MILITARY SEALIFT COMMAND

N104-15-T-3440-URG
CLASS JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION (UNUSUAL AND COMPELLLING URGENCY)
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC), Norfolk, VA.
2. Nature of Action: This is a justification and approval (J&A) for the use of other than full and open competition that will result in two firm fix price purchase orders to Fairbanks Morse Engine of Beloit, WI. (the Original Equipment Manufacturer)of the Main Diesel Generators on the T-AKE Dry Cargo Ships.
3. Description of Supplies/Services: Military Sealift Command (MSC) has an urgent requirement to replace the vibration damper fasteners on six (6) T-AKE Class Dry Cargo ships on the East Coast; USNS LEWIS AND CLARK (T-AKE 1), USNS ALAN SHEPARD (T-AKE 3), USNS ROBERT E. PEARY (T-AKE 5), USNS CHARLES
DREW (T-AKE 10), USNS MEDGAR EVERS (T-AKE 13), and USNS WILLIAM MCLEAN (T-AKE 12); and eight (8) T-AKE Class Dry Cargo ships on the West Coast; USNS SACAGAWEA (T-AKE 2), USNS RICHARD E BYRD (T-AKE 4), USNS AMELIA EARHART (T AKE 6), USNS WALLY SCHIRRA (T-AKE 8), USNS MATTEW PERRY (T-AKE 9), USNS CARL BRASHEAR (T-AKE 10), USNS WASHINGTON CHAMBERS (T-AKE 11), and USNS CESAR CHAVEZ (T-AKE 14), This requirement is differentiated by coast to facilitate Government tracking and Contractor scheduling by its service centers.
4. Statutory Authority Permitting Other than Full and epen: This contractual action is executed under the authority Section 4202 of the Clinger-Cohen Act of 1996 as implemented by FAR 13.501. Section 815 of the National Defense Authorization Act (NDAA) of Fiscal Year 2015 makes the authority permanent.
| 5. | Rationale Justifying Use of Cited Statutory Authority: | There are currently fourteen (14) active T-AKE Dry Cargo Ships in the MSC fleet with two (2) MAN BL 48/60 and two (2) 9L 48/60 four-stroke turbocharged diesel |
| engines per vessel. | The Original Equipment Manufacturer (OEM) of the engines for the T-AKE Dry Cargo Ships is MAN Diesel, Germany. Fairbanks Morse Engine (FME) of Beloit, WI and Motor Services Hugo Stamp (MSHS) of FT. Lauderdale, | |
| FL are the two OEM licensed and authorized service agents for MAN Diesel, Germany. | Proper refurbishment and maintenance of the engines are critical to the safe operation of the T-AKE Dry Cargo Ships. The OEM parts and technical data/drawings from the original manufacturer are required by USCG and ABS regulations. | This maintains all OEM warranties, ensures engine reliability and crew safety, therefore precluding consideration of a product manufactured by another company. |
There have been two catastrophic failures of the vibration damper fasteners on the T-AKE Class Dry Cargo Ships. As a result of the last failure on USNS WASHINGTON CHAMBERS four competitive Combined Synopsis/Solicitations were
N104-15-T-3340-URG
| issued as partial class buys for the replacement of these fasteners. | The premise was to differentiate by coast, urgency, and periods of performance. Two of the Combined Synopsis/Solicitations were considered unusual and compelling urgency and unusual and compelling urgency statements were completed and approved by the requiring code, N104, and NOOL. | Both FME and MSHS provided quotes for the four Combined Synopsis/Solicitations. | Of the four Combined Synopsis/Solicitations, only one resulted in a firm fixed price contract using Simplified Acquisition Procedures. | The other three have yet |
| to be awarded. | These Combined Synopsis/Solicitations were established by coast to facilitate Government tracking and vendor scheduling. | This has now become a large buy under the rules of FAR Part 13.5 because the award amount for each of the two projected awards is expected to be greater than |
$150,000.00 and stand-alone solicitations are required and all solicitations using FAR Part 13.5 rules.
Motor Services Hugo Stamp was awarded one contract for the immediate replacement of the existing fasteners with OEM certified fasteners. The period of performance has started with no action from MSHS. After contract award MSHS determined that it could not obtain the required fastener certification paperwork from the OEM as it believed it could at the time of award. MSHS requested that its remaining quotes be withdrawn and the awarded contract cancelled.
| The urgent requirement for the establishment of a risk mitigation plan, and immediate acquisition and timely installation of certified vibration damper fasteners on all fourteen (14) T-AKE Dry Cargo Ships still remains. | FME will perform the required testing to certify 100% of the fasteners for use and provide that certification to the Government. | Furthermore, FME has been involved in the root cause analysis of the catastrophic fastener failure on the USNS WAGHINGTON CHAMBERS (T-AKE 11) and has developed the proprietary certification and installation processes for these fasteners. | In order to mitigate additional catastrophic vibration damper failures that could result in damage to engine block that could result in block replacement, it is imperative that service orders be awarded as immediate as possible to allow for a required containment plan to be executed across the T-AKE class as soon as practicable. | A catastrophic failure could ultimately require a |
| replacement of an engine block at an estimated $3,000,000.00 plus an approximate 2-year waiting period for a block to be cast and machined. | This would take a T-AKE Dry cargo Ship out of service. | Loss of this valuable |
asset is unacceptable to MSC and would have a severe negative impact on MSC's replenishment support for the U.S. Navy.
Safety Management Systems Number 10.6-002-ALL lists all MPDEs as critical equipment. Failure of one MPDE will force a ship to reduce speed. The loss of two engines puts a ship in a C-4 status, thus becoming unable to perform its primary mission of providing underway replenishment services to the fleet. The reduction of speed can also pose a hazard to the crew, due to limited ship maneuverability. Proper refurbishment and maintenance of engines are critical to the safe operations of T-AKE vessel.
| MSC did not procure the technical data rights to these engines and therefore does not have manufacturing and technical information required to evaluate and determine whether non-OEM components and replacement parts offered are equivalent to the OEM components and replacement parts. | T-AKE engines require special tools, specialized repair parts, and technical expertise unique to these engines; only approved OEM parts are authorized to be |
| installed on this highly sophisticated equipment. | The OEM Representative has |
access to provide parts and technical data I drawings from the OEM to properly repair and maintain the equipment. All OEM repair parts are in compliance with USCG and ABS IMO regulatory requirements
6. Description of Efforts made to Solicit Offers from as Many Offerors as Practicable: The Contracting Officer will continue to synopsize and solicit each requirement in FEDBIZOPPS, unless there is an unusual and compelling need for the service and/or parts. In that event a procurement-specific J&A for unusual and compelling urgency will be executed and included in the contract file.
7. Contracting Officer's Determination of Fair and Reasonable Price: The Contracting Officer will determine that the price is fair and reasonable pursuant to Federal Acquisition Regulations (FAR) Part 13.106-3.
8. Actions to Remove Barriers to Future Competition: No specific action is planned to overcome barriers to competition in subsequent procurements due to the reasons stated in Section 5 of this document.
