Source Selection Information – See FAR 2.101 and 3.104
16.505(b)(2)(i). The applicable exception to the fair opportunity process for this justification for the award of an order exceeding the MPT, but not exceeding the simplified acquisition threshold, is:
FAR 16.505(b)(2)(i)(B) - Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
This is a justification for the use of items particular to one manufacturer, under the authority of 10 U.S.C. 3406(c)(5), as implemented by FAR 16.505(a)).
The supplies for the proposed acquisition must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. The current equipment presently installed/performing is the GSync Time and Frequency Reference Systems by FEI-Zyfer, Inc.
The proposed acquisition is being solicited as a firm-fixed-price purchase order on a Brand- Name basis from authorized resellers.
5. Specific characteristics of the supplies or services support an exception to the fair opportunity process (i.e., unique features, function of the item, etc.). Describe in detail why only this/these supplies/services and/or awardee(s) can furnish the requirements to the exclusion of other supplies/services and/or awardees.
FEI-Zyfer, Inc. is the original manufacturer of the Gsync Time and Frequency Reference Systems, and these assemblies include hot swappable items for existing USNO assets. The GSyncs are capable of supporting hot-swappable modules that are compatible with USNO’s existing chassis units. The specific build modules the USNO requires are include the Ovenized Quartz Crystal Oscillator (OXCO), and modules that support external 1 pulse-per-second (1 pps) synchronization, Inter-range instrumentation group (IRIG) time code generation, ethernet, and Precision Time Protocol (PTP v2) as well as a uniformly high standard of manufacture and assembly. USNO currently uses the FEI-Zyfer GSync 391 series in operations. The installed modules are hot-swappable across the chassis, so this purchase will allow the USNO to improve operations both by adding to current supply to meet the new need and creating a bank of ready spares in case of failure.
6. Market Research. Provide a description of the market research conducted among awardees and the results thereof OR a statement of the reason market research was not conducted.
Market Research was conducted to ascertain if this acquisition meets the FAR definition (as outlined in FAR 2.101) of a Commercial Supply. In accordance with FAR Part 10, a determination has been made that the required items are of a type customarily used by the general public or by non-governmental entities for purposes other than governmental and have been sold to the general public. In addition, the contracting office determined that the items outlined in this acquisition can be procured on a firm-fixed-price (FFP) basis. This acquisition (and any resultant contract action) will be executed incompliance with the requirements of the federal regulations applicable to such action (i.e. FAR,DFARS, etc.) as well as governing policy.
In addition, market research revealed that the GSync Model391 chassis are copy righted products solely owned and licensed by FEI-Zyfer, Inc. The requiring activity posted an advertisement
Source Selection Information – See FAR 2.101 and 3.104 requesting information on NASA SEWP for two weeks to see if there were any authorized resellers and received no offers. The contract specialist searched GSA Advantage for the required products, as these items were previously purchased from said vehicle. The items are no longer offered on GSA Advantage as FEI-Zyfer did not renew their contract.
The contracting office received offers from previously unidentified authorized resellers during the solicitation process. As a result, the proposed acquisition will be re-solicited and processed on a Brand-Name basis for authorized resellers using simplified procedures (SAP) in accordance with FAR 13.106-1(b)(1)(i)
