DEPARTMENT OF THE NAVY
NAVAL AIR SYSTEMS COMMAND AIRCRAFT DIVISION
21983 BUNDY ROAD
BUILDING 441, UNIT 7
PATUXENT RIVER, MARYLAND 20670
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Patuxent River, MD.
2. Description of the Action Being Approved.
Name Justification and Approval authorizes and approves the issuance of a Firm Fixed Priced (FFP) contract action on a brand name basis to any company that is an authorized reseller of Wind River equipment. The Atlantic Test Range’s Range Display Systems (RDS) team is developing a Ground Based Detect and Avoid System (GBDAA) for Unmanned Aerial Systems (UAS) operations in civil and military airspace. The system will be deployed as a real-time operating system (RTOS) that will enhance situational awareness within PAX NAS restricted and Federal Aviation Administration (FAA) controlled airspace. Wind River VxWorks Software is a commercial-off-the-shelf (COTS) solution that meets NAVAIRINST 13034.4 requirements for UAS surveillance without requiring unpractical methods such as a visual observer or manned chase planes.
3. Description of Supplies/Services.
The NAWCAD ATR has a requirement for the procurement of Wind River VxWorks 653 Multi-Core edition 3 Software Licenses and Maintenance. The total cost for this procurement will be approximately $146,340.00.
Estimated Dollar Value in Thousands

| $147 |
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) as cited in FAR6.302-1. The acquisition is considered a brand name description per FAR 6.302-1(c) and is justified here in accordance with FAR 6.303 and 6.304.
5. Rationale Justifying Use of Cited Statutory Authority.
The Guardian GBDAA system will be used to support ATR’s UAS customers and will serve as a safety of flight (SOF) critical system. As a SOF critical system, the software must be integrated onto certified safety hardware and must run on a certified operating system (OS) that meets DO-178C and MIL-STD-882E requirements. Wind River’s VxWorks 653 Multi-core Edition meets NAVAIR policy (NAVAIRINST 13034.4) and is a COTS solution containing a DO-178C/ ED-12C Certification Evidence package, which provides comprehensive safety certification evidence, enabling avionics manufacturers to meet stringent DO-178C certification. The DO-178C certification evidence contains artifacts from core components VxWorks GOS APIs, and ARINC 653 APEX APIs. These artifacts include designs, tests, reviews, source code, build files, test results, annotated object-level code coverage, and tool qualification data for critical IMA systems. In order to maintain compliance with military and Federal (civil) standards, the software is in direct support of test flight operations for all UAV's customers at ATR, including MQ-25A. Wind River VxWorks Software is a commercial-off-the-shelf (COTS) solution that meets NAVAIRINST 13034.4 requirements for UAS surveillance without requiring unpractical methods such as a visual observer or manned chase planes. To develop a comparable software to meet the required standards would be a duplication of costs to the government. The software must be compatible with existing software and hardware systems. Changing to any other brand would delay flight schedules, cause ATR to not meet required deadlines, delay test schedules, and cost the government hundreds of thousands of dollars for the purchase of new equipment, installation, certifications and training.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
ATR has completed market research to identify companies having the expertise, capabilities, and experience to meet the requirements of this procurement. It has been deemed by ATR Subject Matter Expert (SME) as not feasible for another type of VxWorks software to be integrated due to additional development, integration, regression of testing, and compatibility issues. A Combined Synopsis/Solicitation was posted to the Federal Business Opportunities under the Solicitation Number N00421-19-R-0046. The Combined Synopsis/Solicitation opened January 23, 2019 and closed January 28, 2019. Three responses were received in response to this solicitation. Given the dollar threshold of the procurement, FAR Part 13, Simplified Acquisition Procedures will be utilized and the procurement will be set aside for Small Business.
7. Determination of Fair and Reasonable Cost.
Based upon the published Commercial Price List from USI Electronics, the Contracting Officer has adequate information and background to determine a fair and reasonable cost.
8. Actions to Remove Barriers to Future Competition.
The ATR will continue to monitor the market for vendors that can provide the expertise and capability to provide a complete system needed to satisfy and support requirements. If another potential source emerges, ATR will assess whether competition for future requirements is feasible.
Per Navair Instruction 4200.31F dated 22 July 2014, Contracts awarded under FAR Part 13, simplified acquisition procedures, do not require a J&A thus do not need concurrence from our legal counsel.
