JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea (NAVSEA) Systems Command, Naval Undersea Warfare Center, Division Keyport, WA (NUWC Division Keyport), Detachment Pearl Harbor Intermediate Maintenance Activity (IMA), Contracts Department, Code 02, intends to procure the following supplies under circumstances other than full and open competition, based on the following.
2. Description of the Action Being Approved
Award of a firm fixed price contract on a sole source basis for Mart Tornado 40 Parts Washers and Mart EQ-1 Wastewater Processing Systems to Stingray Manufacturing, LLC, Doing Business As (DBA) Stingray Parts Washers (Stingray).
3. Description of Supplies/Services
The procurement is for two (2) Mart Tornado 40 Parts Washers and two (2) Mart EQ-1 Wastewater Processing Systems to replace the existing Mart Tornado 40 Parts Washers and Mart EQ-1 Wastewater Processing Systems. Stingray is the Original Equipment Manufacturer (OEM) and is qualified to provide the Mart Tornado 40 Parts Washers and Mart EQ-1 Wastewater Processing Systems.
The total estimated value for this procurement is . The unit cost for each Mart Tornado 40 Parts Washers is for a total of . The unit cost for each Mart EQ-1 Wastewater Processing System is for a total of . The funding type for this procurement is Fiscal Year (FY) 2016 Operations & Maintenance, Navy (OM&N). The funding planned for this acquisition is currently available. Delivery of all items will be sixteen (16) weeks after contract award.
4. Statutory Authority Permitting Other Than Full and Open Competition
The statutory authority is 10 U.S.C. 2304(c)(l), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by Federal Acquisition Regulation (FAR) 6.302-1.
5. Rationale Justifying Use of Cited Statutory Authority
There are currently three (3) Mart Tornado 40 Parts Washers and three (3) Mart EQ-1 Wastewater Processing Systems located at the . It is necessary to replace two (2) of the Mart Tornado 40 Parts Washers and two (2) of the Mart EQ-1 Wastewater Processing Systems, since the Mart Tornado 40 Parts Washers and Mart EQ-1 Wastewater Processing Systems······· ••••••••••• ; and are beyond economical repair. A site visit was conducted by the OEM to perform an analysis of the equipment. Upon receipt of the detailed report for repair of the current systems, it was determined by the NA VSEA technical community (NUWC Keyport, NUWC Newport, and NAVSEA Program Office) that the four (4) items were beyond economical repair.
Additionally, the repair would only be a temporary fix to the •••••••••••• issues.
The Mart Tornado 40 Parts Washer is a high powered commercial parts washer that is capable of thoroughly cleaning the parts which does not strip the anodizing off the parts. The Mart Tornado 40 Parts Washer is utilized at the , to clean all of the parts components for the , during the maintenance cycle vice expending labor for personnel to hand wash the parts in a deep sink. All Parts are cleaned thoroughly prior to install.
The Mart EQ-1 Wastewater Processing System is utilized for the waste stream from the Mart Tornado 40 Parts Washer and the removal of the chemicals in the Mart Tornado 40 Parts Washers.
The Mart EQ-1 Wastewater Processing System has inter-connectivity to the Mart Tornado 40 Parts Washer. There are currently no other commercial parts washer manufacturers with this capability.
The inter-connectivity between the Mart Tornado 40 Parts Washer and the Mart EQ-1 Wastewater Processing System is imperative. Additionally, the Mart EQ-1 Wastewater Processing System is the only approved system for use by the Pearl Harbor Navy Region Joint Base Environmental Department. For a new wastewater system to be approved by Pearl Harbor Navy Region Joint Base Environmental Department, the process would take a minimum of two (2) years.
The only manufacturer of the Mart Tornado 40 Parts Washers and the Mart EQ-1 Wastewater Processing Systems is Stingray Manufacturing, LLC, DBA Stingray Parts Washers, 2450 Adie Road, Maryland Heights, MO, 63043-3504.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research has been conducted, and no additional sources have been identified for Mart Tornado 40 Parts Washers and Mart EQ-1 Wastewater Processing Systems. A request for information was posted to FedBizOpps in accordance with the Under Secretary of Defense Memorandum; "Actions to Improve Department of Defense Competition" dated 21 August 2014. No responses were received from interested vendors. Alternative Washers and Processing Systems will not be acceptable to the Technical Authority, because the Government requires the units to be replaced immediately to not impact operations.
Approving alternate sources would require testing to ensure anodizing does not get stripped off and the parts are cleaned thoroughly. Additionally, there is no other source for the EQ-1 waste stream, which is imperative to process the waste and must have inter-connectivity to the Tornado 40 Washer unit.
No other manufacturers have the inter-connectivity capability between the Mart Tornado 40 Parts Washers and Mart EQ-1 Wastewater Processing Systems. No other wastewater processing system is approved by the Pearl Harbor Navy Region Joint Base Environmental Department. Based on this information, it will not be possible to select alternate sources without extensive cost to the Government.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the cost to the Government for the supplies covered by this Justification and Approval (J&A) will be found fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, The Naval Sea Systems! Command, NUWC Division Keyport, Contracts Division Code 02 has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, the Naval Sea Systems Command, NUWC Division Keyport, Contracts Department Code 02 will assess whether competition for future requirements is feasible.
