NOTICE TO OFFERORS
1. NOTICE TO ALL OFFERORS: The Government anticipates awarding a firm, fixed price contract in response to quotes/proposals received to this solicitation. As a result, the contract's pricing will not be subject to any adjustment on the basis of the contractor's increased costs due to COVID-19 and/or inflationary causes experienced during contract performance. Because a firm, fixed price contract places the maximum risk and full responsibility for all costs and resulting profit or loss on the contractor, offerors are advised to consider these risks when pricing their quotes/proposals.
2. This solicitation is for the procurement of AC GROOM in support of SRF YOKOSUKA. It is anticipated that this solicitation will result in an award/order of a Firm, Fixed-Price Service type contract.
3. The entire solicitation shall be filled out, signed, and returned as part of your quote. See block 8 on page 1 of the solicitation for the closing date and time.
4. The deadline for submission of questions regarding the solicitation’s terms, conditions, specifications, and/or the statement of work (SOW) / performance work statement (PWS) is _2_ working days prior to the solicitation’s closing date.
5. The Government will award on the basis of price unless the contracting officer is aware of past performance information related to the low price quote/offer which indicates that quote/offer may not represent best value. In that case, the Government reserves the right to consider the past performance of other quotes/offers, conduct a price, past performance tradeoff, and award to other than the lowest price quote/offer
6. SINGLE AWARD FOR ALL ITEMS: Due to the interrelationship of supplies and/or services to be provided hereunder, the Government reserves the right to make a single award to the quoter whose quote is considered in the best interest of the government, price and other factors considered. Therefore, quoters who quote less than the entire effort specified herein may be determined to be unacceptable.
7. “EXCEPTIONS: All quoters MUST note all exceptions from the solicitation’s terms conditions, specifications, and/or the statement of work / performance work statement, if any. Any exceptions taken to specifications are REQUIRED to provide Technical Specification Sheets of the material providing. If technical specifications sheets not received with quote offer will be determined non-responsive/non-compliant and will not be considered. Commander, Navy Installations Command (CNIC), has established the Defense Biometric
Identification System
(DBIDS) to improve management and force protection at Navy installations. The Navy has transitioned from using
The Navy Commercial Access Control System (NCACS) to the DBIDS for contractors and vendors requiring access to an installation. DBIDS is a standardized process for granting unescorted access privileges to vendors, contractors, Suppliers, and service providers not otherwise entitled to the issuance of a Common Access Card (CAC) who seek Access to and can provide justification to enter Navy installations and facilities. Visiting vendors may obtain daily passes directly from the individual Navy Installations by submitting identification credentials for verification and Undergoing a criminal screening/background check.

NOTICE TO CONTRACTORS: Information for Contractor Employees Seeking to Enter Japan
1. The following is provided for the information of contractors to the U.S. Navy whose employees need to enter Japan to perform contract requirements. The information is current as of February 2023. While the information is believed to be accurate, policies and procedures are continuing to change on a regular basis.
2. See https://www.japan.travel/en/coronavirus/ for a list of the current restrictions and COVID entry procedures.
3. All contractor personnel arriving in Japan should utilize the process outlined in the attached USFJ Instruction to ensure they are recognized as members of the civilian component under Article 1.b. of the SOFA. The process requires that a contractor contact the contracting officer for the contract on which its employee will perform in Japan prior to the employee traveling to Japan. Contact is made through the Synchronized Pre-deployment and Operational Tracker (SPOT) system. The contractor will provide information to the contracting officer about the traveling employee. Following review, the contracting officer will issue the contractor a Letter of Authorization (LOA). The incoming contractor employee will hand carry a copy of the LOA and show it to the Japanese immigration authority at the port of entry as evidence of SOFA status.
Contractors who do not have current access to SPOT should contact their contracting officer for information about accessing SPOT.
4. This memo is intended to provide current information for contractors whose employees need to enter Japan to perform contract requirements. Nothing in the memo should be understood to change the terms or conditions of an existing contract. Any such changes must be made by an authorized contracting officer.

Request the following services onboard US SHIP , Yokosuka Japan:
1. Service to inspect and groom four (4) 200-Ton R-134A Air Conditioning (AC) plants.
2. Service to inspect and groom two (2) 1.5-Ton R-134A ship’s stores refrigeration systems (SSRS).
3. Service to plan recovery effort of AC plants based on inspection and groom findings.

Technician Specification: The OEM of this equipment is Johnson Controls Navy Systems (JCNS), CAGE Code 66935. The OEM service entity for JCNS is Johnson Controls BAS (JCBAS), CAGE Code 3GZH7.

Work to include the following:
- Operational assessment of four (4) AC plants on board the ship (procedure below). For inoperable plants provide material inspection.

Assessment/Groom Scope (Part 1):
Conduct an assessment and groom of the Air Conditioning (AC) Plants and Ships Stores Refrigeration Systems (SSRS) onboard US SHIP (DDG), Reference (a) is the technical manual for the AC Plants.
Reference (b) is the technical manual for the SSRS. Section 1 details the assessment/groom scope for the AC Plants, SSRS, issue report of findings listing all discrepancies noted, corrective action taken, and further action required. Report must be provided within 14 days from the completion of the assessment and groom. Issue nightly progress report after each workday highlighting all actions accomplished.
Section 1: AC Plant Assessment/Groom
Equipment/System: AC Plants No 1, 2, 3, and 4.
1. Observe AC plant operation; record operational parameters for operating unit. Ensure each compressor operates for a minimum of 4 hours.
2. Conduct material inspection of the AC plant noting any deficiencies.
3. Troubleshoot all operating parameters that are outside normal ranges. Verify status of air and non-condensable gases and condenser fouling.
4. Check status of moisture indicators, TPE unit oil level, and refrigerant level. Note color or abnormalities of fluids. Replace all washed out moisture indicators while AC plant is de-energized and tagged out. Moisture indicators procured but not required for groom shall be turned over to ship’s supply division.
5. Renew oil in oil sump with York oil “K” (York PN 011-00560-000). Replace online oil filter.
6. Inspect compressor shaft seal with coupling guard removed. Note any discrepancies with coupling or compressor-motor alignment when coupling guard is removed (coupling does not have to be uncoupled). Check the level of the shaft seal oil drip bottle.
7. Check accuracy of pressure transducers with calibrated gauges.
8. Check accuracy of thermistors.
9. Visually inspect AC plant, receiver and TPE unit for leaks. With an electronic leak detector, leak check the AC plant, receiver, TPE unit, and interconnecting piping with operating charge.
Removal of lagging is not required unless refrigerant leak detector alarms.
10. Perform the following with the AC plant energized and the compressor offline:
a. Complete diagnostic testing.
b. Inspect operation of Pre-Rotation Vane (PRV), Variable Geometry Diffuser (VGD), Condenser Water Control Valve (CWCV), Hot Gas Bypass Valve (HGBV) actuators, and Solid State Relays (SSRs) via microprocessor diagnostics testing. Verify switches are in automatic and note any switch that is in manual.
c. Adjust/Calibrate PRV, VGD, CWCV, & HGBV actuators as needed.
d. Check EPROM and note if version is correct for equipment configuration
e. Verify operation of all solenoids.
f. Inspect control parameters and note any parameter that is not set to the default value per reference (a). Reset any values not at default values back to the default value.
g. Calibrate Chilled Water (CW) target flow meter as required.
h. Verify compressor oil sump heater, plant oil pump, & VOR operation.
i. Operationally test TPE unit and note any deficiencies.
11. De-energize/tag-out AC plant and perform the following:
a. Visually inspect the motor controller and junction boxes. Note items including but not limited to spliced wires, poorly installed or missing grounds, commercial ring terminals, burnt wires, damaged wire insulation, missing wire labels, etc.
b. Inspect seawater condenser for biofouling, tube inserts, and tube leaks. Verify the chlorinator is operational.
c. Replace dehydrator cartridge (P/N: 873-NMS) Clean screen of safety cap.
12. Inspect receiver and interconnecting piping.
13. Inspect the AC Plant Maintenance Assist Modules (MAMS) kit.
14. Check ship’s refrigerant logs.
Section 2: Refrigeration System Assessment/Groom
1. Observe SSRS operation; record operational parameters for operating unit. Ensure each compressor operates for a minimum of 4 hours.
2. Conduct material inspection of SSRS noting any deficiencies.
3. Conduct an operational test of all equipment. Work with ship’s force to align each condensing unit with each unit cooler and note any parameters that are out of spec.
4. Check status of moisture indicators, TPE unit oil level, and refrigerant level. Note color or abnormalities of fluids.
5. Inspect compressor shaft seal with coupling guard removed. Note any discrepancies with coupling or compressor-motor alignment when coupling guard is removed (coupling does not have to be uncoupled).
8. Check accuracy of pressure transducers with calibrated gauges.
9. Check accuracy of thermistors.
10. Visually inspect receiver, TPE unit, interconnecting piping, and unit coolers for leaks. With an electronic leak detector, leak check the system, receiver, TPE unit, interconnecting piping, and unit coolers with operating charge.
11. Perform the following with the SSRS energized and the compressor offline:
a. Verify compressor oil sump heater, plant oil pump, & VOR operation.
b. Operationally test TPE unit and note any deficiencies
12. De-energize/tag-out SSRS and perform the following:
a. Verify wiring of Motor Controller
b. Inspect seawater condenser for biofouling, tube inserts, and tube leaks through the zinc plug. Note if the gaskets are misaligned or damaged and if there is any leak by for the SW isolation valves.
13. Inspect receiver and interconnecting piping. Inspect flexible hoses.
14. Inspect SSRS refrigerant logs.
15. Verify proper location of the temperature switch sensing bulbs and correct/insulate as required.
16. Inspect all Thermal Expansion Valves (TXVs). Ensure each TXV provides sufficient superheat.
Adjust as required.
17. Inspect chill and freeze storeroom unit coolers, verify proper defrost operation and take clamp amp readings for all coil and drain pan heaters. Note any operational discrepancies, louver damage, and wiring deficiencies; any deficiencies, including improper terminations, shall be corrected when the unit cooler is de-energized.
18. Inspect condensate drain line heaters from each unit cooler. Verify proper drain line heater operation.
19. Inspect door seal and latching mechanism for each chill and freeze storeroom.
20. Inspect storeroom paneling for leaks or sealant damage.
Material/Support Requirements (Part 2):
Parts/Material/ Services to be provided by USS Shoup DDG 86
- S/F assistance with securing and operating A/C plants throughout the inspection and groom.
- S/F runs all WAFs and Tagouts.
- S/F will provide any additional R134a from the stock system per NSTM516.
- All refrigerant or trace gas required during the inspection and groom.
- Oil drain tank
- Nitrogen required for leak checks of SSRS
Parts/Material/ Services to be provided by the contractor:
-All tools required to complete work listed in Assessment/ Groom Scope (Part 1).
- Four (4) AC Plant dehydrator cartridges
- Sixteen (16) AC moisture indicator cap assembly
- Eight (8) OEM AC Plant oil filter kit YORK 026 32769 000, two per AC plant
- 64 (64) gallons YORK type “K”. Sixteen (16) gallons per AC Plant for full oil renewal.
- Upon completion of assessments, the OEM technician is to provide condition reports that identify any additional discrepancies found during the inspection. The condition report should include conditions found, recommended repairs, additional labor, and material costs to correct.

The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the U.S. Naval Ship Repair Facility (SRF) Yokosuka, Japan via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address https://doncmra.nmci.navy.mil.
Reporting inputs will be for the labor executed during the period of performance during each Governmental fiscal year (FY), which runs October 1 through September

CONFIDENTIALITY AGREEMENTS OR STATEMENTS--REPRESENTATION (JAN 2017)
(a) Definition. As used in this provision-- Internal confidentiality agreement or statement, subcontract, and subcontractor, are defined in the clause at 52.203- 19, Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements.
(b) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions), Government agencies are not permitted to use funds appropriated (or otherwise made available) for contracts with an entity that requires employees or subcontractors of such entity seeking to report waste, fraud, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.
(c) The prohibition in paragraph (b) of this provision does not contravene requirements applicable to Standard Form 312, (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.
(d) Representation. By submission of its offer, the Offeror represents that it will not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).

52.204-27 PROHIBITION ON A BYTEDANCE COVERED APPLICATION (JUN 2023)
(a) Definitions. As used in this clause--
Covered application means the social networking service TikTok or any successor application or service developed or provided by ByteDance Limited or an entity owned by ByteDance Limited.
Information technology, as defined in 40 U.S.C. 11101(6)--
(1) Means any equipment or interconnected system or subsystem of equipment, used in the automatic acquisition, storage, analysis, evaluation, manipulation, management, movement, control, display, switching, interchange, transmission, or reception of data or information by the executive agency, if the equipment is used by the executive agency directly or is used by a contractor under a contract with the executive agency that requires the use-
(i) Of that equipment; or
(ii) Of that equipment to a significant extent in the performance of a service or the furnishing of a product;
(2) Includes computers, ancillary equipment (including imaging peripherals, input, output, and storage devices necessary for security and surveillance), peripheral equipment designed to be controlled by the central processing unit of a computer, software, firmware and similar procedures, services (including support services), and related resources; but
(3) Does not include any equipment acquired by a Federal contractor incidental to a Federal contract.
(b) Prohibition. Section 102 of Division R of the Consolidated Appropriations Act, 2023 (Pub. L. 117-328), the No TikTok on Government Devices Act, and its implementing guidance under Office of Management and Budget (OMB) Memorandum M-23-13, dated February 27, 2023, "No TikTok on Government Devices" Implementation Guidance, collectively prohibit the presence or use of a covered application on executive agency information technology, including certain equipment used by Federal contractors. The Contractor is prohibited from having or using a covered application on any information technology owned or managed by the Government, or on any information technology used or provided by the Contractor under this contract, including equipment provided by the Contractor's employees; however, this prohibition does not apply if the Contracting Officer provides written notification to the Contractor that an exception has been granted in accordance with OMB Memorandum M-23-13.
(c) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (c), in all subcontracts, including subcontracts for the acquisition of commercial products or commercial services.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1)in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—
