JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Patuxent River, MD
2. Description of the Action Being Approved.
This Justification is for the Sole Source procurement of a Firm-Fixed Price (FFP) contract for a Herley Fast Switching Synthesizer in support of the Atlantic Test Range (ATR), ASAM Branch Team. The synthesizer is crucial to several programs in ADAMS which has failed and needs repair. This Sole Source Justification (SSJ) authorizes and approves the issuance of a contract action on a Sole Source basis to the original manufacturer of the failed component Ultra Electronics Herley.
3. Description of Supplies/Services.
The NAWCAD ATR has a requirement for the repair, update and return to full functionality of the failed Fast Switching Synthesizer identified.

4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) as cited in FAR6.302-1. The acquisition is considered a brand name description per FAR 6.302-1(c) and is justified here in accordance with FAR 6.303 and 6.304.
5. Rationale Justifying Use of Cited Statutory Authority.
The Fast Switching Synthesizer in question is a highly complex, COTS frequency synthesizer utilizing state-of-the-art hardware and control software. Repairing said hardware and updating the required control software requires the use of patented, copyrighted and other proprietary data, limiting competition to the original equipment manufacturer only. Repair by other sources is highly impractical. NAVAIR has secured this unit previously and it has to be qualified to meet mission requirements. As a result, compatibility is paramount because it would cause severe delays and funding burdens to have the unit repaired by any other vendor. This would cost the government thousands of dollars in delayed missions and flight schedules.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
ATR has completed market research to identify companies having the expertise, capabilities, and experience to meet the requirements of this procurement. It has been deemed by ATR that there are no other offerors that could support the required repair, update and return to full functionality of the failed Fast Switching Synthesizer. A Combined Synopsis/Solicitation was posted to the Federal Business Opportunities under the Solicitation Number N00421-19-Q-0262. The Combined Synopsis/Solicitation opened 01 April 2019 and closed on 08 April 2019. There was one quote received in response to this solicitation.
7. Determination of Fair and Reasonable Cost.
Based upon the quote received, the Contracting Officer has adequate information and background to determine a fair and reasonable cost.
8. Actions to Remove Barriers to Future Competition.
The ATR will continue to monitor the market for vendors that can provide the expertise and capability to provide a complete system needed to satisfy and support requirements. If another potential source emerges, ATR will assess whether competition for future requirements is feasible.
Per Navair Instruction 4200.31F dated 22 July 2014, Contracts awarded under FAR Part 13, simplified acquisition procedures, do not require a J&A thus do not need concurrence from our legal counsel.
