FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWC-AD) Patuxent River, MD

2. Description of the Action Being Approved.

This Justification and Approval (J&A) authorizes and approves the issuance of a Firm-Fixed- Price contract, brand name specific basis, for calibration equipment from Keysight Technologies Inc., 9780 S Meridian Blvd, Englewood CO, 80112. The procurement is for calibration equipment that is utilized by the Government in all NAVAIR calibration laboratories. The dollar amount for this requirement is estimated at $771,205.50 Vendor will maintain price quote listed for 732 days after the initial order is placed for purchase of up to 6 additional units. The procedures of FAR Part 12 and Part 13.5 will be utilized for this commercial brand name specific acquisition.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c) (1), and FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

Keysight Technology Inc. is the Original Equipment Manufacturer (OEM) for the equipment supported within the Government’s calibration lab. The items requested on this J&A are in the Navy’s inventory; all support for these model numbers have previously been established and paid for by the Government. Procurement of new model numbers will result in additional Instrument Calibration Procedure costs not expected to be recouped by the Government via a competitive procurement. A total workload of 5 Instrument Calibration Procedures would have to be duplicated if new model numbers were introduced. Each Instrument Calibration Procedure includes: procedure re-write, bench-test, QA check, calibration interval analysis/change as required, publication costs, data element/database support/updates at an individual cost of $21,285.00 per procedure for a total cost of $160,425.00. Creating new Instrument Calibration Procedures would result in a duplication of cost to the Government that is not expected to be recovered through full and open competition.

Market research was conducted for this procurement utilizing various web based searches. The Program Office experts in the field who support 4.1.12 are current on the trade studies and the technology environment; they maintain constant surveillance of the marketplace for these items.

To date, no other brand name beside Keysight Technologies are capable of satisfying the Government’s requirements. Based on the results of this information it was determined the items listed on this procurement are the only equipment that will fit the existing logistics infrastructure for calibration of support equipment across the fleet.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

As described in paragraph 5 above, NAVAIR Program Office experts supporting 4.1.12 conducted market research by utilizing various web searches and staying current on the marketplace for these items. Purchasing a brand other than Keysight Technology would require a duplication of work and cost for the Government. In accordance with FAR Part 12, the Government will issue a combined synopsis/solicitation for the period of 15 days. All responsible sources will be considered before award.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.402(a), the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. An analysis of the proposals will be performed by the Contract Specialist. The Contracting Office will use price analysis as the basis of determining the price as fair and reasonable for the calibration equipment

J&A Number 19-0348 covered by this J&A. Information related to prices including established catalog prices and previous procurements for commercial and Government purchases will be utilized in justifying a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition.

AIR 4.1.12 will continue to conduct market research for products to evaluate emergent technologies and architectures that would allow future competition. At this time, Keysight Technologies Inc. is the only source that produces equipment that meets the Government’s requirements. If another potential source emerges, NAVAIR will assess whether competition for future requirements is feasible.
