NOTICE TO OFFERORS
1. This solicitation is for the procurement of MACHINERY ASSESSMENT (VIBRATION ANALYSIS) in support of SRF JAPAN. It is anticipated that this solicitation will result in an ORDER of a FIRM, FIXED-PRICE SERVICE type contract.
2. The following completed, signed documents must be returned as part of your quote: 52.204-24, 52.204-26 and 52.209-11. See block 8 on page 1 of the solicitation for the closing date and time.
3. The Government will award on the basis of price unless the contracting officer is aware of past performance information related to the low price quote/offer which indicated that quote/offer may not represent best value. In that case, the Government reserves the right to consider the past performance of other quotes/offers, conduct a price, past performance tradeoff, and award to other than the lower price quote/offer.
4. SINGLE AWARD FOR ALL ITEMS: Due to the interrelationship of supplies and/or services to be provided hereunder, the Government reserves the right to make a single award to the offeror whose quote is considered in the best interest of the government, price and other factors considered. Therefore, offerors who quote less than the entire effort specified herein may be determined to be unacceptable.
5. “EXCEPTIONS: All offerors MUST note all exceptions from the solicitation’s terms conditions, specifications, and/or the statement of work / performance work statement, if any. The public health considerations occasioned by the Coronavirus Disease 2019 (COVID-2019) continue to evolve. Every contractor should be mindful of current events, travel warnings, and health advisories, and of the potential impacts on personnel safety and contracted supplies and services. Offerors are responsible for understanding any travel restrictions or medical warnings/advisories that may be in effect for the place of performance and should price their proposal accordingly. Relevant information may be obtained from the U.S. Center for Disease Control at https://www.cdc.gov/coronavirus/2019-ncov/index.html, and from the U.S.
Department of State at: https://travel.state.gov/content/travel/en/traveladvisories/COVID-19

1. At the direction of [insert relevant Command or civilian authority], contractor and subcontractor employeesmeeting any of the four criteria below are restricted from entering any U.S. Navy Instillation:
(a) Employees who have been in the People's Republic of China, South Korea, Italy, or Iran, or any region that the U.S. Center for Disease Control designates as a Warning Level 3 or higher due to COVID-19 [or other locations identified by the Command or civil authority]. These locations are referred to as "relevant locations." Contractor employees are restricted from entering [name installation or location] for 14 days from the latest date of departure from a relevant location.
(b) Employees who have been in close physical contact for an extended period of time with someone who has returned from a relevant location. Contractor employees are restricted from entering [name installation or location] for 14 days from the last day on which the employee had close physical contact with someone who has returned from a relevant location.
(c) Employees who have been in close physical contact with someone identified as having COVID-19. Contractor employees are restricted from entering [name installation or location] for 14 days from the last day on which the employee had close physical contact with someone identified as having COVID-19.
(d) Employees who have been diagnosed with COVID-19. Contractor employees who have been diagnosed with COVID-19 will not be permitted to access [name installation or location] until they have been cleared to do so by military personnel or by cognizant medical experts for those not serviced by military medical services.
2. Contractors will notify the U.S. Navy's contracting officer if they become aware that any of their employees or subcontractors who would otherwise seek to access [name installation or location] as part of performing contract requirements meet one or more of the four criteria above. The notice will provide the name of the contractor or subcontractor employee, identify the applicable criterion or criteria that applies, and explain (for criteria (a), (b), or (c)) when the 14 day period concludes.
FACE MASK INSTRUCTIONS MUST BE FOLLOWED:
Navy is committed to taking every precaution to ensure the health and wellbeing of our people and the nation in response to the coronavirus disease 2019 (covid-19) pandemic. Navy supports, and will continue to implement, all measures necessary to mitigate risks to the force, to our mission and to the spread of the disease. The center for disease control and prevention (CDC) recommends wearing cloth face coverings in public settings where other social distancing measures are difficult to maintain, especially in areas of significant community-based transmission.
Effective immediately, to the extent practical, ALL individuals, “this includes Navy Contractors,” on DOD property, installations, and facilities are required to wear cloth face coverings when they cannot maintain six feet of social distance.
The below CDC guidance is acceptable. Face coverings will:
a. Fit snugly but comfortably against the side of the face
b. Be from nose to chin full face coverings (like ski masks) are not authorized
c. Be secured with ties or ear loops
d. Preferably include multiple layers of fabric if material is cloth
e. Allow for breathing without restriction
f. Medical or construction type masks, or other cloth covering such as bandanas,scarfs, etc. are acceptable. When in doubt, priority will be compliance with the CDC guidance for function over appearance or preferred date of implementation.

The following are the requirements for entry into Japan as of 2 November 2020 that Contractors shall comply with. See Section 3 for Pre-departure requirements and Section 4 for procedures upon arrival in Japan.
1. IN UPDATE TO REF F, THE PURPOSE OF THIS MESSAGE IS TO
PROVIDE UPDATED POINT OF CONTACT INFORMATION TO SYSCOMS, WARFARE
CENTERS AND CONTRACTING ACTIVITIES RESPONSIBLE FOR THE COORDINATION
OF SHIP REPAIR AND MODERNIZATION EFFORTS IN JAPAN.
2. GUIDANCE ISO DOD AND INTERNATIONAL RESTRICTIONS AS A RESULT OF
COVID-19 MITIGATION ACTIONS. SRF-JRMC IS UTILIZING THE FUNCTIONALITY
OF THE REGIONAL MAINTENANCE AND MODERNIZATION COORDINATION OFFICE
(RMMCO) IDENTIFIED IN REFS (A) AND (B) TO MANAGE THESE UNIQUE TRAVEL
REQUIREMENTS.
3. ANY PERSONNEL SUPPORTING SRF-JRMC MAINTENANCE AND MODERNIZATION
SHALL COMPLY WITH THE GUIDANCE PROVIDED OR RISK DENIAL OF ENTRY TO
JAPAN AND/OR COMMANDER FLEET ACTIVITIES YOKOSUKA (CFAY) OR
COMMANDER FLEET ACTIVITIES SASEBO (CFAS). DUE TO COVID-19
RESTRICTIONS, ENTRY REQUIREMENTS TO JAPAN IN SUPPORT OF MISSION
ESSENTIAL MAINTENANCE/MODERNIZATION IN WHICH SRF-JRMC SERVES AS
THE NAVAL SUPERVISORY AUTHORITY (NSA) ARE AS FOLLOWS (PRE-DEPARTURE):
A. PERSONNEL MUST HAVE A VALID PASSPORT FOR THE INTENDED PERIOD
OF STAY IN JAPAN.
B. APPROVAL MUST BE OBTAINED THROUGH TRAVEL TRACKER INDIVIDUAL
ANTI-TERRORIST PLAN (TT/IATP) VIA THE IATP.PACOM.MIL WEBSITE. THIS
REQUIRES LEVEL 1 ANTI-TERRORIST AND SURVIVAL, EVASION, RESISTANCE,
AND ESCAPE (SERE) TRAINING BE ACCOMPLISHED VIA
JKODIRECT.JTEN.MIL/ATLAS2/PAGE/LOGIN/LOGIN.JSF WEBSITE; AND A
PERSONNEL RECOVERY MISSION SOFTWARE (PRMS) SUBMISSION THROUGH
PRMSGLOBAL.PRMS.AF.MIL.
C. APPROVAL MUST BE OBTAINED THROUGH AIRCRAFT AND PERSONNEL
AUTOMATED CLEARANCE SYSTEM (APACS) FOR ENTRY TO INDOPACOM AOR. (FOR
SRF-JRMC SPONSORED WORK, SEA21 WILL PROVIDE O7 APPROVAL. ALL OTHER
SPONSORS WILL OBTAIN O7 LEVEL APPROVAL VIA THEIR COC).

JAPANESE IMMIGRATION OFFICIALS UPON ARRIVAL AT PORT OF ENTRY.
CURRENT AUTHORIZED PORT OF ENTRIES INCLUDE COMMERCIAL AIRPORTS AT
TOKYO (NRT OR HND) AND MILAIR VIA YOKOTA AND OTHER LOCATIONS
APPROVED BY C7F OR CPF.
4. UPON COMMENCING TRAVEL, THE FOLLOWING POST-DEPARTURE
REQUIREMENTS ARE IN EFFECT:
A. TRANSPORTATION FROM THE PORT OF ENTRY TO CFAY OR CFAS WILL
BE COORDINATED THROUGH THE RMMCO OFFICE. RMMCO OFFICE WILL PROVIDE
GOVERNMENT TRANSPORTATION INFORMATION ONLY. TRANSPORTATION WILL
BE VIA GOVERNMENT TRANSPORTATION AND SHALL NOT INCLUDE USE OF PUBLIC
TRANSPORTATION BETWEEN PORT OF ENTRY AND LOCAL RESTRICTION OF
MOVEMENT (ROM) BASE (CFAY OR CFAS). IT IS THE TRAVELERS
RESPONSIBILITY TO UTILIZE GOVERNMENT TRANSPORTATION FROM PORT OF
ENTRY TO CFAY OR CFAS.
B. TRAVELERS WILL BE TESTED FOR COVID-19 UPON ENTERING JAPAN
AND ARE HIGHLY RECOMMENDED TO BE TESTED FOR COVID VIRUS WITHIN
72 HOURS PRIOR TO TRAVELING. TRAVELERS WHO ARE FOUND POSITIVE FOR
COVID-19 MUST BE PREPARED FOR:
1. ISOLATION FOR A MINIMUM OF 14 DAYS WITHIN CFAY
BARRACKS OR DESIGNATED QUARANTINE FACILITY.
2. ROOM CLEANING CHARGE UP TO $1000.
3. CASH OR ELECTRONIC FUNDS TRANSFER TO ALLOW FOR
PURCHASING OF FOOD AND INCIDENTALS.
C. TRAVELERS WILL ENTER A 14 DAY ROM PERIOD ON BASE
(CFAY OR CFAS) AND WILL NOT BE ALLOWED TO UTILIZE PUBLIC
TRANSPORTATION. DAILY SELF HEALTH CHECKS WILL COMMENCE UPON
ENTRY INTO JAPAN. TRAVELERS SHOULD INCLUDE A PERSONAL THERMOMETER
FOR TAKING DAILY TEMPERATURE READINGS. THE DAILY HEALTH CHECKS WILL
BE REPORTED TO THE APPROPRIATE RMMCO OFFICE OR ON-SITE SPONSOR. IN
THE EVENT A TRAVELER SHOWS INDICATION OF INFLUENZA LIKE ILLNESS
(ILI), SRF-JRMC RMMCO OFFICE WILL COORDINATE FURTHER HEALTH
ASSESSMENT REQUIREMENTS WITH THE LOCAL MILITARY TREATMENT FACILITY
(MTF).
D. UPON COMPLETION OF THE 14-DAY ROM PERIOD, THE RMMCO OFFICE
WILL COORDINATE THE BASE CHECK IN PROCESS. ENTRY ON TO
COMMANDER FLEET ACTIVITIES YOKOSUKA OR SASEBO WILL REQUIRE:
1. CAC (IF GOVERNMENT EMPLOYEE)
2. REGISTRATION IN DBIDS IS CRITICAL TO ENSURE BASE ACCESS
PRIORITY ISO MISSION ESSENTIAL TASKING IN CASE BASE HPCON LEVEL
CHANGES.
3. VISIT REQUEST VIA JPAS FOR SHIPBOARD ENTRY.
4. GOVERNMENT ORDERS (IF GOVERNMENT EMPLOYEE) OR LETTER
OF AUTHORIZATION (IF CONTRACTOR EMPLOYEE). THESE DOCUMENTS SHOULD
INDICATE MISSION ESSENTIAL NATURE OF WORK.
5. SATISFACTORY DAILY SELF HEALTH CHECK.
E. COMMENCE WORK THROUGH WORK COMPLETION PERIOD. DAILY HEALTH
SCREENINGS WILL BE REQUIRED TO BE CONDUCTED BY EACH TRAVELER AND
REPORTED TO THEIR RESPECTIVE ONSITE LEAD OR SPONSOR, AND REPORTED TO
THE RMMCO OFFICE. ADDITIONAL SCREENINGS BY BASE OR SHIP PERSONNEL
ARE LIKELY AND MAY INCLUDE TEMPERATURE CHECKS. FACE MASKS ARE
MANDATORY TO BE WORN AT ALL TIMES WHILE ON BASE (CFAY OR CFAS), AND
HIGHLY ENCOURAGED TO BE WORN OFF BASE. IF AT ANY TIME A TRAVELER
SHOWS INDICATIONS OF ILI, THEY SHOULD RETURN OR REMAIN AT THEIR
TEMPORARY LODGING AND REPORT STATUS TO THEIR RESPECTIVE ONSITE
LEAD OR SPONSOR, TO BE REPORTED TO THE RMMCO OFFICE.
F. UPON COMPLETION OF WORK, TRAVELERS SHALL REPORT AND CHECKOUT
WITH THE RMMCO OFFICE TO VERIFY ANY ADDITIONAL PERMISSIONS REQUIRED
FOR EXITING JAPAN.

52.203-18 PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL
CONFIDENTIALITY AGREEMENTS OR STATEMENTS--REPRESENTATION (JAN 2017)
(a) Definition. As used in this provision-- Internal confidentiality agreement or statement, subcontract, and subcontractor, are defined in the clause at 52.203- 19, Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements.
(b) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions), Government agencies are not permitted to use funds appropriated (or otherwise made available) for contracts with an entity that requires employees or subcontractors of such entity seeking to report waste, fraud, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.
(c) The prohibition in paragraph (b) of this provision does not contravene requirements applicable to Standard Form 312, (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.
(d) Representation. By submission of its offer, the Offeror represents that it will not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (OCT 2020)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Items. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the
Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services--
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)
(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--
(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or
(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.
(b) The Offeror represents that--
