JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department

2. Description of the Action Being Approved

Award of a firm fixed priced contract on a brand name basis for critical equipment to be used by the Missile Systems Integration and Weapons Effectiveness Division, H30, manufactured by Shimadzu Scientific Instruments, Inc.

3. Description of Supplies/Services

Shimadzu Scientific Instruments, Inc. or an authorized reseller will provide a quantity of one (1) Hyper Vision High-Speed Video Camera, part number HPV-X2, manufactured by Shimadzu Scientific Instruments, Inc. Training on the system and preventative maintenance are also required to ensure this investment is fully utilized and maintained for future applications. Delivery is required 30 days after receipt of the order with training and maintenance provided within 90 days of receipt of the order.

The Government's minimum needs have been verified by the certifying technical and requirements personnel.

The estimated cost of the proposed contract action is $239,000.00. Fiscal year 2018 Capital Improvement Project funds will be utilized for this procurement.

5. Rationale Justifying Use of Cited Statutory Authority

This camera system will be part of a larger instrumentation suite being purchased to upgrade performance of the 40 mm Light Gas Gun located in the H32 Shock Physics Facility (Bldg 424). It is required to record high-speed deformation of materials in support of a wide range of Navy and Joint research programs conducted at the H32 Shock Physics Facility. This state-of-the-art system will provide the high framerate (10,000,000 frames per second) and resolution (400 x 250 pixels) at double the number of frames of any other system. These speeds are required for observing shock propagation and material response to highly transient loading conditions from high-speed projectile impact. The data produced from this system will support the H30 Department modeling and simulation community (M&S) by providing validation data for simulations involving shock physics and structural mechanics as well as lethality, vulnerability and effectiveness analysis. It will also have broad application across NSWCDD and other Warfare Centers seeking high strain-rate response of materials. The current camera used by the Shock Physics Facility has a much slower framerate than the HPV-X2. The facility is being upgraded with the addition of a new fast opening valve to fire the projectile under test. The speed of the current camera is not capable of recording the projectile impact with the required resolution. No other brand name camera is available to meet the government’s requirement matching the required speed, resolution and framerate. Shimadzu Scientific Instruments, Inc. is the original equipment manufacturer of this proprietary system with limited authorized resellers available, therefore, proprietary data limits competition.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Market research performed through internet searches and review of catalogs and technical specifications has no other system will match the speed, resolution, and the amount of frames recorded as the Shimadzu Hyper Vision HPV-X2 High-Speed Video Camera. The alternative to purchasing the camera is contracting the tests out to other facilities resulting in long lead time and increased cost due to higher overhead and manpower costs. The Department of Energy (DOE) has the only facilities comparable for this testing. Costs for each test are approximately $25,000.00 higher through DOE than Dahlgren. At 20 tests per year, a saving of

$500,000.00 will be realized annually in performance of this testing. Market research has also shown that a patent, copy right or proprietary data limits competition. There are limited authorized resellers for this Shimadzu Corporation trademarked system.

The proposed contract will be synopsized on the Federal Business Opportunities (FEDBIZOPPS) website, to be competed amongst authorized resellers. For the reasons discussed in paragraph 5 above, no further market research will be conducted for any company other than Shimadzu Scientific Instruments, Inc. or an authorized reseller to provide the required equipment.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Dahlgren Contract Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
