sources:

Marine Systems, Inc 1401 Precon Drive, Suite 106 Cheaspeake, VA 23320

Valley Power Systems 11300 Inland Avenue, Mira Loma CA 91752

6. Description of Efforts made to Solicit Offers from as Many Offerors as Practicable: The Government intends to issue a solicitation and post the J&A on FEDBIZOPPS for this requirement.

7. Contracting Officer’s Determination of Fair and Reasonable Price: The Contracting Officer will determine that the price is fair and reasonable pursuant to Federal Acquisition Regulations (FAR) Part 13.106-3.

8. Actions to Remove Barriers to Future Competition: No specific action is planned to overcome barriers to competition in subsequent procurements, other than synopsizing the requirements. If other potential sources emerge, MSC Norfolk will assess whether competition for future requirements is feasible.
