DEPARTMENT OF THE NAVY

NAVAL AIR WARFARE CENTER AIRCRAFT DIVISION

22473 MILLSTONE ROAD, BLDG 505

PATUXENT RIVER, MD 20670-1127

IN REPLY REFER TO

J&A Number: 18-0310
J&A Number: 18-0310

JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Systems Command (NAVAIR) Naval Air Warfare Center Aircraft Division (NAWCAD), Patuxent River, MD

2. Description of the Action Being Approved.

This Justification and Approval authorizes and approves the issuance of a Firm Fixed Price contract to A.K.O. Incorporated, Torque Specialties (AKO Inc.), 110 Broadbrook Rd, Enfield, CT 06082-2530. The award of the contract is on a sole source basis for the procurement of Calibration Standards (CALSTDs) and ancillary equipment for the NAVAIR Metrology and Calibration (METCAL) Program.

The dollar amount for this requirement is estimated at $273,950.00 for the required equipment (inclusive of shipping). The procedures of FAR Part 12 and Part 13.5 will be utilized for this commercial brand name specific acquisition.

3. Description of Supplies/Services.

The specific CALSTDs ancillary equipment is as follows:

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

AKO Inc. is the original equipment manufacturer (OEM) of the required CALSTDs ancillary equipment. This TSDTFC2060EX001 Exchange Kit is used to calibrate torque and force tools used on Navy aircraft, ships, and supporting weapon systems/ support equipment. These specific kits are required to replace Beyond Economical Repair kits creating inventory shortfalls at Fleet Calibration Laboratories. Only this Exchange Kit can be used due to proprietary interfaces controlled by AKO Inc. as the OEM. Only the OEM can provide the model numbers that have been certified for use in the NAVAIR METCAL Program. There is no other manufacturer who manufactures this Exchange Kit that is compatible in form, fit, and function with existing NAVAIR Instrument Calibrator Procedures (ICPs) workload. Procurement of new model numbers would result in additional instrument calibration procedure costs. A total workload of 15 ICPs would have to be duplicated if a new model number were introduced. Each ICP includes: procedure re-write, bench-test, Quality Assurance, calibration interval analysis/change as required, publication costs, data element, database support and updates at an estimated cost of $21,285 per procedure, for a total estimated cost of $319,275.00. The estimated cost is high enough that it would not be recouped through competition.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The experts in the field who support NAVAIR METCAL Program are current on the trade studies and the technology environment. They maintain constant surveillance of the marketplace for supporting equipment and currently no other sources are capable of satisfying the Government’s requirement. In addition, internet searches have been performed on the Exchange Kit P/N. AKO Inc. remains the OEM and is the only company available to and capable in providing the required equipment.

In accordance with FAR Part 12, the Government will issue a combined synopsis/solicitation for the period of 15 days. All responsible sources will be considered before award.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAWCAD has no plans at this time to compete future contracts for the types of supplies covered by this J&A. If another potential source emerges, NAWCAD will assess whether competition for future requirements is feasible. NAWCAD will continue to conduct market research for equipment to evaluate emergent technologies and architectures that would allow future competition. At this time, AKO Inc. is the only source that produces the equipment essential for this procurement that meets the Government’s requirements.
