Source Selection Information – FAR 2.101 and 3.104

JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Supply Systems Command, Fleet Logistics Center, Pearl Harbor
2. Description of the Action Being Approved.
A bridge contract to Manu Kai, LLC is required to prevent loss of contractor provided operations and maintenance services at the Pacific Missile Range Facility (PMRF), Hawaii. The bridge contract will prevent degradation, interruption, and/or failure of the PMRF mission.
3. Description of Supplies/Services.
The contract provides for the continuation of Range Operations Support (ROS) and Base Operations Support (BOS) Services at PMRF while a follow-on contract to N0060409D0001 is being procured. The contract will have a 15-month base period with an estimated maximum value of $90,000,000. Fiscal Year 2019 funds will be obligated on Task Orders for ROS and BOS service requirements in support of PMRF.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), the property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency.
5. Rationale Justifying Use of Cited Statutory Authority.
a. Manu Kai, LLC is the only source with human resources and specialized contractor-owned equipment (e.g. firefighting vehicles, mobile cranes, etc.)
in place at PMRF to immediately continue performance of ROS-BOS services without disruption to (1) Fleet live-fire qualification training, (2) mobile and portable range support for the training and readiness of Forward Deployed Naval Forces located at Fleet concentration areas, and (3) live-fire Developmental and Operational Tests for major weapons acquisition programs.
1) Manu Kai, LLC currently employs the human resources necessary for efficient, effective performance of services. The firm is the only private entity on the island of Kauai that has personnel qualified and certified to perform both range and base operations support services (e.g. Radar Maintenance, Ordnance, Fuels Management and Aircraft Refueling, Fire and Emergency Services, Armed Security Services, Air Traffic Control Tower, Ground Electronics, Air Intercept Controllers).
2) Manu Kai, LLC is the only firm with on-site, high-value vehicles and equipment required to provide services. The firm owns structural fire trucks, airfield rescue and firefighting vehicles, and other emergency vehicles necessary to the safety of PMRF assets and personnel. The firm owns vehicles necessary to lift, transport, install components, subsystems, and other items necessary to maintain and sustain systems and assets for PMRF and the command mission.
b. Manu Kai, LLC is the only firm with the management, procedures, and processes in place to continue support to on-going missions. No other firm is positioned or prepared at this time to ensure U.S. Navy air, surface and subsurface forces are trained and prepared to deploy, to provide range services for the conduct of ballistic missile defense and other major weapons acquisition live-fire tests, and to meet the safety and security of PMRF while the follow-on contract is procured.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
a. The bridge contract will provide interim coverage while the follow-on
PMRF ROS-BOS contract is being procured. The posting of a Request for Information or Sources Sought Notice has been waived by the Head of the Contracting Activity for this bridge (interim) contract in accordance with DFARS PGI 206.302-1. DFARS PGI 206.302-1(d), states "[w]hen utilizing the authority at FAR 6.302-1, the Contracting Officer shall post a request for information or a sources sought notice, and shall include the results of this inquiry in the justification required by FAR 6.303. This requirement to post may be waived by the Head of the Contracting Activity, or designee."
b. The Government held an Industry Day (September 11-12, 2017) for the follow-on contract to N0060409D0001; more than 30 firms attended the event.
c. A draft Performance Work Statement for the follow-on contract to
N0060409D0001 was posted to the Federal Business Opportunities Website on August 14, 2017.
d. Synopsis. In accordance with FAR 19.202, a public release of information has not been completed prior to development of the acquisition strategy and approval of a DD2579. A synopsis will be issued upon approval of a DD2579.
7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this Justification and Approval will be fair and reasonable.
The extension will be based on the annual cost and award fee pool of the final period of N0060409D0001. The final option period was evaluated in the prior competitive source selection. Fair and Reasonable costs of the final option period are based on the cost analysis and price comparisons used in determining the contract costs to be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
To remove barriers to future competition, the need for future bridge contracts will be reduced by initiating future follow-on PMRF ROS-BOS procurements five(5) years prior to contract expiration.
The Government intends to compete the follow-on contract to N0060409D0001.
