DEPARTMENT OF THE NAVY
NAVAL AIR SYSTEMS COMMAND AIRCRAFT DIVISION
21983 BUNDY ROAD
BUILDING 441, UNIT 7
PATUXENT RIVER, MARYLAND 20670
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Patuxent River, MD
2. Description of the Action Being Approved.
This Justification is for the Sole Source procurement of a Firm-Fixed Price (FFP) contract with the Cubic Defense Applications in support of the Atlantic Test Range (ATR), in support of the Wideband Line-of- Sight (LOS) operations at Patuxent River, MD. This Sole Source Justification (SSJ) authorizes and approves the issuance of a contract action on a Sole Source basis to the only authorized dealer of the MQ- 25A KI-16 Removable Module.
3. Description of Supplies/Services.
The NAWCAD ATR has a requirement for the purchase of MQ-25A KI-16 Removable Module that will be integrated with the current Removable Modules. The total cost for this procurement will be approximately $90,000.00.
Estimated Dollar Value in Thousands
FY19-RDT&E $90
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) as cited in FAR6.302-1. The acquisition is considered a brand name description per FAR 6.302-1(c) and is justified here in accordance with FAR 6.303 and 6.304.
5. Rationale Justifying Use of Cited Statutory Authority.
These removable modules provide the capability to transmit encrypted Command and Control (C2) data to the MQ-25A Air vehicle using the Cubic Mantis II Surface Data Terminal already in place. Using the same terminals will minimize the time needed for software development and integration with the current systems since ATR has already purchased them. As a result, compatibility is paramount because it would cause severe delays and funding burdens to have to develop and integrate new modules into the system with the current one. This would cost the government thousands of dollars in delayed missions and flight schedules.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
ATR has completed market research to identify companies having the expertise, capabilities, and experience to meet the requirements of this procurement. It has been deemed by ATR that there are no other offerors that could support the required repair, update and return to full functionality of the failed Fast Switching Synthesizer. A Combined Synopsis/Solicitation was posted to the Federal Business Opportunities under the Solicitation Number N00421-19-Q-0362. The Combined Synopsis/Solicitation opened 04 June 2019 and closed on 11 June 2019. There was one quote received in response to this solicitation and was from Cubic Defense Applications.
7. Determination of Fair and Reasonable Cost.
Based upon the quote received, the Contracting Officer has adequate information and background to determine a fair and reasonable cost.
8. Actions to Remove Barriers to Future Competition.
The ATR will continue to monitor the market for vendors that can provide the expertise and capability to provide a complete system needed to satisfy and support requirements. If another potential source emerges, ATR will assess whether competition for future requirements is feasible.
Per Navair Instruction 4200.31F dated 22 July 2014, Contracts awarded under FAR Part 13, simplified acquisition procedures, do not require a J&A thus do not need concurrence from our legal counsel.
