JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department
2. Description of the Action Being Approved
Award of a firm fixed priced contract on a sole source basis for critical equipment and training in support of the Electromagnetic Environmental Effects (E3) Spectrum Supportability Branch, (B51), manufactured by CRFS, Inc. Authority to act under this Class J&A expires on 30 September 2018.
3. Description of Supplies/Services
CRFS, Inc. will provide the following required equipment:

EMB-NCP0003 NCP embedded software license, required per Node to use with RFeye Site.
EMB-APP0001 RFeye Apps: Logger. Embedded application for continuous background spectrum data collection and processing.
J&A Number:
APP-MON0001 RFeye Monitor application software:
Integrated, configurable application for collecting and managing spectrum data from a network of widely distributed RFeye Nodes. Includes 1 server application license and 1 web client user license. Server license allows connection for up to 10 Nodes
APP-SIT0001 RFeye Site application software, designed for multi-user, multi-mission applications on multi-node networks.
EXT-TDA0002 RFeye Site extension: TDOA, extension to core RFeye Site application software, ordered in addition.
The required delivery is twelve (12) weeks after receipt of the order. The Government's minimum needs have been verified by the certifying technical and requirements personnel. The estimated cost of the proposed contract action is $392,319.00. Fiscal Year (FY) 2018 Naval Innovative Science and Engineering (NISE) funds will be utilized for this procurement.

5. Rationale Justifying Use of Cited Statutory Authority
The NSWCDD E3 Spectrum Supportability Branch, B51 has a requirement to develop the Electromagnetic Warfare (EMW) In-Port Spectrum Monitoring capability (prototype), develop the accompanying EMW training scenario (tool), and participate in a land-based demonstration under a FY 2018 NISE funded project.
This NISE project is an enabler for one of the EMW tenets:
battlespace awareness. With this NISE project, the Surface Navy warfighters will be provided: 1) the detection while stationary in port to alert the port authority of a potential damaging situation thus maintaining operational readiness; 2) the notification of potential Hazards of Electromagnetic Radiation to Personnel (HERP); 3) the ability to alert port authority of potential violations of the national broadband plan; and 4) monitor the ships emissions and positions to alert the ship’s crew to changes in the littoral restrictions. The CRFS RFeye Site Node and Monitor is the equipment used by Real Time Spectrum
Operations (RTSO), the transition program for this NISE project.
In order to leverage the current RTSO configuration and build toward future RTSO capability, the requested hardware must be the same in all aspects (form, fit and function) as the current configuration already in use. Procuring equipment from another manufacturer would present unacceptable schedule risks to the Electromagnetic Warfare (EMW) In-Port Spectrum Supportability within the overarching Department of Defense required timeline.
The cost of this would be upwards of $700,000.00 and in excess of twelve (12) months of time to research, procure, install, reconfigure, reprogram software code and retrain personnel on a different system.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research by the B51 engineering team was conducted to find expert resources to meet the needs of the program. Market research included reviewing online product literature published by manufacturers and consulting with B Department Subject Matter Experts (SMEs). RTSO proprietary data limits competition. CRFS, Inc. is the sole manufacturer identified during research with the ability to deliver hardware required to meet frequency response, portability, weather resistivity, and compatibility requirements.
Market research has also found that CRFS, Inc. has no authorized resellers available.
The proposed contract will be synopsized on the Federal Business Opportunities (FEDBIZOPPS) website as a sole source requirement basis for critical equipment and training, manufactured by CRFS, Inc.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
Future procurements for this item are not planned at this time but should another requirement emerge, additional market research will be performed to gage market conditions and to determine if any resellers have been authorized.
