JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Division.
2. Description of the Action Being Approved
Award of a firm fixed price contract on a sole source basis for
Rockwell Collins receiver units for the Combat Direction Systems
Activity, Dam Neck (CDSA DN), C6ISR Systems Division, R10, manufactured by Rockwell Collins.
3. Description of Supplies/Services
Items to be procured include one (1) Rockwell Collins IFMR-6070
Instantaneous Frequency Measurement (IFM) Receivers (P/N 822-
2926-002), one (1) Rockwell Collins CS-5020C Microwave Receiver
(P/N 70730-49), and one (1) Rockwell Collins CS-5027 Digitizer
(P/N 70730-06). The required delivery date is 365 days after receipt of the order.
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open
Competition
10 U.S.C. 2304(c)(1) – Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority
The Rockwell Collins IFMR-6070 IFM Receiver provides the instantaneous frequency measurement in conjunction with the

Rockwell Collins CS-5020C Microwave Receiver and CS-5027
Digitizer, required to meet mission requirements while maintaining the interoperability, functionality and compatibility with current system configurations held in inventory. The Rockwell Collins IFMR-6070 IFM Receiver is newly emerging technology which provides the additional instantaneous signal detection capabilities used in conjunction with the
Rockwell Collins CS-5020C Microwave Receiver and CS-5027
Digitizer mission requirements. Only Rockwell Collins possesses the proprietary design drawings, manufacturing processes and integration/test procedures necessary to produce these items.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
Market research has shown that proprietary data rights limit competition; Rockwell Collins is the Original Equipment
Manufacturer (OEM), and is the only corporation that produces the IFMR-6070 IFM Receiver, CS5020C Microwave Receiver and the
CS-5027 Digitizer.
Use of another vendor’s product, assuming a qualified vendor can be found, would require unbudgeted and unanticipated system integration, operability, functionality, and form fit re-design and testing, impacting the timely systematic installation of the Rockwell Collins IFMR-6070 IFM Receiver with the CS-5020C
Microwave Receiver and CS-5027 Digitizer to meet mission requirements. The cost to the Government to duplicate this capability would be in excess of $2,500,000.00.
A Sources Sought Notice was posted on the Federal Business
Opportunities (FEDBIZOPPS) website on 29 June 2016 and only
Rockwell Collins expressed an interest in this requirement. The proposed contract was synopsized on the Federal Business
Opportunities (FEDBIZOPPS) website on 18 July 2016 and only
Rockwell Collins submitted a response. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Rockwell Collins to provide the required equipment.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
No actions are planned to be taken to ensure that future procurements for the required supplies or services will be competed, due to the fact that the IFM receiver, microwave receiver and digitizer are proprietary, military focused catalog items. Rockwell Collins is not willing to sell the requisite data rights to the government for these catalog items that would enable competitive procurement.
