JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY: The requiring activity is the Commander Navy Installations Command (N95), Navy Wounded Warrior-Safe Harbor Program Office, Arlington, VA. The contracting activity is the NAVSUP Fleet Logistics Center Norfolk, Philadelphia Office.

2. NATURE/DESCRIPTION OF CONTRACT ACTION: This requirement is a sole source action to be awarded as a new delivery order to The Bacik Group for a period of one year estimated at $822,039.00.

3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES: Navy Wounded Warrior- Safe Harbor is the Navy’s lead organization for coordinating the non-medical care of seriously wounded, ill, and injured Sailors and their family members. Through proactive leadership, Safe Harbor provides a lifetime of individually tailored assistance options designed to optimize the success of our Shipmates’ recovery, rehabilitation, and reintegration activities. In January 2010, OSD announced its joint partnership with the US Olympic Committee to host the Inaugural Wounded Warrior Games, an athletic competition between each Service Component’s Wounded Warrior Program enrollees. The event was held at the USOC training site in Colorado Springs, CO. The event shed light on the role of adaptive sports in the recovery and rehabilitation of these warriors. As a result, OSD has made recommendation to support comparable Adaptive Athletics Programs within each component.

The Navy Safe Harbor Program Office has been tasked to stand up an Adaptive Athletics Program that will be offered to program enrollees for the Navy. The proposed acquisition is to procure services that continue the development and expansion of the Adaptive Athletics Program that will be offered to program enrollees for the Navy. The contractor shall provide program management, analytical, and policy support in the continuation of the Navy Safe Harbor Adaptive Athletics Program and provide training specialists to provide on-site training to program participants at training camps, adaptive athletics recreational events, and throughout the year and at the Annual Wounded Warrior Games in May 2014.

The total value of this acquisition is projected to be approximately $822,000 and will be funded with FY13 OM&N funds. The period of performance will be 30 September 2013 through 29 September 2014.

4. IDENTIFICATION OF STATUTORY AUTHORITY: The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c)(5), Authorized or Required by Statute, Sole Source Awards to Service-Disabled Veteran-Owned Small Business Concerns, as implemented by FAR 6.302-5(b)6.

5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY: Bacik Group has been determined to be the only qualified SDVOSB source to perform the required services.

Bacik Group's experience and current infrastructure provides them with the immediate capability to support the seamless continuation of Navy Wounded Warrior-Safe Harbor's Adaptive Athletics Program. Bacik Group is uniquely qualified to perform this requirement as the President of Bacik Group has significant personal experience with Wounded Warrior programs following his serious injuries suffered while serving our nation in Iraq. Mr. Bacik's personal experience as a recovering amputee gives Bacik Group a unique understanding of the wounded warrior population and will help to grow the Navy's Wounded Warrior-Safe Harbor's Adaptive Athletic program and meet the Navy's aggressive timeline for execution of the program.

Bacik Group has unique experience in the arena of Adaptive Athletics and has a large network of experts that they are able to provide. The arenas in which they provide expertise are coaching, training, and programmatic consultation to the Navy. Two of their staff members previously worked with the USOC's Military Paralympic Sports program that founded the annual Warrior Games and provided sports programming to military treatment facilities around the country. The personnel on staff have a varied background to include introductory sports, intermediate, and competitive knowledge. These wickets are in keeping with NWW-SH Adaptive Athletics Program's Three Tier Approach. There is a dedicated representative available and ready to facilitate each of these three tiers.

Bacik Group's workforce has significant experience working with the Navy's seriously wounded, ill, and injured individuals. The staff members know the sailors on a personal level and have an intimate knowledge of CNIC’s athletics program. In addition, they have been instrumental in facilitating CNIC’s 5 year strategic athletics plan that provides for a wealth of opportunities in FY14.

The company has an incomparable repertoire with various entities outside of the military, such as, but not limited to the United States Paralympics Committee, Veteran's Affairs, and charitable resource organizations that provide vital recovery and rehabilitative support to Wounded Warriors. These relationships are critical to facilitating the Navy's sole Wounded Warrior Adaptive Athletics Program.

This sports program is an extremely important piece of the Navy Wounded Warrior Program's recovery, rehabilitation, and reintegration initiatives. It is one of the few programs where the lasting impression of the services provided can be observed. Presently, 268 recovering service members are registered for adaptive sports. The ripple effect of a change in vendor, would severely affect the lives of the nearly 300 sailors.

This requirement will be awarded as a Set-Aside for a Service Disabled Veteran Owned Small Business (SDVOSB) under the authority of a Sole Source Awards to Service-Disabled Veteran-Owned Small Business Concerns, as implemented by FAR 6.302-5(b)6. A direct award to Bacik Group LLC will be made based on Bacik Group’s SDVOSB designation by the Department of Veteran Affairs VetBiz Registry.

In addition, Bacik Group is the only known SDVOSB source that has the immediate capability to support the rapid creation of Navy’s Wounded Warrior Adaptive Athletic Program. Market research was performed to find other available SDVOSB sources that are capable of performing the required services. The results of this market research showed there was no other available SDVOSB capable of performing the services as detailed in paragraph 6.

6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY OFFERORS AS PRACTICABLE: Market research was performed to evaluate whether other SDVOSB sources were capable of providing the required services. Market research members contacted Service Disabled Veteran Owned Small Businesses directly while also researching potential SDVOSB sources via Government contract websites such as GSA. No capable sources were found.

Direct award to Bacik Group is consistent with the Navy’s mandate to increase contracting opportunities with small business and supports the Navy’s SDVOSB acquisition goal. Bacik Group has been determined to be the only qualified SDVOSB source with the capability to support the rapid creation of Navy’s Wounded Warrior Adaptive Athletic Program.

Additionally, a combined solicitation/synopsis will be posted on NECO. Any challenges of the SDVOSB sole source award to the Bacik Group will be evaluated accordingly.

7. DETERMINATION OF FAIR AND REASONABLE COST:

The NAVSUP Fleet Logistics Center Norfolk, Philadelphia Office Contracting Officer will determine that the price negotiated for this acquisition to be fair and reasonable in accordance with FAR 13.5.

8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: All future requirements will be handled on a case-by-case basis.
