JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department

2. Description of the Action Being Approved

Award of a firm fixed priced contract on a sole source basis for critical equipment in support of the Warfare Systems Department

, Test Environment Engineering Branch , manufactured by Advanced Simulation Technology, Inc. (ASTi). Authority to act under this Class J&A expires on 30 September 2018.

3. Description of Supplies/Services

ASTi will provide the following required equipment:

The required delivery is one hundred twenty (120) days or as soon as possible after receipt of the order. The Government's minimum needs have been verified by the certifying technical and requirements personnel.

The estimated cost of the proposed contract action is

$206,200.00. Fiscal year 2018 (FY18) Other Procurement, Navy, funds will be utilized for this procurement.

4. Statutory Authority Permitting Other Than Full and Open

Competition

5. Rationale Justifying Use of Cited Statutory Authority

The requires replacement spares is an ASTi system. In order to maintain compatibility with the existing system the requested parts must be compatible replacement spares in all aspects (form, fit and function) for existing equipment currently installed.

Utilizing another manufacturer’s products would require a complete redesign of the existing system that would result in an unbudgeted and unanticipated substantial duplication of costs, estimated at $3,000,000.00, to the government in testing, training, development and cause unacceptable delays, estimated at eight (8) months, to program schedules and fielding. In addition, the sites currently have over $2,000,000.00 worth of

ASTi components installed. Utilizing another manufacturer’s products would result in the lowest replaceable units (LRUs) being incompatible with each other.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

Market research consisted of contacting knowledgeable individuals in government and industry regarding market capabilities to meet requirements, reviewing the results of recent market research undertaken to meet similar or identical requirements, querying government data bases that provide information relevant to agency acquisitions, participating in interactive, on-line communication among industry, acquisition personnel, and customers, obtaining source lists of similar items from other contracting activities or agencies, trade associations and other sources and reviewing catalogs and other generally available product literature published by manufacturers, distributors, and dealers or available on-line.

As a result of the above market research and the review of the manufacturer’s compatibility and system specifications, it was revealed that these products would be the only solution compatible with the production suite. Market research revealed that ASTi is the original equipment manufacturer of the requested hardware. Market research also revealed that ASTi has no authorized resellers available.

The proposed contract was synopsized on the Federal Business

Opportunities (FEDBIZOPPS) website. ASTi expressed interest in this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than ASTi to provide the required equipment.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For reasons set for in Paragraph 5, Dahlgren Contract Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
