JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department
2. Description of the Action Being Approved
Award of a firm fixed priced contract on a sole source basis for critical repairs and equipment to be used by the Electromagnetic Environmental Effects (E3), Systems Integration Branch, Code B51 and E3 Systems Integration Branch, Code B54, manufactured by Tektronix, Inc.
3. Description of Supplies/Services
The procurement consists of one (1) service task to repair one (1) Real Time Spectrum Analyzer (RSA) 6114A, S/N: B020573 and trade-in two RSA 6114As, S/N: B010481 and B010332 for two new RSA5126Bs in support of mission requirements for various critical development programs. The two current Real Time Spectrum Analyzers, serial number: B010481 and B010332 will be traded in to receive a 30% discount off of the initial price of two (2) new RSA 5126B units. The new units will operate the same as the older units and be able to read pre-existing data files from the X-COM IQC5255B Dual channel Wideband RF I/Q Capturer and Storage Systems. Real Time Spectrum Analyzer 6114A, S/N: B020573 will be repaired and calibrated at a cost of $3,079.00 and S/N: B010481 and B010332 will be traded in for 2 new RSA5126B’s at a trade-in value of $52,614.00 for a total of $174,662.60. The repairable unit, S/N:
B020573 will be repaired and set back to the OEM specifications while S/N: B010481 and B010332 will remain at Tektronix. Delivery is required as soon as possible after award of the order but not later than 28 February 2018.
The Government's minimum needs have been verified by the certifying technical and requirements personnel.
The estimated cost of the proposed contract action is $177,741.60. Fiscal year 2018 Research, Development, Test and Evaluation funds will be utilized for this procurement.
4. Statutory Authority Permitting Other Than Full and Open Competition

5. Rationale Justifying Use of Cited Statutory Authority
Electromagnetic Environmental Effects (E3), Systems Integration Branch recently used the Tektronix Real Time Spectrum Analyzers during an onsite test event. The units failed to operate correctly and needed to be sent back to Tektronix for evaluation, the Original Equipment Manufacturer (OEM). It was determined that the units needed to be repaired and/or traded- in due to the error that was occurring. The units OEM warranty has expired and due to the uniqueness and proprietary nature of the equipment, they can only be repaired and calibrated by Tektronix. Tektronix provided a copy of the repair history of all three units, and it was determined that 2 of the 3 units had recent failures costing the government in excess of $50,000.00 in repairs over the past 2 years. Therefore, it was determined to be more cost effective to trade these units in for a discounted price on 2 new, warrantied units. Utilizing another manufacturer’s product would create an unanticipated and unbudgeted need to reconfigure and replace all existing hardware, software and support. This additional effort is estimated to cost in excess of $1,100,000.00 and require an additional 24 months to research, rewrite software to support post processing of data, certify, train and deploy a new system. There are no follow-on procurements known at this time.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research though contacting the OEM, Tektronix, has shown that the OEM does not have any authorized repair agents for their proprietary equipment. Due to the proprietary nature of the equipment. B51/B54 are the technical agents for the Department of the Navy (DON) for the Electromagnetic Environmental Effects (E3) program under the Navy’s tech warrant holder Naval Sea Systems Command (SEA 05W43). As such, B51/B54 have the responsibility to measure, quantify and resolve electromagnetic interface between radar, SATCOM, electronic warfare, weapons and other shipboard systems.
Failure to repair these analyzers could cause substantial impact to mission critical requirements.
The proposed contract was synopsized on the Federal Business Opportunities (FEDBIZOPPS) website on 05 January 2018 and only Tektronix, Inc. expressed interest in this requirement.
It is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Tektronix, Inc. to provide the required equipment.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, Dahlgren Contract Department has no plans at this time to compete future contracts for the type of equipment covered by this document.
If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
