4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c) (1), only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

Morehouse Instruments is the original equipment manufacture of the items being requested and already exists is in the Navy inventory. All support for this ancillary equipment has previously been established and paid for by the Government. Procurement of a new model numbers will result in additional instrument calibration procedure costs not expected to be recouped by the Government via a competitive procurement. A total of 12 instrument calibration workload procedures would have to be duplicated if a new model number is introduced. Each procedure includes: procedure re-write, bench-test, Quality assurance checks, calibration interval analysis/change as required, publication costs, and data element/database support/updates at a cost of $21,285 per procedure for a total cost of $255,420.00 resulting in a substantial duplication of cost to the Government that would not be recovered through competition. In addition, there are no other model numbers that could replace the intended due to the systems they support. All calibration activities now utilize the same Calibration Equipment Standards and Standard Instrument Calibration Procedures to support similar workloads and cannot be deviated or substituted. This has minimized the number of calibration procedures used Navy-wide, reduced the training requirements, causing fewer interface problems between equipment, reduced calibration time and improved compatibility between calibration laboratories.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The NAVAIR METCAL engineering program experts in the field who support AIR-4.9 are current on the trade studies and the technology environment, they maintain constant surveillance of the marketplace for these items, and to date are unaware of any other sources that are capable of satisfying the Government’s requirements.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies provided under this contract are procured at a fair and reasonable price. The Contractor will submit a formal price proposal with sufficient information to support the accuracy and reliability of the estimate. The proposal will be reviewed by experienced technical analysts, and contract specialists. The Contracting Officer will utilize price analysis as the basis for negotiating a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in paragraph 5, there are no plans at this time to compete future contracts for the type of supplies covered by this document. If another potential source emerges, the contracting activity will assess whether competition of future requirements is feasible.
