JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare
Center, Dahlgren Division (NSWCDD), Contracts Department
2. Description of the Action Being Approved
Award of a firm fixed priced contract on a brand name basis for critical software to support the Naval Surface Warfare Center, Dahlgren Division (NSWCDD) Integrated Warfare Systems Laboratory
(IWSL), Code V42, manufactured by Kongsberg Geospatial Ltd..
3. Description of Supplies/Services
The IWSL, Code V42, requires a quantity of eighty-four (84)
InterMAPhics Warranted Runtime Licenses, part number IMWRT5, manufactured by Kongsberg Geospatial Ltd.. Seventy-one (71) licenses are to be immediately ordered, and thirteen (13) are to be included as optional quantities to purchase within one year.
The Government's minimum needs have been verified by the certifying technical and requirements personnel.
The estimated cost of the proposed contract action is $420,000.

4. Statutory Authority Permitting Other Than Full and Open
Competition

5. Rationale Justifying Use of Cited Statutory Authority
The NSWCDD, V43 has been tasked with building a Virtual Test
Environment (VTE) for Aegis Tactical Console Display. This task is to be completed by the VTE team funded by the Program
Executive Office, Integrated Warfare Systems (PEO IWS) 1.0TI/SE.
This environment will be running a virtualized version of a tactical combat system. The IWSL’s mission is to provide the facilities and support infrastructure required to test and certify Aegis computer programs lifecycle support engineering for
Aegis class Cruisers and Destroyers. The IWSL requires these licenses, which have been chosen by NAVSEA, in order to test and certify Aegis computer programs for use in fleet and land-based test sites. Kongsberg Gallium InterMAPhics is approved in DON
Application and Database Management System (DADMS) for the NSWCDD under DADMS ID 63606. Failure to procure the requested licenses will result in a deficiency in providing other Warfare Centers, supporting customers, and sponsors with a low-cost, proven tactical platform to perform their program Test and Evaluation and Validation/Verification work. Without these software licenses, development currently underway will halt. This would impact future missions, and would delay the development and deployment of systems. Utilizing another manufacturer's product would require a complete redesign of the existing system that would result in an unbudgeted and unanticipated substantial duplication of costs, estimated at $3,000,000.00, to the government in testing, training, development and cause unacceptable delays, estimated at eight (8) months, to program schedules and fielding.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
Market research has shown that Kongsberg Geospatial Ltd. is the developer of the requested software licenses. Lockheed Martin chose this software to be the display technology for all Aegis tactical console displays and is part of the tactical software installation delivery to NSWCDD; no other software can perform this task. This software is fully integrated into the installation disk and cannot be purchased through any other manufacturer. Market research has also shown that Kongsberg
Geospatial Ltd. has limited authorized resellers available. They have worked with small businesses in the past and will fully honor any procurement of their software and licenses. In addition, the software meets the needs of the AEGIS Program and that other companies’ similar products lacked the particular features, does not meet or cannot be modified to meet the agency’s requirement.
The proposed contract is anticipated to be synopsized on the
Federal Business Opportunities (FEDBIZOPPS) website during the month of July 2018. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Kongsberg
Geospatial Ltd. or an authorized reseller to provide the required licenses and support.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraphs 5 and 6, Dahlgren
Contract Department has no plans at this time to compete future contracts for the type of software covered by this document.
