JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department
2. Description of the Action Being Approved
Award of a firm fixed priced contract on a brand name basis for critical equipment to be used by the
, manufactured by Nano Dimensions Technologies, LTD.
Authority to act under this J&A expires 30 September 2018.
3. Description of Supplies/Services
Nano Dimensions Technologies, LTD or an authorized reseller will be providing installation, training, and the following equipment:

The requested 3D Printer and associated material are required 90 days after receipt of the order with installation and training to be completed within 6 months of receipt of the order. The
Government's minimum needs have been verified by the certifying technical and requirements personnel.

5. Rationale Justifying Use of Cited Statutory Authority
The
; the DragonFly 2020 Pro 3D printer meets the minimum requirements while providing flexibility with various printing materials and multi-layer functionality. A patent, copy right or proprietary data limits competition. Only the original equipment manufacturer (OEM), Nan
Dimension Technologies, LTD or an authorized reseller can provide the required items.
Awarding to another vendor brand of 3D printers would require additional capability testing that would exceed the cost of the previously researched and tested printers and would not meet the program schedule requirements for 2018. Any deviation from this unit will create a substantial amount of reevaluation costs and logistic postponements by the Air Force; as this 3D printer meets the ability to produce components that have form, fit, and function of existing composite components of all
. If another brand of 3D printers were to be used, it is estimated to cost the Government an additional $1M in certification and validation costs. These costs could not be recovered through full and open competition.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
Market research was conducted through internet searches and contact with the OEM, Nano Dimensions Technologies, LTD. Market research performed has shown that Nano Dimension Technologies, LTD has limited authorized resellers available for their proprietary equipment. One small business reseller was found for sales in the United States, Kemeera Incorporated, doing business as Fathom, Inc. No other authorized resellers could be found for this region.
The proposed contract will be synopsized on the Federal Business
Opportunities (FEDBIZOPPS) website. It is not practicable, for the reasons discussed in paragraph 5 above, for any other company other than Nano Dimension Technologies, LTD or an authorized reseller to provide the required equipment.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, Dahlgren Contract
Department has no plans at this time to compete future contracts for the type of equipment covered by this document specifically due to the components being in a national security system. If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
