JUSTIFICATION AND APPROVAL

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department

2. Description of the Action Being Approved

Award of a firm fixed priced contract on a sole source basis for critical equipment to be used by the Naval Surface Warfare Center, Dahlgren Division (NSWCDD), , manufactured by Boston Micromachines Corporation (BMC).

3. Description of Supplies/Services

The following items, manufactured by Boston Micromachines Corporation (BMC), are required:

The estimated cost of the proposed contract action is . Navy Working Capital Improvement Project (CIP) funding will be utilized for this procurement.

4. Statutory Authority Permitting Other Than Full and Open Competition

5. Rationale Justifying Use of Cited Statutory Authority

The requiring activity is the Naval Surface Warfare Center, Dahlgren Division (NSWCDD), . The NSWCDD is

Undergoing , while maintaining the current capability .

. Similarly, a higher frame rate is needed. With the addition of longer wavelength requirements, a broadband coating is needed from visible to far short-wave infrared. Higher end BMC mirrors meet all of these and the base requirements.

. Only BMC products can meet the Government’s need

There are very few deformable mirror manufacturers, limiting the availability. Switching to a new manufacture would introduce unacceptable cost and schedule risk to the mission.

. Market research and knowledge from subject matter experts provided one other manufacture of a compatible deformable mirror, in regards to the performance requirements. However, the risk to cost and schedule due to switching to a new infrastructure, as described above, is considered unacceptable.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Market Research was conducted through vendor and subject matter expert (SME) discussions, online research, and obtaining a market research quote. The required supplies are available strictly from the manufacturer, Boston Micromachines Corporation. In addition, discussions with the manufacturer have confirmed that there are no authorized resellers for this proprietary equipment.

The proposed contract was synopsized on the SAM.Gov website on 28 February 2024 and only Boston Micromachines Corporation expressed interest in this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Boston Micromachines Corporation to provide the required equipment.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Dahlgren Contract Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
