DEPARTMENT OF THE NAVY

NAVSUP FLEET LOGISTICS CENTER NORFOLK

1968 GILBERT STREET SUITE 600

NORFOLK VA 23511-3392

IN REPLY REFER TO

J&A #: 15739

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

The U.S. Navy Naval Supply Systems Command (NAVSUP) Fleet Logistics Center, Norfolk, VA

(NAVSUP FLC Norfolk).

2. Description of the Action Being Approved

This is a sole source commercial firm fixed price definite delivery definite quantity contract with Ecolab, Inc., 370 N Wabasha Street, Saint Paul, Minnesota, 55102-1323.

3. Description of Supplies/Services The Commander Navy Region Mid-Atlantic (CNRMA) Fleet Family Readiness, Regional Food Service has requested the procurement of dishwasher lease and maintenance at eight (8) regional galleys. The following table displays the estimated total cost of the services:

Period Period of Performance

Base Period 16 April 2018 – 15 April 2019

Option Period 1 16 April 2019 – 15 April 2020

Option Period 2 16 April 2020 – 15 April 2021

Option Period 3 16 April 2021 – 15 April 2022

Option Period 4 16 April 2021 – 15 April 2022

Subtotal

FAR 52.217-8 16 April 2022 – 15 September 2022

The Government intends to utilize annual fiscal year 2018 Operations and Maintenance, Navy (O&M, N) funds for this procurement.

4. Statutory Authority Permitting Other Than Full and Open Competition

The statutory authority permitting other than full and open competition is 41 USC 1901(e)(2) - a sole source acquisition under the authority of Special Rules for Commercial Items, as implemented by Federal

Acquisition Regulation (FAR) 13.501(a).

5. Rationale Justifying Use of Cited Statutory Authority

It is imperative CNRMA keeps the existing contractor, Ecolab, Inc. to ensure avoidance of re-fitting existing building electrical, plumbing and drainage systems for each of the eight (8) galleys to match any new machines. The cost associated with changing any of the electrical, plumbing and drainage will require establishing a new requirement and contract with Naval Facilities Engineering Command

(NAVFAC). Creating a new contract with NAVFAC would be cost prohibitive to the command. The tasking for such work would require CNRMA to obtain new work permit approvals from each galley once

NAVFAC has selected a contractor. Additionally, drawings with specification worksheets would also have to be obtained and funded before any new installation is performed. Although the process would take approximately 90-120 days, there are additional unforeseeable circumstances that would further delay the requirement. Due to the age of the galley buildings, in the past, wiring delays have caused

CNRMA to obligate additional funding for paper products utilized to provide meals.

Further, dishwasher equipment has a high rate of obsolescence, rewiring eight (8) buildings for one piece of equipment does not help CNRMA’s mission of meeting the nutritional needs of service men and women, nor is this type of work cost effective. When compared with alternative solutions, leasing the equipment from Ecolab for five (5) years reveals that the Government will save over the time frame of the lease.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable Market Research was conducted by CNRMA and NAVSUP FLC Norfolk through review of previous purchases, posting of a sources sought notice and internet searches including GSA e-Library, Federal Business Opportunities and Dynamic Small Business Search.

7. Determination of Fair and Reasonable Cost

The contracting officer will determine the anticipated cost to the Government for the services covered by this J&A to be fair and reasonable.

8. Actions to Remove Barriers to Future Competition There are no foreseeable future requirements for these services at this time. If another potential source emerges, NAVSUP FLC Norfolk will assess whether competition for future requirements is feasible.

9. Contracting Point of Contact The point of contact at NAVSUP FLC Norfolk is Ms. Krystal Goodman, who can be reached at (757)
