J&A 19-0154
5. Rationale Justifying Use of Cited Statutory Authority.
MTS Systems Corporation is the Original Equipment Manufacturer (OEM) of the existing system that the IDL Test System will replace. Many items previously procured for the existing system will be retained and used in conjunction with the new IDL Test System. The IDL Test
System must be compatible with existing components presently installed at this laboratory (test fixtures and mounts of the exiting test system). Additionally, the IDL Test System software needs to be compatible with the programmed test procedures that have been written for the existing test system. MTS has proprietary rights in regards to the software used to operate the equipment. All support for the existing test system have previously been established with MTS Systems Corporation and paid for by the Government, including calibration and interface with existing components.
Market Research was conducted for this procurement utilizing various web searches. Based on the result of this information, MTS Corporation is the only source that will meet the
Government’s requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The NAVAIR Subject Matter Experts in the field who support AIR-4.3 are current on the trade studies and the technology environment. The engineering program experts maintain constant surveillance of the marketplace for these items, and to date are unaware of any other sources that are capable of satisfying the Government’s requirements.
A synopsis of the proposed procurement will be published in the Federal Business Opportunities and in accordance with FAR Part 12, the Government will issue a Request for Proposal for this sole source requirement for a period of 15 days.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies provided under this contract are procured at a fair and reasonable price. The contractor will submit a formal price proposal with sufficient information to support the accuracy and reliability of the estimate. The proposal will be reviewed by experienced technical analysts and the Contract
Specialist. The Contracting Officer will utilize price analysis as the basis for negotiating a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in paragraph five, there are no plans at this time to compete future contracts for the type of supplies covered by this document. AIR 4.3 will continue to conduct market research for products that would allow future competition. If another potential source emerges, the contracting activity will assess whether competition of future requirements is feasible.
