JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department

2. Description of the Action Being Approved

Award of a firm fixed priced contract on a brand name basis for

Tornado VxWorks licenses and support for the Naval Surface

Warfare Center, Dahlgren Division (NSWCDD), and the Combat

Information Technology (IT) Division, IT Operations Branch.

Authority to act under this J&A expires 30 November 2018.

3. Description of Supplies/Services

Wind River Systems, Incorporated or an authorized reseller partner will be providing the following proprietary licenses and support:

The Government's minimum needs have been verified by the certifying technical and requirements personnel.

The estimated cost of the proposed contract action is

$251,797.00. Fiscal year 2018 Working Capital Fund funding will be provided for this procurement. Award is requested to begin 3

May 2018 to avoid a break in support. The period of performance is for 12 months of license support and services.

5. Rationale Justifying Use of Cited Statutory Authority

The NSWCDD has standardized the Wind River product line for the

Research, Development, Test and Evaluation (RDT&E) network with

Tornado VxWorks software as a major software component within this environment for the development of programs supporting national security initiatives, command and control of military forces, testing and development of equipment that is an integral part of a weapon or weapons system, or systems which are critical to the direct fulfillment of military or intelligence missions. Tornado VXworks software has been used for over 15 years by engineers and scientists throughout the NSWCDD.

Tornado VXworks is a tool utilized to produce systems engineering views of processes, objects, and analyze those views to help identify vulnerabilities and breakdowns. Without this software maintenance renewal, users will experience a work stoppage. The Wind River Tornado, version 6.X, is Department of

Navy Application and Database Management System identification number 5366 approved. The major benefits of procuring the same vendor product to the original installation are as follows:

(1) To date, the IT Division has already invested in

Wind River products and licenses. Procuring the software maintenance renewal will maintain the integrity of data and compatibility with the technical architecture of RDT&E. Also, assured software compatibility saves time and manpower that would be required to test and evaluate other vendor products to determine if they would be seamlessly compatible and reliable with existing architecture and data; and

(2) Enables maximization of existing NSWCDD experience and minimizes operations and maintenance efforts and costs by not having to become knowledgeable on two families of business software. Multiple vendors or configurations would require additional human resources, training, and the inherent costs incurred by maintaining multiple vendor products. In addition, data rights limit competition. Wind River Systems, Incorporated is the software publisher for this proprietary software.

Disapproval of this request would unduly impact the ability of

NSWCDD to run and manage the day to day operations of its intelligence mission.

This specific brand name is also required to maintain supportability and security stature with current RDT&E networks.

Use of any other brand software would require replacement of current software and new evaluation to ensure compatibility and reliability resulting in a duplication of costs to the government, estimated at $500,000.00 that could not be recovered through full and open competition.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

Market research for other potential brand solutions was not performed for the reasons specified above. A patent, copy right or proprietary data limits competition. Market research was performed to identify authorized resellers for Wind River products and support through contacting the original equipment manufacturer (OEM), Wind River, Incorporated. One (1) authorized reseller for government customers, Avnet USI, was identified by the OEM.

The proposed contract is anticipated to be synopsized on the

Federal Business Opportunities (FEDBIZOPPS) website during the month of March 2018 or April 2018. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Wind River, Inc. or an authorized reseller to provide the required software renewals.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the software and support covered by the

J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Dahlgren Contract

Division will continue to provide limited competition for future contracts for the type of software renewals covered by this document, where available. If another potential source emerges, Dahlgren Contract Division will assess whether competition for future requirements is feasible.
