DEPARTMENT OF THE NAVY

NAVAL SURFACE WARFARE CENTER

DAHLGREN DIVISION

6149 WELSH ROAD, SUITE 203

DAHLGREN, VIRGINIA 22448-5117

IN REPLY REFER TO

DL# 14064

24 July 2018

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department.

2. Description of the Action Being Approved

Award of a firm fixed priced contract on a sole source basis for

Microsoft (MS) Premier Services, manufactured by Microsoft

Corporation.

3. Description of Supplies/Services

The following MS Premier Support services are required for the

Naval Systems Engineering Resource Center (NSERC) a centralized operation which supports Naval Systems Engineering efforts:

Description Quantity

Support Account Management hours 800 Hours

USNAT Program Hours 200 Hours

Designated Support Engineering* (Azure IaaS) 800 Hours

Designated Support Engineering* (SharePoint) 200 Hours

Designated Support Engineering* (SQL-Database) 200 Hours

The Government's minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open

Competition

41 U.S.C. 1901, Simplified Acquisition Procedures

5. Rationale Justifying Use of Cited Statutory Authority

The MS Premier Support will provide the NSERC a knowledgeable

Application Development Manager, SharePoint Engineer, and SQL

Engineer from Microsoft, all of whom can provide strategic architectural advice and guidance, insight and planning around new technologies, including code samples. Through Premier

Support for Developers, NSERC will gain an Application

Development Manager from Microsoft who will provide a wealth of development experience. Specifically, the individual will utilize their NSERC strategic architectural advice and guidance, insight and planning around new technologies, and general “how-to” advice, including code samples. The application Development

Manager will ensure that optimal software development and testing environments are in place to streamline software development and drive success. The Application Development

Manager, being directly linked to Microsoft, will coordinate with Microsoft support-engineering teams and other resources to deliver in-depth technical services such as labs, workshops, code reviews, debugging, and optimization services. The NSERC knows from experience that only Microsoft Application

Development managers can meet the needs of the NSERC/Navy in providing the support required. Specifically, no other external developer would be able to architect the technologies required within the NSERC infrastructure and the hardware, software and networking required to ready the NSERC for the Microsoft Azure

“Cloud” environment. The cloud environment is rapidly changing and only a Microsoft developer and teams within Microsoft can use their knowledge to guide NSERC in their preparation for the move to the cloud. Contracting with the owner of the cloud will ensure there will be no waste of time and funds in developing software ready for the cloud.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

Prior to selecting Microsoft Premier Support, the NSERC performed exhaustive research as to determine the best acquisition strategy to support both Microsoft software and the future of the Microsoft cloud environment. Specifically, the

NSERC reviewed: 1) A large number of technical journals, both in print and found on the internet; 2) Held in-person and teleconference based meeting with experts in the field and with other cloud providers; and 3) Held specific meetings with

Microsoft to determine if there were any third-party experts who may come close to their capabilities. This market research determined that Microsoft is the only entity with the expertise and resident knowledge required to fully support the government’s requirements.

This investment would not be recovered through full and open competition. The continued MS

Premier Support will continue to guarantee interoperability, compatibility and integration with current systems already operating in this computing environment.

The proposed contract was synopsized on the Federal Business

Opportunities (FEDBIZOPPS) website on 25 July 2018 and only one vendor, Microsoft, expressed an interest in this requirement.

No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Annapolis Micro Systems, Inc. to provide the required equipment.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the software and support covered by the

J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Dahlgren Contracts

Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contracts Department will assess whether competition for future requirements is feasible.
