JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Undersea Warfare Center

Division, Keyport (NUWC Keyport), Contracts Department (Code

02).

2. Description of the Action Being Approved

Contract N0025320P0057 for a regular overhaul (ROH) of YTT-

11 was awarded by NUWC Keyport to Bay Ship & Yacht Co. on 03

March 2020 after full and open competition using a lowest price technically and past performance acceptable (LPTA) methodology. The awarded value was $3,288,950, with a maximum potential value of $4,245,204. Inspections conducted throughout the Period of Performance (PoP) of the

YTT-11 ROH revealed that growth work beyond that originally solicited was required. Repair work is necessary to ensure the safe operation (and return to NUWC Keyport) of the vessel. To minimize safety, schedule, and cost risk, the work must be completed on current contract at Bay Ship &

Yacht Co.’s facilities within the existing PoP.

Growth work will be negotiated on a sole-source basis with the contractor, since competing this requirement would preclude the repairs from being accomplished expeditiously and would negatively impact ship schedule and safety. Bay

Ship & Yacht Co. will use its current workforce, facilities, and equipment to enact the repairs to allow the YTT-11 to return to Keyport, WA, and with as little disruption as possible to the scheduled and unscheduled operational needs of the vessel.

Authority to act under this J&A expires 25 September 2020.

3. Description of Supplies/Services

The following table identifies the growth work items that will result in a contract ceiling increase along with the proposed prices.

It is anticipated that all work will be performed during the current PoP that ends 25 September 2020.

All growth requirements have been verified by the certifying technical and requirements personnel.

The additional contract increases will be funded using

FY20 RDT&E funds.

4. Statutory Authority Permitting Other Than Full and Open

Competition

10 U.S.C. 2304(g)(3): Only One Source Reasonably Available

(FAR 13.106-1(b)(1))

5. Rationale Justifying Use of Cited Statutory Authority

Schedule and safety implications of growth work delay are discussed below.

It is not feasible to perform the identified growth work at another time or location. As the YTT-11 is currently docked within Bay Ship & Yacht Co.’s facilities, competing this requirement would preclude the repairs from being accomplished expeditiously. Furthermore, the Government cannot direct Bay Ship & Yacht Co. to allow another contractor to enter its facility to make repairs to the YTT-

SCHEDULE IMPLICATIONS: Deferring the work would negatively impact the YTT-11 schedule by removing it for service for up to two months, and this does not include time required to resolicit and award a new contract. This would leave NUWC

Keyport’s only other YTT (YTT-10) as the sole YTT having to support all range events as NUWC Keyport returns to conducting range operations after the COVID-19 shutdown.

This shutdown has created a backlog of range events to be conducted. Having the YTT-11 tied up for an additional two months extends the single point of failure for YTT support of range events and delays a November range event that requires both YTTs.

Superstructure Preservation: The paint on the superstructure is delaminating. Failure to correct this will cause deterioration of the superstructure’s base metal and eventual structural failure, resulting in extensive steel repairs in the future.

Traction winch hydraulic motor shaft and hose repairs:

The traction winch shafts are pitted and scored and the hoses are cracked and failing. Without the traction winches, the ship cannot go into moor or conduct recovery operations using a remotely operated vehicle

(ROV).

SAFETY IMPLICATIONS: Deferring the below growth work would also seriously impact the YTT-11’s and its crew’s ability to safely transit over 900 nautical miles back to NUWC Keyport.

L-drive sleeve seal replacement: The L-drive sleeve seal is scored, allowing lube oil to be flung from the motor into the space. The L-drives are used for ship propulsion and maneuverability and loss of lube oil is dangerous to the equipment.

Main shaft scoring and pitting repairs: The propulsion shaft’s pitting and scoring reduces the integrity of the shaft and the ship’s propulsion system. This work must be accomplished in a dry dock. A functional propulsion shaft is required for maneuvering.

Stern tube preservation: The stern tube is severely corroded. The corrosion in the stern tube is suspected to be a causal factor in the failure of the stern tube shaft bearings. Preservation of the stern tube is required to maintain its structural integrity. This work must be accomplished in a dry dock.

Bow thruster diverter actuator shaft repairs and bow thruster valve tiller arm replacement: The diverter actuator shaft bearings are seized and the tiller arms are inoperable and required for proper operation of the bow thruster. The bow thruster system is used in mooring evolutions and during torpedo launch events.

Based on the foregoing analysis, it is the Government’s intent to have Bay Ship & Yacht Co. perform this critical growth work while the vessel is at its facility in order to protect the vessel from the risks described above. It is imperative to begin this work quickly in order to ensure its completion prior to the end of the PoP.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

No other sources have expressed interest as this requirement has not been advertised or announced to the public. No additional market research has been conducted due to the urgency of the requirement.

The importance of making the above repairs promptly impedes the Contracting Officers’ ability to solicit maximum competition. Based on the urgency of the repairs and lack of control over access to Bay Ship & Yacht’s facilities, it is impractical to request proposals from other Offerors. The requirement will not be synopsized per FAR 5.202(a)(11) and

FAR 13.105(a), as the proposed action is made under the terms of an existing contract that was previously synopsized in sufficient detail to comply with the requirements of

5.207 with respect to the current proposed contract action.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A are fair and reasonable.

8. Actions to Remove Barriers to Competition

The work was discovered during the open and inspect phase of the ROH. Future contracts will incorporate greater built-in allowances for additional growth capacity.
