JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department

2. Description of the Action Being Approved

Award of a firm fixed priced contract on a sole source basis for critical equipment manufactured by DRS Laurel

Technologies.

3. Description of Supplies/Services

DRS Laurel Technologies will be providing the following equipment:

Delivery is required 26 weeks after receipt of the order, sooner, if available. The Government's minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open

Competition

The procedures in FAR subpart 13.5 were used in accordance with 41

U.S.C. 1901.

5. Rationale Justifying Use of Cited Statutory Authority

The IRIS Processors and IRIS VDAD2 VME CCAs are

These specific components have been identified as the sole pieces of hardware possessing the form, fit, and function to match joint capabilities that the national mission operators have been trained to perform the mission with. The procurement of the hardware and software selected to support the

DRS Laurel Technologies is the original equipment manufacturer

(OEM) of these proprietary components with no authorized resellers available, therefore, proprietary data limits competition.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

Market research included contacting the OEM, DRS, to determine if authorized resellers were available for these proprietary products. That market research has confirmed that DRS possesses the proprietary design drawings, manufacturing processes and integration/test procedures necessary to produce these items with no authorized resellers available.

The proposed contract was synopsized on the Federal Business

Opportunities (FEDBIZOPPS) website on 14 Dec 2018 and only DRS

Laurel Technologies expressed interest in this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than DRS Laurel Technologies to provide the required equipment.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Dahlgren Contract

Department has no plans at this time to compete future contracts for the type of equipment covered by this document, due to the fact that the components are proprietary, military focused catalog items. DRS is not willing to sell the requisite data rights to the government for these catalog items that would enable competitive procurement. If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
