JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Patuxent River, MD
2. Description of the Action Being Approved.
This Justification and Approval (J&A) authorizes and approves, on a sole source basis, a Cost Plus Fixed Fee (CPFF) bridge contract between the existing contract N00178-04-D-4143-M806 and the follow-on contract. The bridge contract will be issued to The Engility Corporation (hereafter referred to as “Engility”) with an anticipated period of performance starting 01 April 2014 and ending 18 January 2015. This bridge contract will ensure the continuation of engineering and technical services to the Naval Air Systems Command (NAVAIR), Software Engineering and Acquisition Management Division (AIR 4.1.4), in support of software development, test and acquisition at Patuxent River, MD.
3. Description of Supplies/Services.
Contracted support services are required for the development and integration of systems, including hardware and software. This shall include software program generation, and software and hardware integration, along with development of test devices and systems which support system test and integration such as weapon system simulators and trainers. Such devices may include non-intrusive hardware/interface monitoring devices and the software/systems that analyze the data extracted/generated. This requirement will cover a broad spectrum of development of operational systems requirements and integration, which includes conducting operational and functional systems testing, and fleet introduction. Each task requires specific product deliverables that include, but are not limited to: (a) hardware, firmware, trade analysis documentation, (b) test plans, (c) test procedure documentation, (d) test report documentation, (e) training materials including computer based training as well as training documentation, (f) operator user guides and (g) operational concept documentation.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
The requirement for a 10 month period, which is necessary to allow sufficient time to adequately process a competitive follow-on contract to N00178-04-D-4143-M806 (expires 31 March 2014) and to allow for the uninterrupted continuation of contracted services in support of critical PMA functions. Engility, as the incumbent contractor, has the management structure, experience and technical expertise to execute the effort. It is impossible for another contractor to assume the ongoing workload without a transition period which would cause unacceptable delays in completing and delivering products to the fleet. This contract vehicle provides systems engineering and software engineering support to over seven major program offices in NAVAIR, several Competency Teams in NAWCAD, NAWCWD and FRC. A delay in the awarding of the bridge will have an immediate and detrimental effect on the products and services provided to the fleet. At this point in time, Engility is the single source capable of providing the management and technical continuity necessary to avoid a degradation of performance and quality.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
A Sources Sought notice for this bridge effort, solicitation N00421-13-R-0082, was posted in FedBizOpps from 08 October 2013 to 23 October 2013. During this timeframe, no other potential sources expressed an interest in this requirement or contested a proposed award on a sole source basis to Engility.
7. Determination of Fair and Reasonable Cost.
Per FAR 15.402, the Contracting Officer is required to procure supplies and services from a responsible source at a fair and reasonable price. Engility will submit a formal price proposal with certified cost and pricing data and sufficient information to support the accuracy and reliability of the estimate. The Contracting Officer will obtain sufficient cost and/or pricing data, utilize available direct/indirect rate information from DCAA/DCMA and consider previous estimated and actual cost history as the basis for determining a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition.
This action is for a standalone bridge contract while the follow-on procurement is being competed. In accordance with NAVAIRINST 4200.58, the Statement of Work shall be reviewed by an independent source which is defined as an entity within the technical community not directly related to the procurement. This review shall occur prior to solicitation release to ensure requirements are not overly restrictive or targeted for the incumbent. In addition, the Government will release another draft copy of the statement of work along with the pre-solicitation notice to ensure potential offerors have ample opportunity to review the requirement.
