MILITARY SEALIFT COMMAND NORFOLK

SP64 471 EAST C STREET

NORFOLK, VA 23511-2419

20 May 2015 N104-15-T-3729

JUSTIFICATION AND APPROVAL (J&A)

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command-Norfolk (MSC), 471 East C. Street Norfolk, Va. 23511.

2. Description of Action Being Approved: This is a sole source justification to procure the services of Control Flow for repairs of the ram tensioners with which the T-AKEs are outfitted. Control Flow is the Original Equipment Manufacturer (OEM) of the T-AKE ram tensioner used on the UNREP System installed on the T-AKE ships.

3. Description of Supplies/Services: MSC Norfolk has a requirement to address additional repairs that will be required to complete the refurbishment of Ram Tensioners for the UNREP Stations. The USNS CHARLES DREW (T-AKE 10) ROH/DD period of performance commences on 29 June 2015. Adding painting to the repair period may delay completion of assembly and testing at Control Flow past the start date of the ROH period. Past experience on the USNS MATTHEW PERRY determined that delaying receipt of the ram tensioners on site could still be acceptable if the rams were shipped painted and tested complete, ready for installation. Estimated cost is $266,000.

4. Statutory Authority Permitting Other Than Full and Open Competition: The statutory authority for this procurement is 10 USC 2304 (c) (1) as implemented by FAR Part 13.501. The authority was permanent by the NDAA of FY 2015.

5. Rationale Justifying Use of cited Statutory Authority: Control Flow of Signal Hill, CA is the Original Equipment Manufacturer (OEM) of the T-AKE ram tensioner used on the UNREP System installed on the T-AKE ships. There are seven (7) ram tensioners installed on each T-AKE class ship. A settlement between NAVSEA PMS 325 and the manufacturer required removal from the T-AKE ships and return to Control Flow for disassembly of the ram tensioners to correct defective components manufactured out of tolerance from the design specification.

The ram tensioner components have been in service in the fleet for over 5 years and require preservation, preparation, and painting. Control Flow has the handling equipment required at their facility and is already required to disassemble these large rams (35 ft/11,000 lb. each) for warranty repair. The best opportunity to preserve these components is while they are disassembled when the hard to reach areas are accessible to paint.

The ram tensioners are identified as critical equipment for the USNS LEWIS AND CLARK Class in the SAMM Maintenance System. In accordance with SMS procedure 10.6-002-ALL, critical equipment must be maintained to include preventative and corrective maintenance. The ram tensioners are critical to the performance of the ship’s mission. SAMM Maintenance Procedures require Original Equipment Manufacturer (OEM) Technical Service Representatives to perform the preventative and corrective maintenance on the units.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: Through market research and input from the Technical experts for the UNREP Gear, there has been only one responsible source identified that can repair the Ram Tensioners installed on the T-AKEs. The requirement was synopsized in FEDBIZOPPS on 21 May 2015.

7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine that the price is fair and reasonable pursuant to Federal Acquisition Regulations (FAR) Part 13.106-3.

8. Actions to Remove Barriers to Future Competition: No specific action is planned to overcome barriers to competition in subsequent procurements, other than synopsizing the requirements. If another potential source emerges, MSC Norfolk will assess whether competition for future requirements is feasible.
