JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Underwater Warfare Center (NUWC) Division Keyport, Contracts Division Code 023.

2. Description of the Action Being Approved

Award of a firm-fixed price contract for commercial products on a sole source basis for a Laser Ablation system to Adapt Laser Systems.

3. Description of Supplies/Services

NUWC Keyport is procuring a portable handheld laser ablation unit which is comprised of base 1000W pulsed laser unit with controller and chiller, umbilical assembly and work head.

Additionally, other general services will be procured such as training and technical support.

Contract must be awarded no later than 30 Sep 2020, with delivery of equipment by 30 Sep 2021, and a period of performance to 30 Sep 2025.

The above procurement satisfies the needs of the Government’s technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1). Only one responsible source and no other supplies or servicers will satisfy agency requirements, as implemented by FAR 6.302-1.

5. Rationale Justifying Use of Cited Statutory Authority

The Adapt Laser System equipment is

A Broad Agency Announcement (BAA) was solicited through the National Center for Manufacturing Sciences in FY19 for an operational demonstration of Commercial-Off-The-Shelf laser ablation coating removal equipment. There were four (4) responses to the request: Adapt Laser Systems, General Lasertronics, SurClean, and Atmospheric Plasma Solutions.

Of the four (4) companies that submitted proposals only Adapt Laser Systems has commercially built and

The Naval Undersea Warfare Center (NUWC) Division Keyport awarded purchase order, N0025319P0102, to Adapt Laser Systems to rent its 1000w pulsed laser system for research purposes. This led to a significant amount of investment in the metallurgical qualification, procedural documentation, and environmental qualifications for the Adapt Laser Systems equipment. The environmental operating permit is nearly completed, which is specific to the equipment for which it is written. In accordance with FAR 9.202, qualification processes and requirements have subsequently been developed to support future qualification of additional vendors to broaden capability and increase competition.

The rental contract with Adapt Laser Systems for the purposes of metallurgical qualification, environmental qualification and Operational Demonstration was completed satisfactorily.

The cost to the government to duplicate the qualification effort would be approximately based on actual project costs that have been incurred during this project. This value does not include any previous government expenses funding research and development projects through the National Shipbuilding Research Program for early development and testing of this equipment.

Working toward qualification of another source would delay this project approximately 18-24 months due to the volume of testing required, procedural development and approval, and coordination of funding on the government side. The current project has been in execution for over 2 years, however it is assumed that lessons learned would help to accelerate the overall process. 6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

As noted above, a Broad Agency Announcement was solicited through the National Center for Manufacturing Sciences in FY19 for an operational demonstration of Commercial-Off-The- Shelf laser ablation coating removal equipment. There were four (4) responses to the request: Adapt Laser Systems, The following is a breakdown of the submittals:

- Adapt Laser Systems:

The proposed contract was synopsized on betaSAM.gov on 15 June 2020 and only expressed interest in this requirement. For the reasons discussed in paragraph 5 above, is not able to support the requirements of this contract. was provided guidance on the required qualification and coordination with the Navy if they wish to have their equipment considered for future procurements.

To date, no other sources have expressed interest in this procurement.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will determine that the cost or price negotiate for this procurement is fair and reasonable prior to contract award.

8. Actions to Remove Barriers to Competition

In accordance with FAR 9.202, the following steps must be performed to become a qualified system for naval asset usage:

Government site visit, where a Technology Readiness Assessment and Manufacturing Readiness Assessment is conducted.

Initial operational demonstration showing efficacy of removal of navy coatings and government review of equipment function and process parameter evaluation.

Development of qualification test plan, which will likely include tensile testing, metallography (surface and cross sectional views), adhesion, and fatigue testing (multiple material conditions).

o There is potential for follow-on testing for weldment fatigue tests.

Technical warrant holder review of qualification test data/report.

Develop/review and approved equipment training plan and curriculum.

Develop and approve operating procedure and process instruction.

Performance of operational demonstration and review results.

Formal technical warrant holder letter of approval.

This process is documented in the Strategic Technology Transition Plan for Laser Ablation, which is currently under review for approval.
