JUSTIFICATION & APPROVAL (J&A)
FOR USE OF UNUSUAL AND COMPELLING URGENCY
N32205-15-T-4003
1. Contracting Activity: Department of the Navy, Military Sealift Command Norfolk (N104-4).
2. Description of Action Being Approved:
This justification is provided to support contracting without full and open competition for subject requirement as authorized by 10 U.S.C. 2304(c)(2) in that the supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the government. This urgent action is a C-3 CASREP to fabricate a STBD rudder and rudder stock for the USNS GRAPPLE.
3. Description of Supplies/Services: The USNS Grapple lost one of its two rudders during a mission sometime in the last six months. A replacement rudder is needed to successfully maneuver the ship during the upcoming missions this year. The ship's steering system is currently CASREP C-3 and not capable of being fully mission ready unless the missing rudder is replaced and installed. The first step is to contract for a complete, new replacement rudder and rudder stock.
4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C. 2304(c)(2), FAR 6.302-2 Unusual and Compelling Urgency
5. Rationale Justifying Use of Cited Statutory Authority: The timeline from contract award to completion of fabrication is 17-20 weeks. A required delivery date of 28 August 2015 has been established. Competition was maximized within practical limits of urgency by the posting of a sources sought which resulted in the response from two small businesses. If these repairs are not done the mission of USNS GRAPPLE would be jeopardized.
6. Description of Efforts made to Solicit Offers from as Many Offerors as Practicable: A sources sought was posted to FedBizOpps and returned two small businesses interested in quoting, Padgett Swann Machinery and Colonnas Shipyard Inc. A small business set-aside solicitation is posted with a response date of 15 April 2015. This is a C3 CASREP. The USNS GRAPPLE is currently in a “No Sail” status and cannot sail away and deploy to complete future critical operational commitments. This could have significant impact on the Navy.
7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine the estimated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable. The Low Price Technically Acceptable (LPTA) method will be used to determine fair & reasonable in accordance with FAR PART 15.
8. Actions to Remove Barriers to Future Competition: In this case, the limitation on competition is a result of emergent work and possibly the process and ability to fabricate the large rudder.
