JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department
2. Description of the Action Being Approved
Award of a firm fixed priced contract on a sole source basis for critical equipment to be used by the
High Power Radio Frequency (HPRF) System , manufactured by Teledyne E2V (UK)
_Limited.
3. Description of Supplies/Services
Three (3) High Power MG5875, is required.

4. Statutory Authority Permitting Other Than Full and Open Competition
The procedures in FAR subpart 13.5 were used in accordance with 41 u . s .c. 1901.

5. Rationale Justifying Use of Cited Statutory Authority
The Joint Non-Lethal Weapons Directorate (JNLWD) has tasked the to develop a non-lethal vessel stopping capability that uses HPM technology to disrupt critical engine control electronics. The use of HPM for vessel stopping presents significant advantages over current capabilities (e.g. , entanglement nets, engine disabling munitions, and physical boarding of the vessel) . The FY19 HPRF Vessel Stopping Prototype (VSP) effort includes the strategy, planning, and technical development of a narrowband HPRF experimental vessel stopping system for future planned integration onto a USCG vessel that shall undergo a 1-year USCG evaluation. The current Te2v systems have several technical specifications that have not been found available through other magnetron system vendors. These specifications are output power, variable output power, pulse width, pulse repetition rate, and duty cycle. These Te2v components have been identified as front running solutions to achieve an output of 7.5 MW and therefore meet VSP source requirements. Performance parameters of the source that shall be characterized and validated include peak output power, pulse with, pulse repetition frequency, burst duration, non-transient peak voltage, and others. The results will also be compared against preliminary VIPER performance specifications.
Subsequently, NSWCDD has made design improvements that led to performance enhancements capable of increasing overall power output of existing magnetron sources, i.e. FCT 5MW magnetron.
NSWCDD has also designed, procured, and built a thermal management test bed which incorporated source heat loading and compatibility with the solid state Marx test stand. The test bed will be used to validate the thermal regulation system against several environmental parameters such as air temperature, water temperature, and solar loading. These components must be compatible (form, fit, and function) with the currently installed components in the system while meeting the required specifications. This Te2v magnetron is the only known component to meet all specifications and maintain compatibility within the systems to be utilized. Te2v developed this proprietary hardware that matches the required technical parameters and is the most mature example of this technology in industry. Due to the complexity of system operation and proprietary rights, Te2v is the only company that can provide this proprietary equipment.
The Government has invested over $284,500. 00 in the evaluation of these components to include testing and labor. In addition, the investment the program has made is estimated to be more than $3.9

J&A Number: DN-19-01 49 million over a 3 year period. This investment would not be recovered through full and open competition.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
The VSP program has been conducting market research and desi.gn studies since the origination of the program in 2015. Extensive market research was conducted in an attempt to find other sources for the magnetron systems that would meet the current design requirements, and providing confidence in system reliability and design maturity to minimize life cycle costs. Market research was conducted via peer review, current known manufacturer capabilities, Requests for Information submitted to FedBizOpps and internet research. To date there been no responses that meet the required specifications.
The proposed contract .will synopsized on the Federal Business Opportunities (FEDBIZOPPS) expressed interest in this requirement. No additional arket research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than E2V to provide the required equipment.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
The RFI has been poted since February 23 of 2018 in order to stay abreast of current industry capabilities to enhance competition in the future. The RFI has since expired on February 23rct of 2019 with no responses that meet the required specifications. For the reasons set forth in Paragraph 5, Dahlgren Contract Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
