JUSTIFICTION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department,

2. Description of the Action Being Approved

Award of a firm fixed priced contract on a sole source basis for critical equipment to be used by the Gun & Electric Weapon

Systems Department , Test & Evaluation Division , manufactured by Weibel Scientific.

3. Description of Supplies/Services

The Potomac River Test Range (PRTR) Test Engineering Branch currently has a requirement to procure a Tracking Radar System and Supporting Accessories from Weibel Scientific, to expand current testing capabilities. This effort also includes system set-up, interconnection, start-up and training on the system once operational. Delivery is required nine (9) months after receipt of the order, or sooner, if available.

The Government's minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open

Competition

The procedures in FAR subpart 13.5 were used in accordance with

41 U.S.C. 1901.

J&A Number: DL-19-0234

5. Rationale Justifying Use of Cited Statutory Authority

The PRTR has a requirement to expand and enhance the current radar capabilities by obtaining a second Weibel tracking radar with increased transmitter power and antenna gain to meet current and future development programs.

This specific radar and supporting accessories/software is required to ensure compatibility and interface with existing equipment and capabilities, and to obtain consistent data across past and future testing. Additionally, the has developed written and approved operations and maintenance procedures for the existing Weibel Radar system and supporting equipment. These procedures are directly applicable to the We.ibel system. A radar system from another manufacturer would require replacement of the existing equiµment, re-design and retesting existing data for analysis comparison, retraining of personnel and research and testing to develop new operating and maintenance procedures, resulting in at least 6 months and additional costs in excess of

$535,000.00 as well as reflect major delays across multiple programs. This additional cost could not be recovered through full ·and open competition.

6. Description Qf Efforts Made to Solicit Offers from as

Many Offerors as Practicable

Market research revealed that Weibel Scientific is the original equipment manufacturer with no authorized resellers or distributors of the required system.

The proposed contract was synopsized on the Federal Business

Opportunities (FEDBIZOPPS) website on 29 July 2019 and only

Weibel Scientific and their United States VS) subsidiary expressed interest in this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Weibel Scientific to provide the required equipment.

7. . Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.

NCH 53.6-2

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Dahlgren Contract Department

Has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
